責任及細則 (郵輪旅行團)

顧客須於作出任何付款前細讀本“重要責任及細則” 所載的條款及條件,當顧客付款後將視為接受所有條款及條件。

愛旅航有限公司保留變更、刪除或新增條款的權利。每次顧客進行旅行預訂時,都有責任閱讀並接受這些條款。在這些預訂條款經過變更、刪減或新增後,若顧客仍繼續使用愛旅航有限公司的服務即表示顧客認可並接受本條款。如有任何爭議,愛旅航有限公司保留最終決定權。

A)責任問題

  1. 愛旅航有限公司(「本公司」)安排之交通工具(如郵輪、輪船、火車或巴士等)、住宿、膳食、旅遊觀光或娛樂項目,均非由「本公司」擁有,管理或控制,而是按照當地獨立旅遊代理人及服務機構單位所定的規則條款下簽發及安排。顧客了解所有預訂均受這些條款和任何其他服務提供商特定條款或細則,包括政策的約束(「服務供應商條款」),這些條款或細則應在顧客完成預訂之前提供。 如果這些條款與服務供應商條款發生抵觸,以服務供應商條款的相關規定為準。在發生突發或未能預料的情況下,顧客同意及接受當地旅遊代理人及提供服務機構單位最終的安排,並同意此等安排不構成違反旅行團的商品說明。如遇交通延誤、行李損失、意外傷亡及財物損失等,顧客同意及接受僅向擁有、管理或控制有關交通工具、酒店、食肆、旅遊點或娛樂項目之供應商及機構直接交涉及追討或索償,不論交涉、追討或索償結果如何,顧客不會要求「本公司」對此負上任何責任及放棄向「本公司」追討或索償。
  2. 郵輪公司、酒店及其他旅遊機構之服務,均非由「本公司」擁有、管理或控制。凡參加「本公司」旅行團之顧客如遇有財物損失、意外傷亡、天災人禍、機器失靈、交通延誤、失火、罷工、戰爭、政局不安及政府更改條例等而招致損失或引致額外費用時,顧客同意及接受不會要求「本公司」對此負上任何責任及放棄向「本公司」追討或索償。請顧客自行安排及確保有足夠的保險覆蓋該情況下損失。
  3. 除因由「本公司」或其員工之疏忽而引致顧客之個人傷亡外,「本公司」對顧客在任何意外中之個人傷亡、經濟、娛樂或精神損失概不負責。
  4. 「本公司」直接提供之服務(不包括經委託合作機構),均以香港法律來解釋,對「本公司」所有索償必須於香港辦理,而「本公司」對顧客所負之責任,在適用法律許可的最大程度下不會超過顧客所繳交費用之總額。
  5. 「本公司」不具有各地旅遊規例、不安狀態、健康風險、氣候危險、供應商破產、或對於殘疾人士的適合性等相關專業知識。「本公司」提供的相關資訊僅供參考。顧客應自行尋求目的地官方機構所發布的最新資訊並履行有關規定,以確保符合旅遊資格。顧客特此豁免「本公司」,同意不對關於本章節提及的情況中全部或部分內容以及其他任一超出其管控範疇的情形進行申訴,並同意在旅行返程後30天 內提交任何其他關於「本公司」的申訴。所有申訴必須以書面形式提交並附以精準的證據或證明文件。
  6. 顧客參加「本公司」之旅行團前,應參閱相關旅遊警示(如有)。顧客參加旅行團與否,純屬個人決定。如顧客因當地懸掛旅遊警示而自行決定不參加旅行團均當作自動放棄論,所繳費用概不退還,「本公司」不會安排其他替代旅行團或服務。
  7. 自備機票參加旅行團的顧客須先備妥有效旅遊証件、入境簽證、國際機票、所有內陸機票、保險及個別路線之交通安排。顧客必須於指定地點及時間集合。顧客已安排之自定行程及機票如因擬定及/或推介日期沒有出團而需重新編定行程,安排調動更改酒店、郵輪及所引致的損失、額外費用及一切與航空公司安排調動更改機票的事宜,概由顧客自行承擔及處理。
  8. 在發生不能控制或未預料到事件的情況下,「本公司」及其他代理人及當地服務機構單位有權在啟程前或旅途中取消或替換行程內之項目,亦有權縮短或延長旅程,顧客不得異議。各參加旅遊團之顧客同意及接受經調整的行程安排為最終的安排,亦不會把這最終的安排當作違反旅行團的商品說明。
  9. 「本公司」旅行團所採用之團體預訂,必須按列明日期往返,如顧客要求提早到達或延期逗留,「本公司」當盡力為顧客代訂相應的住宿及其他列明之項目(如有)。但不論提早到達或延期逗留之住宿確定與否,顧客不得藉此退團、要求更改出發日期或作出任何索償。提早到達或延期逗留之日期一經確認,一概不能取消或更改,並採用旅行團之預訂條款。顧客同意及接受當旅行團尚未開始或延期逗留開始時,「本公司」安排之行程未有生效或即告結束,逗留期間之費用、責任、行李損失、意外傷亡及財物損失等,均由顧客自負,概與「本公司」及其代理人及當地服務機構單位等無關,亦毋需負上任何法律責任。
  10. 顧客如在旅途中自行離團或放棄行程,離團後「本公司」安排之行程即告完成及結束,離團後須自負責任,一切與「本公司」及其他代理人及當地服務機構單位或其委託機構無關。
  11. 行程中所安排之船票/住宿/觀光等項目,均屬團體訂位,一經「本公司」確認及訂購後,不論任何情況下而未能使用者,概不退回任何款項,不會安排其他替代行程。
  12. 顧客須遵守各國政府之法例,包括但不限於有關風俗、入境或運輸的規定、嚴禁攜帶違禁品、禁止使用航拍機、禁止酒店及住宿房間內吸煙及當地其他違法條例等;違例者須自行負責,「本公司」保留追討因而引致的損失。
  13. 顧客須遵守合理而適當的行為標準,不得侮辱、滋擾、威脅、攻擊或恐嚇其他顧客、工作人員及其他人士。顧客必須依從導遊或其他獲授權者有關安全事宜或依照時間表的合理指引,以旅行團整體利益為依歸。假如「本公司」或當地服務機構單位合理地認為其中任何顧客不遵守行為標準,或不遵守應有謹慎措施及安全規定,或不遵守工作人員指引及安排,或對他人作出滋擾或影響團隊正常活動及安全時,將被視為違約。顧客同意及接受「本公司」或獲授權人士有權採取「本公司」認為合理必要的措施以防止此等行為繼續,包括終止顧客繼續參加旅行團,而「本公司」安排之行程對有關顧客即告完成及結束。而受該顧客監護之18歲以下同行團員亦須一併離團。被終止繼續參加旅行團的顧客,將不獲退款,「本公司」亦不再對其負有責任,亦不會負責承擔被逐離團後的任何行動及費用。
  14. 所有住宿套餐之更改、取消手續及預訂要求,顧客必須直接與「本公司」聯絡及辦理。如顧客自行與住宿或當地服務機構單位作任何私人協議將被視為無效,「本公司」一概不予承認,並有權終止顧客繼續參加套餐不退回任何款項。
  15. 如果「本公司」由於顧客意圖或疏忽、違反法律、公共秩序和道德的行為或顧客未遵守「本公司」的旅行協議的規定而遭受損害,「本公司」將會向顧客索取賠償。
  16. 顧客應將其旅遊証件副本、旅遊收據、旅遊簽證及旅遊保險和所有重要文件副本留於易於聯絡的有關人士,以備在旅程中遺失或損壞文件時用。同時,顧客應確保將家人或朋友的聯絡資料副本,交予導遊及「本公司」,以備在緊急情況下,「本公司」或獲授權人士可以提供協助。
  17. 如顧客表示有敏感情況(食物如堅果,花生等﹔花粉),須自行採取適當的預防措施。如顧客患有嚴重過敏症,請諮詢醫生意見,以了解是否適合在特定情況下參加行程或活動。如有任何特別調節要求,顧客須於報名截止日期前聯絡「本公司」,「本公司」當協助顧客向當地獨立旅遊代理人及服務機構單位要求安排,但以代理人及服務機構單位最後安排為準。
  18. 根據香港特別行政區個人資料(私隱)條例,所有顧客資料除為安排旅行團或觀光行程外,絕對不會提供予第三者。
  19. 報名及責任細則以香港特別行政區法律為依據,所有對「本公司」之索償必須在香港特別行政區辦理。

B)郵輪公司責任問題

  1. 顧客同意及接受所有郵輪產品均受郵輪公司之條款約束及限制。
  2. 顧客必須遵守個別郵輪公司的條款細則,個別船隻航行路線、嬰兒、小童、孕婦、成人等定義。詳情請參閱有關行程單張上所列說明。
  3. 顧客必須遵守各國政府及郵輪公司法例及規則,包括但不限於嚴禁携帶違例物品出入境或登船,違反者需自行承擔一切責任。
  4. 報名前請參閱有關郵輪公司之英文版條款及細則。詳情請向郵輪公司查詢。
  5. 顧客同意及接受艙房住宿、航程路線、泊岸及啟航時間,將以郵輪公司最後安排為準。
  6. 郵輪公司或「本公司」有權因應當日郵輪泊岸時間及當地天氣、交通情況而更改岸上觀光行程之項目,顧客同意及接受郵輪公司或「本公司」有最終的決定權,亦不會把更改岸上觀光行程當作違反旅行團的商品說明。顧客亦就此放棄向郵輪公司或「本公司」追討或索償。
  7. 如因天氣惡劣、海面狀況或各種未能預知或迫不得已的情況下而不能泊岸或更改航程,顧客同意及接受郵輪公司或「本公司」不需作出任何補償。

C)特殊情況

  1. 顧客於出發前須自行了解清楚及預先辦妥所須入境文件包括簽證和入境要求,沿途於任何國家,如顧客因任何理由而被拒或延遲入境,顧客必須承擔此責任及須承擔由此問題而引致同團顧客之損失,「本公司」毋須為此負任何責任。顧客所需額外安排之食宿、交通及其他有關之費用全部由該顧客負責,而未能隨團完成之餘下行程將不會獲得任何補償。
  2. 若顧客因簽證問題(包括但不限未辦簽證或簽證被拒)而不能成行,後果均由顧客自負。「本公司」有權就所繳之團費中扣除因此而引致的一切費用(包括但不限於住宿、膳食、旅遊觀光的費用)及「本公司」的行政費用。
  3. 即使顧客持有有效之入境簽證及旅遊證件,如出/入境時遭本地/當地政府機構或航空公司拒絕出/入境,不論是因其本身背景問題或任何其他原因(不論是否知道原因),顧客同意並接受不能要求「本公司」對此負上任何責任。另所繳團費不得退回或轉予他人或轉用於其他旅行團,顧客須自行繳付期間引致之額外費用。
  4. 行程順序若因特殊狀況及其他不可抗拒之現象;如天氣、交通、航班、列車、船舶影響,而有飯店、景點、餐食順序上之調動,以當地接待社安排為準,顧客不得異議。
  5. 「本公司」當盡力根據行程安排所有酒店,但「本公司」有權視乎當時情形作出更改,如遇酒店突告滿房、大型活動、滑雪期間或其他特殊情況,將安排住宿鄰近(城市)之同級酒店代替。
  6. 行程之任何景點和膳食,如遇節日、假期或特殊情況下關閉或休息,「本公司」及其他代理人有權替換行程內之項目。
  7. 行程中各項活動皆按整體需要而設計及安排。顧客參加此等活動時,應遵守服務人員和郵輪公司之指引及安排,並必先衡量個人的年齡、體格、健康狀況、當時的天氣環境及活動內容等,以評估自己能承擔風險程度,再決定應否參與,並須獨自承擔由此而引致的一切責任及後果。當顧客認為有需要時,更應自行尋求醫生或專業人士提供之意見。
  8. 如果 「本公司」,郵輪公司或當地服務機構單位合理地認為顧客無法参加行程中活動或未能到参與活動的要求,「本公司」或當地服務機構單位將保留自行决定終止顧客加入或繼續参與活動的權利。被終止繼續參加活動的顧客,概不退回任何款項,亦不會獲安排其他替代行程。
  9. 如遇不能控制之特殊情況或航班延誤,導致客人需提出保險索償,顧客需自行與保險公司聯絡。
  10. 政府和旅遊機構或會提供世界各地的疾病預防,安全事項,及防疫注射意見(例如黃熱病)。顧客前往感染風險地區應留意相關資訊和風險評估。有關顧客身體狀況是否適合服用預防藥物或注射疫苗,以及是否能夠服用預防藥物或承受注射疫苗後可能會引起的副作用,請務必於確認訂單前自行尋求醫生或專業人士提供之意見。

D)報名須知

  1. 由於個別國家之出入境條例有別,建議出國顧客之旅遊證件於「旅遊地回程日」起計需有最少6個月有效期。旅遊證件必須有足夠的空白頁數,以蓋上出入境印或入境簽證。參加中國旅行團者必須提供相關旅遊證件副本(如國內居民身份証,回鄉証等)。
  2. 顧客參加中國旅行團,行程期間請隨身攜帶本人的有效旅遊證件原件。國內居民未滿16歲者請攜帶戶口本原件;超過16歲的旅客若沒有辦理身份證,請在戶口所在地開出相關身份證明,以免影響酒店入住或景點入場等安排。出行前顧客請務必檢查證件的有效期。
  3. 「本公司」根據顧客所提供之資料進行預訂手續。顧客必須提供旅遊證件上的完全相符之姓名及資料,並清楚核對收據上參加者的資料。如顧客於報名後更改旅遊證件資料或所提供之資料不符,必須立刻通知「本公司」,因更改資料會導致其預訂須重新辦理,顧客必須繳付由此而產生之額外費用。
  4. 「本公司 」保留取消任何以虛假或重覆名字登記訂單之權利。
  5. 請務必填寫準確有效的聯繫方式(如手提電話號碼及電郵地址),以便「本公司」聯絡顧客。
  6. 當顧客收到確認書時,請仔細核對以確保內容正確無誤,諸如旅行日期、地點、票價和內容。對於因顧客未確認行程而導致的損失和不便,「本公司 」不承擔任何責任。
  7. 預訂一經「本公司」確認及訂購後,除經「本公司」之特別同意及安排,否則不得將預訂轉予他人或轉用於其他出發日期或其他旅行團。
  8. 顧客參加「本公司」之旅行團,必須自行選擇購買適當的旅遊保險;顧客有責任認清承保範圍,必須理解保單內的條款細則,確保所購買的保險能夠覆蓋行程中各項已包及自費活動。
  9. 請保留收據,以作特殊情況下退款之憑據。
  10. 在一個旅行團中,每位顧客可以預訂最多 3 間客房。如果「本公司」認定顧客透過個別預訂的方式總計預訂超過 3 間客房,「本公司」保留取消預訂的權利,並按條款收取相關費用(如適用)。
  11. 訂單需以電子錢包或信用卡形式全數繳付費用,並經過銀行確認過帳,方可作實。所有付款皆以港幣、美金或南韓圜形式結算。若顧客以非港幣、美金或南韓圜結算的貨幣付款,需自行承擔銀行匯率之差異及手續費,詳情請向相關金融機構查詢。
  12. 減免折扣,豁免及其他推廣優惠,必須於報名時申請及提供證明予「本公司」。
  13. 旅行團團費及年齡定義各有不同。詳情請參閱有關行程單張上所列條款細則。
  14. 按行程出發日計算,年齡未滿21歲的顧客須符合下列報名要求:
    • 15歲以下:必須與父或母或監護人同行。
    • 滿15歲而未滿21歲: 如非與父或母或監護人同行,則必須由父或母或監護人同意並於確認書簽署作實,個別國家或有可能要求具備一份合適的旅遊綜合保險及一份入境國家認可的同意書。
  15. 由成人陪同的兒童或嬰兒也需要預約參團,並需付相關參團費用。「本公司」將不會為嬰兒額外提供膳食,酒店床位及任何佔座位之交通安排(包括但不限於旅遊巴士)的座位。如顧客要求提供嬰兒床,「本公司」將協助顧客向住宿供應商面要求安排,但以住宿供應商面保留最終決定權。
  16. 「本公司」保留接受報名與否之最終權利。
  17. 旅行團成行與否受不同因素影響,「本公司」保留最終決定權。若「本公司」最終決定該旅行團不能出發,「本公司」將按旅遊業議會指引退回團費。

E)費用包括

  1. 酒店及郵輪住宿:根據行程表內所列或同級酒店,房間是以兩人共用一雙人房為標準。單人房費(或附加費)則以一人佔一房為標準。
  2. 交通工具(如有):行程表內所列之各式交通工具,惟在發生突發或無法控制事件的情況下,「本公司」及當地獨立旅遊代理人有權替換行程內之交通工具。
  3. 膳食:行程表內所列之膳食,惟在發生突發或無法控制事件的情況下,「本公司」及當地獨立旅遊代理人有權替換行程內之膳食。
  4. 遊覽節目(如有):行程表內所列之遊覽活動,惟在發生突發或無法控制事件的情況下,「本公司」及當地獨立旅遊代理人有權替換行程內之項目。
  5. 領隊之服務(如有):當地領隊接待。每團之出發人數以不少於15人為原則,若個別旅行團人數不足15人,「本公司」將不派當地領隊接待,改由當地導遊接待。個別景點或國家提供之領隊,導遊為英語或華語。顧客不得藉詞反對或退出。
  6. 香港旅遊業議會印花成本。

F)費用不包括

  1. 旅遊證件、各國之入境簽證費。
  2. 給予領隊或導遊或司機之服務費。(除特別註明除外)
    • 服務內容: 與當地旅遊代理人及提供服務機構單位接洽,落實旅行團之包含膳食、住宿、交通及活動安排。辦理酒店入住及退房手續、分配酒店房間。介紹當地風土人情等。
  3. 各國之機場稅、港口稅、燃油附加費、航空保險稅。(除特別註明除外)
  4. 港口服務費、碼頭稅、郵輪上之建議服務費(除特別註明除外)
  5. 一切私人性質之費用。
  6. 所有行程表以外之觀光節目(包括岸上觀光)。
  7. 行程內於當地餐廳用膳期間的私人消費。
  8. 提早到達或延期逗留者住宿或機場之接送費用、單人房附加費、升級房間等級或其他相關之費用。
  9. 因私人、交通延阻、罷工、颱風或其他「本公司」不能控制的情況而引致之額外費用。
  10. 旅行平安、醫藥、行李等保險。
  11. 因個人問題或個人糾紛所引致之責任、延誤、損失及賠償。
  12. 個人需要的醫療服務費用及有關的其他支出。

G) 取消及退款辦法

  1. 「本公司」可根據香港旅遊業議會關於「會員因迫不得已理由而取消旅行團」的第223號指引,於處理團員退款時可以收取退票費(如有),以及「本公司」訂列收取之手續費如下。有關香港旅遊業議會的第223號指引,請瀏覽香港旅遊業議會網站 http://www.tichk.org/

團員繳付退票費後(如適用):

  • 可保留團費半年; 或
  • 如選擇轉團,團費差額則可保留半年; 或
  • 可繳付「因迫不得已理由」之手續費後,取回已付餘款。
  1. 根據第177號指引,「迫不得已理由」指戰爭、政治動盪、恐怖襲擊、天災、疫症、惡劣天氣、交通工具發生技術問題、載運機構臨時更改班次 / 時間表、罷工、工業行動、旅遊目的地政府 / 世界衛生組織發出旅遊警告、香港特區政府發出紅色 /黑色外遊警示,以及其他業界不能控制的不利旅客外遊的情況。
  2. 若參加人數不足,或已知或受到不可抗力事件的威脅,「本公司」有權提前取消旅行團,並按香港旅遊業議會相關指引作出安排,「本公司」毋需負責取消旅行團的責任或支付額外補償。
  3. 除經「本公司」之特別同意及安排,「本公司」或其委託機構均不接納顧客在出發前,出發日或旅途中自行更改由其他人士代為參團,已報名的顧客將被當作自動放棄論,「本公司」亦有權取消其隨團資格而毋須發還任何團費。該顧客需自行承擔所有行為後果。
  4. 顧客可於報名時要求自行出發或中途參團,惟因任何延誤以致未能隨上原團安排之行程,所繳團費概不發還,而其個人之一切住宿膳食以及其他直接或間接的費用或損失,一切由顧客承擔。
  5. 顧客如在旅途中突然退出或不參予任何團體活動如膳食、觀光或住宿),均當作自動放棄論,所繳費用概不退還,亦不會安排其他替代活動。
  6. 如顧客遇上突發情況或因任何理由而未能跟隨團隊的行程,「本公司」須考慮當時環境及情況,並顧及其他團員的安全與利益等因素下,方決定是否安排當地代表陪同該顧客逗留當地並予以協助,顧客不得異議及藉此要求賠償。另外,如顧客需要當地獨立旅遊代理人及服務機構單位代表於途中或完團後提供額外協助,當中衍生之額外開支,一切由顧客承擔。
  7. 訂單確認後,顧客因任何情況下提出要求取消或更改參加者,出發日期及旅行團等,應盡快及於出發日前事先提出(不包括出發日及通知日)。申請一經被接納,款項將按照行程單張上所列條款扣除費用(不包括出發日及通知日)。日後若「本公司」因任何原因而取消旅行團,所扣除的費用概不發還。
  8. 部份旅行團於訂單確認後取消,所有費用將被扣除。詳情請參閱有關行程單張上所列條款細則。

H)額外注意事項

  1. 當顧客提出的要求超出訂單內容的合理範圍時, 「本公司」保留拒絕顧客預訂的權利。
  2. 如果「本公司」合理地認為顧客可能給其他參加者或他人帶來不安、不便或阻礙行程順利進行,或者妨礙業務運作,「本公司」保留拒絕顧客預訂的權利。
  3. 顧客需時刻謹慎照顧隨行之小孩,長者及有需要人士。
  4. 郵輪公司,部分提供特定服務和/或活動的服務供應商可能會要求顧客在參與服務和/或活動前簽署相關的免責協定。若顧客未能符合或違反此類供應商的規定和限制,將可能導致預訂被撤銷、無法享受適用的旅行產品或服務,預訂費用損失和/或「本公司」追討因此類違約而產生的費用。
  5. 行程中眾多旅遊項目需要顧客具備基本的健康條件。如果顧客患有慢性疾病、正在懷孕、患有殘疾或有特殊需要,要密切注意自己的身體狀況,並考慮是否適宜參加旅行。請在申請旅行時告知「本公司」,切不可隱瞞或盲目前往。在某些情況下,「本公司」可能會要求顧客提交醫生簽署的醫療證明適合參與行程及要求有醫護人員或照顧者全程陪伴。同時,「本公司」保留拒絕顧客預訂或隨團出發的權利。
  6. 「本公司」、當地獨立旅遊代理人及服務機構單位工作人員不具有個人護理等相關專業知識。如顧客需要此類協助,「本公司」建議顧客與專業人士同行或另作適當安排。
  7. 如顧客於出發前感到身體不適,應即向尋求醫生或專業人士尋求適合旅遊的專業意見。而顧客因身體抱恙導或體溫超過37度(攝氏),「本公司」保留拒絕顧客預訂或隨團出發的權利而不退回任何款項。提早離團所產生之各項費用需由顧客自理。
  8. 如有特殊需要,顧客理應承擔「本公司」根據顧客要求採取的特殊措施的費用。
  9. 入住的酒店「本公司」將根據房態或實際情況安排,恕不接受指定住宿。入住房型按行程表上所列,「本公司」不保障具體房間設施,所處位置及顧客特殊要求(包括但不限房間升級,床型,吸煙房等)。住宿房間如有衛生安全問題或設施嚴重不完善,請立即與導遊和住宿供應商聯繫,當場解決。
  10. 如顧客有特殊需求,請於確認訂單前向「本公司」諮詢。申請一經被接納,一概不能取消或更改,顧客理應承擔「本公司」根據顧客要求採取的特殊需求的費用(如有)。日後若「本公司」因任何原因而取消旅行團,相關費用概不發還。
  11. 如顧客需要加床安排,請在預訂時備註,後續是否可以安排及相關費用以「本公司」回覆為準。部份酒店房間面積較小,加床可能會引起顧客的不便,顧客應先評估情況,再決定應否確認安排。加床安排一經被接納,一概不能取消或更改。
  12. 「本公司」按承諾標準確保餐飲衛生及餐食數量,但不同地區膳食口味有差異,不一定滿足顧客的口味或需求,敬請諒解。
  13. 行程中所用車輛皆為專車。車型視出行人數而定,「本公司」會根據人數安排合適的用車,顧客不得異議。
  14. 行程中郵輪公司或當地服務機構單位或會提供無線上網服務。實際上網穩定性及速度或會受到不同產品型號,顧客身處位置,實際使用人數,信號覆蓋範圍及信號接收強弱等因素影響,需視乎當地安排為準。顧客不可藉故退團。同時使用該服務人士均受相關之條款及細則規限。顧客應先評估情況,再決定應否接受。
  15. 部份旅行團因行程內容設有年齡限制,詳情請參閱有關行程單張上所列條款細則。例如:
    • 出於安全考慮,21歲以下未成年人需要至少一名成年旅客陪同參加。
    • 部分旅行團因服務能力有限,不接受70周歲(含)以上客人預訂。
    • 部分旅行團因服務能力有限,無法接待嬰兒(14天-2周歲(含))出行。
    • 出於安全考慮,部分旅行團不接受孕婦或行動不便人士預訂。
  16. 「本公司」未有授權任何人士(包括領隊及導遊)向顧客推銷或介紹自費項目或未經「本公司」認可的活動及貨品。因顧客自願參加此等活動或購買此等貨品而引致的任何不滿、損失或傷亡,旅客應直接向介紹人或服務提供者進行交涉或追討賠償,「本公司」一概不會負責。

I)收集及使用個人資料指引

  1. 「本公司」將按照隱私和 Cookie 聲明中的規定收集及使用個人資料。「本公司」向顧客收集的個人資料,將會以保密方式處理,並只會用作為顧客提供相關旅遊服務時使用。過程中,「本公司」可能需要將顧客資料轉交予相關的旅遊代理人或提供服務機構,以安排及完成有關旅遊服務。除此之外,未經顧客同意,「本公司」將不會向其他機構或人士提供顧客的個人資料(法律要求者除外)。
  2. 顧客可透過登入會員帳戶查閱及更正其個人資料。

J)遵照旅遊業議會指示

  1. 遵照旅遊業議會指示,旅行社可向顧客徵收外遊費之0.15%作為印花成本。持有印花收據的顧客,可獲得「旅遊業賠償基金」(包括「旅行團意外緊急援助基金計劃」)的保障,包括:(一)顧客因旅行社倒閉或挾款潛逃,可從旅遊業賠償基金獲得外遊費九成之特惠賠償;及(二)參加旅行團外遊時因意外導致傷亡之人士,他們及其家屬可得到援助基金提供的經濟援助,金額最高為港幣30萬元。上述賠償基金及援助基金並非取代旅遊保險,顧客應自行購買合適的保險計劃,以求全面保障。
  2. 如想查詢上述賠償基金及援助基金之資料,請致電旅遊業賠償基金管理委員會秘書處電話:+852 3151-7945或到網站:https://www.ticf.org.hk查詢。
  3. 旅客必須取得印花收據,方可獲得『旅遊業賠償基金』保障。
  4. 為確保以上權益,「本公司」建議顧客保留已蓋有旅遊業議會印花之旅行團收據正本,並交予親友妥善保存,以作突發事故之意外或保險索償用途。

K)條款可承諾性

此等預訂條款適用於顧客個人,在未獲得「本公司」書面確認前,顧客不可將預訂條款或權利或義務轉讓予任何第三方。「本公司」基於預訂條款所享有的權利可進行轉讓, 且可將其職責委託予他人。

「本公司」有權酌情根據這些預訂條款放棄任何權利。「本公司」也可以根據香港有關機構不時發布的規則和規例的要求放棄其在這些預訂條款下的權利。「本公司」對此預訂條款中任何條款或條件之放棄主張,不得被視為進一步或持續對此條款或條件、或對任何其他條款或條件的放棄主張,任何 「本公司」未基於此預訂條款而主張之權益或條款,不應被視為放棄該權益或條款。若本預訂條款中的任何條款, 被法院或其他具合法管轄權的法庭基於任何理由認定為無效、違法或無法強制執行,此條款應被刪除,或在不影響使用條款中其他條款 完整效用的情況下,將其縮限至最小範圍。

顧客保證顧客擁有所有法律授權,並依據預訂條款以及網站使用條款和隱私政策之規範使用本網站。本網站適用的該預訂條款,以及隱私政策和使用條款,共同構成顧客和「本公司」之間對於網站就旅行預訂的任何使用方式問題的完整理解和協議, 且其效力優於同期的所有該網站旅行預訂的書面和口頭理解、協議、擔保和保證。「本公司」保留任何上述內容未明示之權利。

TERMS AND CONDITIONS (CRUISE PACKAGE)

Please take the time to read and understand this Terms and Conditions set out below prior to booking a trip with us. We strongly recommend that customers carefully read all information relating to your trip on our website and APPs. Customers will be deemed to have accepted this Terms and Conditions after making payment.

TOURTOLOVE Limited reserves the right to change, delete or add new terms. It is customer’s responsibility to read and accept these Terms each time he/ she makes a travel reservation. Customer’s continued use of TOURTOLOVE Limited services after changes, deletions, or additions have been made to these Terms shall constitute customer’s acceptance thereof. In case of any disputes, the TOURTOLOVE Limited reserves the right to make final decision.

A)Responsibility

  1. The transportation (such as cruises, ships, trains or buses, etc.), accommodation, meals, sightseeing or entertainment arranged by TOURTOLOVE Limited (the “Company") are not owned, controlled or managed by the “Company”, but is issued and arranged in accordance with the rules and terms set by local independent travel agents and service agencies. Customer understands that all bookings are subject to these Terms and any other service provider specific terms or conditions, including policies, (“service provider terms”) which shall be made available to customer before completing booking. In the event of conflict between these Terms and service provider terms, the relevant provisions of the service provider terms will prevail. In the event of an unexpected or unforeseen situation, the customer agrees and accepts the final arrangement of the local travel agent and service provider, and agrees that these arrangements do not constitute a violation of the trade descriptions of the tour. In case of traffic delays, baggage loss, accidental casualties and property losses, etc., customer agrees and accepts that he/ she will recover the amount of the loss or damage by negotiate, claim, action against and only the suppliers and organizations that own, manage or control the transportation, hotels, restaurants, tourist spots or entertainment. Regardless of the outcome of the negotiation, claim or action, the customer should not make claim against the “Company” for any recovery.
  2. The services of cruise companies, hotels and other travel companies are not owned, managed or controlled by the “Company". In the event that the customer participating in tour of the “Company" suffer from property damage, accidental casualties, natural disasters and human failure, machine failures, traffic delays, fires, strikes, wars, political unrest, or changes in government regulations, etc., which incur losses or additional expenses, the customer agrees and accepts that he/ she should not make claim against the “Company” for any recovery. Meanwhile, customer should arrange and ensure the insurance coverage is sufficient and appropriate for such.
  3. Except for the personal injury or death of the customer caused by the negligence of the “Company” or its employees, the “Company” shall not be responsible for the personal injury, financial, entertainment or mental loss of the customer in any accident.
  4. The services directly provided by the “Company” (excluding the entrusted cooperative institutions) are interpreted in accordance with Hong Kong law and ordinance. All claims against the “Company” must be handled in Hong Kong, and to the fullest extent permissible by the applicable law, the liability of the “Company” is limited to the total amount of fees paid by customer.
  5. The “Company” have no special knowledge regarding travel regulations, unsafe conditions, health risks, climate hazards, supplier bankruptcies, or suitability for a disabled person of any type of travel. The relevant information provided by the “Company” is for reference only. Customers should research for the latest information released by the official authorities of the destination and comply with relevant regulations to ensure that they meet the travel qualifications. Customer hereby release the “Company” from any claims resulting in whole or in part from the situation mentioned in this paragraph and any other causes not within its control, and agree to submit all other claims against the “Company” within 30 days after the return of trip. All claims must be submitted in writing with precise evidence or supporting documents.
  6. Customers should refer to the relevant travel warnings (if any) before participating in the tours. Whether a customer participates in a tour or not is purely a personal decision. If a customer decides not to participate in a tour due to a local travel warning, it will be deemed to have waived his/ her right, and no refund will be granted. The “Company” will not arrange other alternative tours or services.
  7. For customer who has own air tickets for group travel, he/ she should possess valid travel documents, entry visa, international air tickets, all domestic air tickets, travel insurance and transportation arrangements. Customer must gather at the designated place and time. If the customer has to re-arrange the itinerary, accommodation, flight and cruise as the promoted or suggested package tour did not confirm, all the losses incurred should be responsible by the customers.
  8. In the event of uncontrollable or unexpected, the “Company”, other agents and local service agencies have the right to cancel or replace items in the itinerary before or during the journey, and to shorten or extend the trip. Customers shall raise no objection. Customer participating in the package tour agrees and accepts that the adjusted itinerary is the final arrangement, and this final arrangement do not constitute a violation of the trade descriptions of the tour. Itinerary arrival and departure times are always subject to change without notice. The “Company” reserves the right to cancel, alter, advance, postpone or substitute any scheduled itinerary which, in its sole judgment and discretion, is justified for any reason, and to do so without liability for any loss whatsoever to customers as a result of said change(s).
  9. The “Company” package tour must depart and return at the specified date. If the customer requests to arrive early or extend the stay, the “Company” shall do its best to reserve the corresponding accommodation and other listed items for the customer (if any). Regardless of whether the accommodation for early arrival or extension of stay is confirmed or not, customers are not allowed to withdraw from the tour, request to change the trip date or make any claims for such. Once the request for early arrival or extension of stay is confirmed, it cannot be cancelled or changed, and the package tour booking conditions applied. The customer agrees and accepts that when the package tour has not commenced or the extended stay has begun, the itinerary arranged by the “Company” does not take effect or ends immediately, and the cost, liability, luggage loss, accidental injury and property damage during the stay are at customer’s own risk and liability. The “Company”, its agencies and local service organizations will not be liable for any consequence.
  10. If the customer leaves the group or abandons the itinerary during the trip, the itinerary arranged by the “Company” will be completed and ended right after his/ her departure. After leaving the group, customer is full accountable for their action and hold the “Company”, other agents, local service agencies and its entrusted cooperative institutions harmless against all and any claims.
  11. The ferry tickets/ accommodation/ sightseeing activities and other items included in the itinerary are all group reservations. Once confirmed and ordered, no refund will be arranged to customer who did not avail or drop out from the journey in any circumstances. Alternative itineraries will not be arranged.
  12. Customers must abide by the laws and regulations of various countries, including but not limited to customs, entry or transportation regulations, prohibiting the carrying of restricted articles, prohibiting the use of drone, prohibiting smoking in hotel rooms and accommodation, and other local regulations, etc. Offenders are solely responsible, and the “Company” reserves the right to make claim against the offenders.
  13. Customer must conduct oneself in an orderly and acceptable manner and must not insult, harass, threaten, attack or intimidate other customers, staff and other persons. Customers must follow the reasonable guidelines of safety and schedule announced by the tour guide or other authorized person, in accordance with the overall interests of the group. If, in the “Company” and local service agency’s reasonable opinion, customer fails to comply with the code of conduct, or fails to follow the safety regulations, or fails to follow the guidelines or arrangement of staff, or causes annoyance to others or disrupts to tour operations and safety, it will be regarded as breach of contract. Customer agrees and accepts the “Company” and authorized person reserve the right to take such measures as deem reasonably necessary to prevent continuation of such conduct, including terminate the booking immediately without further liability. The itinerary arranged by the “Company” will be completed and ended immediately for the concerned customer. Minors in the same travel party, aged 18 or below, has to leave the group. In such cases, customer shall not be entitled to any refund or compensation of any kind. Under no circumstances shall the “Company” be liable for any liability, action and cost whatsoever incurred by the customer as a result of such termination of booking.
  14. For all changes of booking, cancellation procedures and reservation requirements, customers must contact and arrange with the “Company” directly. If the customer makes any private deals with the accommodation or local service providers, it will be deemed invalid. The “Company” will not acknowledge any private deals, and has the right to terminate the customer's participation in the package with no refund.
  15. If the “Company” suffers damage or loss due to customer intentions or negligence, acts that violate laws, public order and morals, or the customer fails to comply with the provisions of the “Company” travel agreement, the “Company” may make claims of recovery from the customer.
  16. Customers should keep copies of their travel documents, travel receipts, travel visas and travel insurance policies and all important documents with relevant persons who are easily accessible in case they are lost or damaged during the journey. At the same time, customers should ensure that a copy of the contact information of family members or friends is provided to the tour guide and the “Company” so that the “Company” and authorized person can provide assistance in case of emergency.
  17. If the customer has any allergies (food such as nuts, peanuts, etc.; pollen), he/ she must take appropriate precautions. If the customer suffers from severe allergies, he/ she should consult a doctor for advice on whether it is suitable to participate in the trip or activity under specific circumstances. For any special request, customer must contact the “Company” before the registration deadline. The “Company” shall assist the customer to request arrangements from the local independent travel agents and service agencies, however, the final arrangement by the agent and service agencies shall prevail.
  18. According to the Personal Data (Privacy) Ordinance of the Hong Kong SAR, all customer information will never be provided to third parties, except for the purpose of arranging tours or sightseeing itineraries.
  19. The registration and the terms and conditions are based on the laws of the Hong Kong SAR, and all claims against the “Company” must be initiated in Hong Kong SAR.

BCruise Terms and Conditions

  1. Customer agrees and accepts that all cruise products are subject to the terms and conditions of the cruise company.
  2. Customers must abide by the terms and conditions of cruise company, the definitions of individual sailing routes, infants, children, pregnant women, and adults. For details, please refer to the instructions listed on the relevant itinerary leaflet.
  3. Customers must abide by the rules and regulations of various countries and cruise companies, including but not limited to prohibiting the carrying of restricted articles for immigration and boarding. Offenders are solely responsible.
  4. Please refer to the terms and conditions of the cruise company (English Version) before registration. For details, please check with the concerned cruise company.
  5. Customer agrees and accepts that the cruise company has sole discretion on the stateroom assignment, itinerary, arrival and departure time at port.
  6. Cruise company reserves the right to change itinerary, timing of all embarkations/disembarkations, and port(s) call cancellation due to weather conditions of specific reasons. All of the changes will not be considered as against “The Trade Descriptions Ordinance, Chapter 362, Laws of Hong Kong”. Customers shall not make claims against cruise line or/and the “Company” for any compensation.
  7. If the ship is unable to dock or has to change itinerary due to bad weather, sea situation or any unpredictable or reasons beyond control, customer agrees and accepts cruise company and the “Company” will not be liable for any consequences.

C)Special Circumstances

  1. All travel documents are the customer’s responsibility. Customer should ensure the required document, including visas and public health documents, are prepared and to comply with customs requirements of the destination, including countries that may just be transiting through. If the customer is denied or delayed entry for any reason, customer should assume full and complete responsibility and the loss incurred to other customers in same group due to the issue raised. The “Company” does not accept any responsibility. Customer needs to arrange additional accommodation, transportation and other related expenses on his/ her own. Unaccomplished group itinerary will not be compensated.
  2. Customer is fully responsible if he/ she is unable to travel due to visa issues (including but not limited to failure to apply for a visa or visa refusal). The “Company” reserves the right to deduct the expenses incurred (including but not limited to the expenses of accommodation, meals, tours) from the tour fares and the administrative fees.
  3. Customer agrees and accepts that the “Company” will not be liable if the customer is denied to entry/ exit the country by local government or airlines, whether it is caused by the issue of customer’s background or any other reasons (whether it is a known or unknow reason), even the customer holds valid travel and visa. The tour fares cannot be refunded or transferred to others or tours. Customer bears the additional cost during the period.
  4. The local service provider will make final decision for the change of the sequence of the itinerary, accommodation, tours and meals due to the special situation and force majeure such as act of God, weather, traffic, flights, trains and ships. Customer shall raise no objection.
  5. The “Company” arranges the accommodation with reference to the itinerary, but reserves the right to make changes depending on the situation. In the event of full house, major event, skiing period and other special circumstances, the accommodation will be replaced with hotels of similar standard in neighbourhood city.
  6. he “Company” and service provider have sole discretion regarding itinerary changes in the event of closure of the attractions and restaurants during festival, holiday or special circumstances.
  7. The itineraries are comprehensive and planned based on the overall group needs. During the journey, customer shall comply with guidelines, recommendations or directions given by the person from service provider and cruise company. The customer shall conduct a risk tolerance self-assessment about their age, health conditions, weather and nature of the activity before participation of any activities and be fully accountable for all consequence. Doctor or medical professional should be consulted when necessary.
  8. The “Company”, cruise company or local service agency reserve the right to terminate the participation of any customer who, in the “Company” or local service agency’s reasonable opinion, cannot participation or does not fulfil the requirement to participate in the activity. Customers who have been terminated from the event will not be arranged for any refund or activity replacement.
  9. Customer shall contact the insurance company and submit the claim by their own in the event of any special circumstances which beyond the “Company” control such as flight delay.
  10. Governments and travel organizations may provide the advice for prevention and security of diverse disease and vaccination (e.g. yellow fever). Customer who travels to areas at risk of infection shall pay attention to the relevant information and conduct a risk assessment. Before confirming a trip, customer shall seek advice from doctors or professionals regarding whether the customer’s physical condition is suitable for taking preventive drugs or vaccination, and whether tolerate the side effects that may be caused by vaccination.

DBooking Terms

  1. Travel requirements are different in every country. It is recommended that customer should have a passport which is valid for at least 6 months beyond the end of the trip. Passport should have sufficient blank pages for stamps and visa. Customer who joins a tour in China must allow the “Company” to take and retain copies of the passport or equivalent travel document (such as PRC Resident Identity Card and Mainland Travel Permit for Hong Kong and Macau Residents). Security measures imposed by governments may change from time to time and each customer will be required to comply with them. Please check with the appropriate consulate for specific requirements.
  2. Due to the current travel restrictions in China, most regional authorities in China require all travelers to provide and present valid identification documents (children should bring the original household registration certificate, and those who have not applied for a Resident ID card should bring the original photo household registration certificate) for real-name registration. During the journey, customer should bring along valid documents at all time. Before travel, customers must check the validity of the certificate to ensure it will not affect hotel stays or admission to attractions.
  3. Customers agrees and confirms all traveler details on the booking are full and accurate (as stated in the travel documents), and review the confirmation letter in detail. The “Company” reserves the trip items according to the information provided. Any discrepancies must be brought to the “Company” attention immediately. Amendment will likely result in price differences, loss of reservations and / or incurring amendment or rebooking fee.
  4. The “Company” reserves the right to cancel any request or reservation with false or duplicate names.
  5. Customer should provide accurate and valid contact information (such as mobile phone number and email address) so that the “Company” can contact customer efficiently.
  6. When receiving the confirmation, customer should check it thoroughly to make sure it is correct as to the dates, locations, fares, and package inclusion. The “Company” accepts no responsibility for losses and inconvenience arising from customer’s failure to check the confirmation.
  7. Once the reservation has been confirmed and ordered by the “Company”, the reservation cannot be transferred to other people, travel date or package tour, without the consent and arrangement of the “Company”.
  8. The “Company” recommends that the customer to take out travel insurance, to protect against loss or damage to baggage and personal effects, trip cancellation and emergency evacuations, accidental death or injury, illness and medical expenses sustained or incurred in connection with the trip. It is customer’s responsibility to arrange suitable insurance cover for the activities and event in the holiday.
  9. Please keep the original receipt for refund purpose in special case.
  10. In a package tour, each customer can reserve maximum 3 rooms. If, in the reasonable opinion of the “Company”, the customer reserves more than 3 rooms in total, the “Company” reserves the right to cancel the reservation and charge related fees (if applicable) in accordance with the terms and conditions.
  11. The order must be paid in full in the form of electronic wallet or credit card, and confirmed and posted by the bank before it can be confirmed. All payments are settled in, HK dollar, US dollar or South Korean Won. If the customer pays with currency other than HK dollar, US dollar or South Korean Won, he/ she will be responsible for the difference in exchange rates and handling fees of the bank. For details, please check with the concerned financial institute.
  12. Discounts, exemptions and other promotional offers must be provided and registered at the time of booking.
  13. The tour fares and age definition vary. For details, please refer to the terms and conditions on the respective itinerary leaflet.
  14. Based on the start date of the itinerary, customers under the age of 21 must meet the following registration requirements:
    • Below 21 years old: Must travel with parent or a guardian.
    • 15 years old and above but not yet twenty-one: If customer is not traveling with parent or a guardian, he/ she must obtain the consent of the parent or guardian and sign the confirmation letter. Some countries may require travel package insurance for the children or teenagers and a consent form recognized by the country of entry.
  15. The “Company” will not provide additional meals, hotel beds and any seat-occupied transportation arrangements (including but not limited to coach seats) for infants. If the customer requests a baby cot, the “Company” will assist the customer to request arrangements for the accommodation, but the accommodation reserves the right to make the final decision.
  16. The “Company” may cancel the booking of any customer who is or becomes ineligible to travel for any reason, or who is travelling without proper documentation. In case of disputes, the “Company” reserves the right to make the final decision.
  17. Whether the package tour will confirm or not is affected by different factors, and the “Company” reserves the right to make the final decision. If the package tour cannot depart as scheduled as decided, the “Company” will refund the tour fares according to the guidelines of the Travel Industry Council of Hong Kong

E ) Inclusion

  1. Hotel and cruise accommodation: as specified in the itinerary or same standard hotel, accommodation is based on twin-share bedroom. Fare for a room with single occupancy (or surcharge) is based on one person occupies one room.
  2. Transportation (if any): The various of transportation listed in the itinerary, but in the event of unexpected or uncontrollable incidents, the “Company” and the local independent travel agent have the right to replace the transportation in the itinerary.
  3. Meals: meals listed in the itinerary, but in the event of unexpected or uncontrollable incidents, the “Company” and the local independent travel agent have the right to replace the meals in the itinerary.
  4. Tour program (if any): tour program listed in the itinerary, but in the event of unexpected or uncontrollable incidents, the “Company” and the local independent travel agent have the right to replace the program in the itinerary.
  5. Tour host service (if any): tour escort in the destination. The number of participants for each group should not be less than 15 people. Tour host service will not be provided by the “Company” for trip less than 15 people, a local tour guide will be arranged instead. Tour host service provided by individual attractions or countries speaks in English or Chinese. Customer shall raise no objection or requests to withdraw from trip for such.
  6. Levy cost of Travel Industry Council of Hong Kong.

F)Exclusions

  1. Travel documents, Visa fees.
  2. Any gratuities to tour host or tour guide or driver. (Unless specified)
    • Service includes: Liaise with local travel agents and service providers to make arrangements for the package including meals, accommodation, transportation and activities. Hotel check-in and check-out procedures, hotel room allocation. Introduce local customs, etc
  3. Airport tax, port tax, fuel surcharges, flight insurance tax of various countries. (Unless specified)
  4. Port fee and tax, gratuities, (Unless specified)
  5. All personal expenses.
  6. All sightseeing programs not included in itinerary (including shore excursion).
  7. Personal consumption when dining at a local restaurant during the trip.
  8. Accommodation or airport pick-up and drop-off fees for those who arrive early or extend their stay, single room surcharges, room upgrades, or other related fees.
  9. Additional expenses incurred due to personal matters, traffic delays, strikes, typhoons or other circumstances beyond the control of the “Company”
  10. Travel insurance, medicine, baggage insurance, etc.
  11. Liability, delay, loss and compensation caused by personal problems or personal disputes.
  12. Personal medical service expenses and other related expenses.

G) Cancellation and Refund

1. According to Directive No. 223 issued by the Travel Industry Council of Hong Kong and concerning cancellation of package tours by travel agents for reasons beyond control, if a travel agent cancels a package tour because of ‘reasons beyond control’, it is allowed to collect cancellation charges (if any) and a handling fee clearly stated on the package tour when making refunds to the tour participants. According to Directive No. 177, “reasons beyond control” mean hostilities, political unrest, terror attacks, natural disasters, pestilences, bad weather, technical problems to transport,  changes  to  the  frequency/timetable  of  any  means  of  conveyance  by  its operator without advance notice, strikes, industrial action, travel advisories (warnings) issued  by  governments of the destinations/ the World Health Organization, red/ black outbound  travel  alerts  issued  by  the  Hong  Kong  SAR Government,  and  any  other situations of which the industry has no control and which are unfavorable to outbound trips of travelers.

3. If the minimum passenger requirement of the tour does not meet or known or affected by the reasons beyond control, the “Company” has the right to cancel the tour, and make further arrangement based on relevant guideline of Travel Industry Council of Hong Kong. It need not make any extra compensation.

4. Unless agreed and arranged by the “Company”, the “Company” or its entrusted cooperative institutions will not accept any name change after booking confirmed. Unauthorized traveler change at any time, including before departure, on departure day and during trip, is not allowed. Customers who have signed up will be treated as a waiver, the “Company” also has the right to disqualify the customer with no refund. Customer is fully liable for any consequences.

5. Customer can request to join the tour in any one of the trip days. However, if customer fails to join back the original tour owning to delay of any reason, the tour fares will not be refunded. Customer is responsible for the direct or indirect personal expenses on accommodation, meals and other losses.

6. If the customer withdraws or does not participate in any group activities unexpectedly (such as meals, sightseeing or accommodation) during the trip, it will be deemed to have waived automatically. The fee paid will not be refunded, and no substitution will be arranged.

7. If the customer encounters an emergency or fails to follow the tour itinerary for any reason, the “Company” will assess the situation, and take into account the safety and interests of other group members before deciding whether to arrange a local representative as accompany in destination and provide assistance. Customer shall raise no objection or request compensation by this. In addition, if customer requests further assistance from agents or local service agencies during or after the tour, the additional costs incurred will be borne by the customer.

8. Once booking confirmed, the customer should submit the request for cancellation, name change, date change or tour change as soon as possible, regardless of the reason. Documentary evidence may be required in support of the request. Once accepted, fee will be deducted according to the terms and conditions of the package (excluding the departure date and notification date). If later, the “Company” cancels the package tour for any reason, this fee will not be refunded.

9. Cancellation with refund is not allowed for certain tours. For details, please refer to the terms and conditions listed on the relevant itinerary leaflet.

HAdditional Information

  1. the “Company” reserves the right to reject his/ her reservation.
  2. in the “Company” reasonable opinion that the customer may cause discomfort, inconvenience to other participants and individuals, obstruct the tour operations, obstruct the business operation. etc., the “Company” reserves the right to reject his/ her reservation.
  3. Customers should always take care of the accompanying children, the elderly and anyone in need of priority.
  4. Some third-party service providers offering certain services and/or activities may require customer to sign their liability waiver prior to participating in the service and/or activity they offer. If customer is unable to fulfil or violate any such supplier's rules and restrictions, it may result in cancellation of reservation(s), being denied access to the applicable travel product or services, forfeiting any monies paid for such reservation(s), and/or the “Company” may make claim for any costs it incurs as a result of such violation.
  5. Customers warrants that he/ she and any person in his/ her care and responsibly shall be physically fit to take the trip. People has chronic disease, is pregnant, has disability or special needed should pay close attention to the health condition and consider if suitable to participate in the trip. The “Company” reserves the right to ask for medical evidence of fitness to travel. Customers must be self-sufficient and/or should travel with a companion to provide any assistance needed during the trip. The “Company” reserves the right to require that customers who is not or deemed not self-sufficient to travel with a companion who shall take responsibility for any assistance needed during the trip and in case of emergency. Customers with any physical or mental disability, mobility problem, other medical condition or handicap which may require special care, treatment or assistance of any kind during the trip (including persons confined to wheelchairs) must report to the “Company” in writing when a reservation is made. If any such disability, mobility problem or condition arises after the reservation has been made then notice must be given to the “Company” as soon as possible. The “Company” may require a medical certificate or other documentation, information or waiver relating to such disability, mobility problem condition as it considers necessary. Moreover, the “Company” reserves the right to reject his/ her reservation or terminate the customer's participation.
  6. The “Company”, local independent travel agents and service agencies staff has no special knowledge of personal care and other related expertise. If the customer needs such assistance, it is recommended that the customer travels with a qualified professional or make appropriate arrangements.
  7. If the customer is suffering from a physical condition or body temperature exceeds 37 degrees (Celsius), the “Company” reserves the right to reject his/ her reservation or to travel with the group. No refund will be provided. All expenses incurred by early departure must be borne by the customer.
  8. For any special needs, the customer should bear the cost of the relevant measures taken by the “Company” according to the request.
  9. Accommodation will be arranged according to the room availability or actual situation. No designated accommodation will be accepted. Check-in room types are as listed in the itinerary. The “Company” does not warrant the room facilities, hotel location and special request by customers (including but not limited to room upgrades, bed types, smoking rooms, etc.), customer should contact the tour host and resolve on the spot for any issue about the hotel room.
  10. Customer should raise any special requirement to the “Company” before confirming the order. Once the request is accepted, it cannot be cancelled or changed, and the customer should pay for the cost (if any) of the special needs taken by the “Company” according to the customer's request. If later the “Company” cancels the package tour for any reason, the relevant fee will not be refunded.
  11. Customer should inform extra bed arrangement upon reservation. Confirmation and fee (if any) will be subject to the “Company” written reply. Extra beds may cause inconvenience to customer as some of the hotel rooms may be packed after the extra bed in placed. Customer should evaluate the situation before confirming the arrangement. Once the extra bed arrangement is accepted, it cannot be cancelled or changed.
  12. The “Company” warrant the food hygiene and food quantity in accordance with the promised standards. However, the flavour or taste of meals may not meet the expectation of customer and it is different across the region.
  13. All vehicles used in the itinerary are dedicated to the group. The model used depends on the number of passengers. The “Company” will arrange a suitable vehicle based on the group size. Customer shall raise no objection.
  14. During the tour, cruise company and local service providers may provide wireless internet services. The stability and speed of the network may be affected by different factors such as product models, location, actual number of users, signal coverage, and signal reception strength etc. Customers cannot withdraw from the tour for this. At the same time, users are subject to the relevant terms and conditions of the service provider. Customer should make assessment before accepting the service.
  15. Age restrictions will apply for certain tours. For details, please refer to the terms and conditions listed on the relevant itinerary leaflet. For example:
    • For safety reasons, age below 21 need to be accompanied by at least one adult passenger.
    • Due to limited-service capacity, certain routes may not accept customers who are 70 years old or above.
    • Due to limited-service capacity, certain routes may not accept infants who are 14 days to 2 years old.
    • For safety reasons, certain tours may not accept booking for pregnant woman or guest with mobility challenge.
  16. The “Company” has not authorized any person (including tour host and tour guide) to promote optional tour, or activities and products which are not approved by the “Company”. For any dissatisfaction, loss or casualties caused by customers voluntarily participating in such activities or purchasing such products or service, customer should directly negotiate with the agents or service provider for compensation, and the “Company” will not be liable.

IGuidelines on Collection and Use of Personal Data

1. The “Company” will only collect and use the personal information as set out in our Privacy and Cookie Statement. The personal data collected will be treated in a confidential manner and will only be used to provide relevant travel services to customer. During the process, the “Company” may need to transfer the data to relevant travel agents or service providers to arrange and complete relevant travel services. In addition, without the customer's consent, the “Company” will not provide the data to other organizations or persons (except as required by law).

2. Customers can review and update their personal information by login to their membership account.

JInstructions of the Travel Industry Council of Hong Kong

  1. According to guidelines from the Travel Industry Council of Hong Kong, travel agency may recover the cost of levy payments (0.15% of outbound fare) from customers.  The Travel Industry Compensation Fund (TICF) provides protection to outbound travellers who may claim: (a) An ex gratia payment equivalent to 90% of the loss of outbound fares (commonly arisen from the default of a licensed travel agent); and (b) reimbursement up to HK$300,000 in ex gratia payment, in case of injury or death in an accident during an outbound activity provided or organized by a licensed travel agent.
    Although the TICF has provided customer with certain protection, customer is strongly advised to take out travel insurance which meets personal need for a comprehensive protection.

  3. Travellers must obtain receipts with levy stamps to have protection by the Travel Industry Compensation Fund.
  4. To protect the rights above, it is recommended family members or friends should keep all franked receipts for customer before departure and bring a copy of the receipts during the tour in case of accident or insurance claims.

KAssignability Of Booking Terms

These Booking Terms are personal to individual customer, and customer may not assign these Booking Terms or his/ her rights or obligations there under to a third party without the “Company” prior express written consent. The rights of the “Company” under these Booking Terms may be assigned, and its duties may be delegated.

The “Company” have an absolute discretion to waive any of their rights under these Booking Terms. The “Company” may also waive its rights under these Booking Terms to the extent this is required by the rules and regulations from time to time published by the relevant authorities in Hong Kong. No waiver of by the “Company” of any booking related term or condition set forth in these Booking Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the “Company” to assert a right or provision under these Booking Terms shall not constitute a waiver of such right or provision. If any provision of these Booking Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Booking Terms will continue in full force and effect.

Customer warrants that one possesses all legal authority to use the Website in accordance with these Booking Terms as well as the Website's Terms of Use and Privacy Policy. These Booking Terms, along with the Privacy Policy and Terms of Use applicable to the Website, constitute the entire understanding and agreement between you and the “Company” with respect to all matters relating in any way to the use of the Website for travel bookings and supersede all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to the travel bookings on the Website. Any rights not expressly granted herein are reserved.

The Terms and Conditions has been drafted, and shall be construed, in the Chinese language. Any translation of the Terms and Conditions is solely for reference only. In the event of inconsistency between the Chinese language version and a translated version, the Chinese language version of the Terms and Conditions shall always prevail.

責任及細則 (旅行團)

顧客須於作出任何付款前細讀本“重要責任及細則” 所載的條款及條件,當顧客付款後將視為接受所有條款及條件。

愛旅航有限公司保留變更、刪除或新增條款的權利。每次顧客進行旅行預訂時,都有責任閱讀並接受這些條款。在這些預訂條款經過變更、刪減或新增後,若顧客仍繼續使用愛旅航有限公司的服務即表示顧客認可並接受本條款。如有任何爭議,愛旅航有限公司保留最終決定權。

A)責任問題

  1. 愛旅航有限公司(「本公司」)安排之交通工具(如郵輪、輪船、火車或巴士等)、住宿、膳食、旅遊觀光或娛樂項目,均非由「本公司」擁有,管理或控制,而是按照當地獨立旅遊代理人及服務機構單位所定的規則條款下簽發及安排。顧客了解所有預訂均受這些條款和任何其他服務提供商特定條款或細則,包括政策的約束(「服務供應商條款」),這些條款或細則應在顧客完成預訂之前提供。 如果這些條款與服務供應商條款發生抵觸,以服務供應商條款的相關規定為準。在發生突發或未能預料的情況下,顧客同意及接受當地旅遊代理人及提供服務機構單位最終的安排,並同意此等安排不構成違反旅行團的商品說明。如遇交通延誤、行李損失、意外傷亡及財物損失等,顧客同意及接受僅向擁有、管理或控制有關交通工具、酒店、食肆、旅遊點或娛樂項目之供應商及機構直接交涉及追討或索償,不論交涉、追討或索償結果如何,顧客不會要求「本公司」對此負上任何責任及放棄向「本公司」追討或索償。
  2. 郵輪公司、酒店及其他旅遊機構之服務,均非由「本公司」擁有、管理或控制。凡參加「本公司」旅行團之顧客如遇有財物損失、意外傷亡、天災人禍、機器失靈、交通延誤、失火、罷工、戰爭、政局不安及政府更改條例等而招致損失或引致額外費用時,顧客同意及接受不會要求「本公司」對此負上任何責任及放棄向「本公司」追討或索償。
  3. 除因由「本公司」或其員工之疏忽而引致顧客之個人傷亡外,「本公司」對顧客在任何意外中之個人傷亡、經濟、娛樂或精神損失概不負責。
  4. 「本公司」直接提供之服務(不包括經委託合作機構),均以香港法律來解釋,對「本公司」所有索償必須於香港辦理,而「本公司」對顧客所負之責任,在適用法律許可的最大程度下不會超過顧客所繳交費用之總額。
  5. 「本公司」不具有各地旅遊規例、不安狀態、健康風險、氣候危險、供應商破產、或對於殘疾人士的適合性等相關專業知識。「本公司」提供的相關資訊僅供參考。顧客應自行尋求目的地官方機構所發布的最新資訊並履行有關規定,以確保符合旅遊資格。顧客特此豁免「本公司」,同意不對關於本章節提及的情況中全部或部分內容以及其他任一超出其管控範疇的情形進行申訴,並同意在旅行返程後30天 內提交任何其他關於「本公司」的申訴。所有申訴必須以書面形式提交並附以精準的證據或證明文件。
  6. 顧客參加「本公司」之旅行團前,應參閱相關旅遊警示(如有)。顧客參加旅行團與否,純屬個人決定。如顧客因當地懸掛旅遊警示而自行決定不參加旅行團均當作自動放棄論,所繳費用概不退還,「本公司」不會安排其他替代旅行團或服務。
  7. 自備機票參加旅行團的顧客須先備妥有效旅遊証件、入境簽證、國際機票、所有內陸機票、保險及個別路線之交通安排。顧客必須於指定地點及時間集合。顧客已安排之自定行程及機票如因擬定及/或推介日期沒有出團而需重新編定行程,安排調動更改酒店、郵輪及所引致的損失、額外費用及一切與航空公司安排調動更改機票的事宜,概由顧客自行承擔及處理。
  8. 在發生不能控制或未預料到事件的情況下,「本公司」及其他代理人及當地服務機構單位有權在啟程前或旅途中取消或替換行程內之項目,亦有權縮短或延長旅程,顧客不得異議。各參加旅遊團之顧客同意及接受經調整的行程安排為最終的安排,亦不會把這最終的安排當作違反旅行團的商品說明。
  9. 「本公司」旅行團所採用之團體預訂,必須按列明日期往返,如顧客要求提早到達或延期逗留,「本公司」當盡力為顧客代訂相應的住宿及其他列明之項目(如有)。但不論提早到達或延期逗留之住宿確定與否,顧客不得藉此退團、要求更改出發日期或作出任何索償。提早到達或延期逗留之日期一經確認,一概不能取消或更改,並採用旅行團之預訂條款。顧客同意及接受當旅行團尚未開始或延期逗留開始時,「本公司」安排之行程未有生效或即告結束,逗留期間之費用、責任、行李損失、意外傷亡及財物損失等,均由顧客自負,概與「本公司」及其代理人及當地服務機構單位等無關,亦毋需負上任何法律責任。
  10. 顧客如在旅途中自行離團或放棄行程,離團後「本公司」安排之行程即告完成及結束,離團後須自負責任,一切與「本公司」及其他代理人及當地服務機構單位或其委託機構無關。
  11. 行程中所安排之船票/住宿/觀光等項目,均屬團體訂位,一經「本公司」確認及訂購後,不論任何情況下而未能使用者,概不退回任何款項,不會安排其他替代行程。
  12. 顧客須遵守各國政府之法例,包括但不限於有關風俗、入境或運輸的規定、嚴禁攜帶違禁品、禁止使用航拍機、禁止酒店及住宿房間內吸煙及當地其他違法條例等;違例者須自行負責,「本公司」保留追討因而引致的損失。
  13. 顧客須遵守合理而適當的行為標準,不得侮辱、滋擾、威脅、攻擊或恐嚇其他顧客、工作人員及其他人士。顧客必須依從導遊或其他獲授權者有關安全事宜或依照時間表的合理指引,以旅行團整體利益為依歸。假如「本公司」或當地服務機構單位合理地認為其中任何顧客不遵守行為標準,或不遵守應有謹慎措施及安全規定,或不遵守工作人員指引及安排,或對他人作出滋擾或影響團隊正常活動及安全時,將被視為違約。顧客同意及接受「本公司」或獲授權人士有權採取「本公司」認為合理必要的措施以防止此等行為繼續,包括終止顧客繼續參加旅行團,而「本公司」安排之行程對有關顧客即告完成及結束。而受該顧客監護之18歲以下同行團員亦須一併離團。被終止繼續參加旅行團的顧客,將不獲退款,「本公司」亦不再對其負有責任,亦不會負責承擔被逐離團後的任何行動及費用。
  14. 所有住宿套餐之更改、取消手續及預訂要求,顧客必須直接與「本公司」聯絡及辦理。如顧客自行與住宿或當地服務機構單位作任何私人協議將被視為無效,「本公司」一概不予承認,並有權終止顧客繼續參加套餐不退回任何款項。
  15. 如果「本公司」由於顧客意圖或疏忽、違反法律、公共秩序和道德的行為或顧客未遵守「本公司」的旅行協議的規定而遭受損害,「本公司」將會向顧客索取賠償。
  16. 顧客應將其旅遊証件副本、旅遊收據、旅遊簽證及旅遊保險和所有重要文件副本留於易於聯絡的有關人士,以備在旅程中遺失或損壞文件時用。同時,顧客應確保將家人或朋友的聯絡資料副本,交予導遊及「本公司」,以備在緊急情況下,「本公司」或獲授權人士可以提供協助。
  17. 如顧客表示有敏感情況(食物如堅果,花生等﹔花粉),須自行採取適當的預防措施。如顧客患有嚴重過敏症,請諮詢醫生意見,以了解是否適合在特定情況下參加行程或活動。如有任何特別調節要求,顧客須於報名截止日期前聯絡「本公司」,「本公司」當協助顧客向當地獨立旅遊代理人及服務機構單位要求安排,但以代理人及服務機構單位最後安排為準。
  18. 根據香港特別行政區個人資料(私隱)條例,所有顧客資料除為安排旅行團或觀光行程外,絕對不會提供予第三者。
  19. 報名及責任細則以香港特別行政區法律為依據,所有對「本公司」之索償必須在香港特別行政區辦理。

B)郵輪公司責任問題

  1. 顧客同意及接受所有郵輪假期均受郵輪公司之條款約束及限制。
  2. 報名前請參閱有關郵輪公司之英文版條款及細則。
  3. 顧客同意及接受艙房住宿、航程路線、泊岸及啟航時間,將以郵輪公司最後安排為準。
  4. 郵輪公司或「本公司」有權因應當日郵輪泊岸時間及當地天氣、交通情況而更改岸上觀光行程之項目,顧客同意及接受郵輪公司或「本公司」有最終的決定權,亦不會把更改岸上觀光行程當作違反旅行團的商品說明。顧客亦就此放棄向郵輪公司或「本公司」追討或索償。
  5. 如因天氣惡劣、海面狀況或各種未能預知或迫不得已的情況下而不能泊岸或更改航程,顧客同意及接受郵輪公司或「本公司」不需作出任何補償。

C)特殊情況

  1. 顧客於出發前須自行了解清楚及預先辦妥所須入境文件包括簽證和入境要求,沿途於任何國家,如顧客因任何理由而被拒或延遲入境,顧客必須承擔此責任及須承擔由此問題而引致同團顧客之損失,「本公司」毋須為此負任何責任。顧客所需額外安排之食宿、交通及其他有關之費用全部由該顧客負責,而未能隨團完成之餘下行程將不會獲得任何補償。
  2. 若顧客因簽證問題(包括但不限未辦簽證或簽證被拒)而不能成行,後果均由顧客自負。「本公司」有權就所繳之團費中扣除因此而引致的一切費用(包括但不限於住宿、膳食、旅遊觀光的費用)及「本公司」的行政費用。
  3. 即使顧客持有有效之入境簽證及旅遊證件,如出/入境時遭本地/當地政府機構或航空公司拒絕出/入境,不論是因其本身背景問題或任何其他原因(不論是否知道原因),顧客同意並接受不能要求「本公司」對此負上任何責任。另所繳團費不得退回或轉予他人或轉用於其他旅行團,顧客須自行繳付期間引致之額外費用。
  4. 行程順序若因特殊狀況及其他不可抗拒之現象;如天氣、交通、航班、列車、船舶影響,而有飯店、景點、餐食順序上之調動,以當地接待社安排為準,顧客不得異議。
  5. 「本公司」當盡力根據行程安排所有酒店,但「本公司」有權視乎當時情形作出更改,如遇酒店突告滿房、大型活動、滑雪期間或其他特殊情況,將安排住宿鄰近(城市)之同級酒店代替。
  6. 行程之任何景點和膳食,如遇節日、假期或特殊情況下關閉或休息,「本公司」及其他代理人有權替換行程內之項目。
  7. 行程中各項活動皆按整體需要而設計及安排。顧客參加此等活動時,應遵守服務人員之指引及安排,並必先衡量個人的年齡、體格、健康狀況、當時的天氣環境及活動內容等,以評估自己能承擔風險程度,再決定應否參與,並須獨自承擔由此而引致的一切責任及後果。當顧客認為有需要時,更應自行尋求醫生或專業人士提供之意見。
  8. 如果 「本公司」或當地服務機構單位合理地認為顧客無法参加行程中活動或未能到参與活動的要求,「本公司」或當地服務機構單位將保留自行决定終止顧客加入或繼續参與活動的權利。被終止繼續參加活動的顧客,概不退回任何款項,亦不會獲安排其他替代行程。
  9. 如遇不能控制之特殊情況或航班延誤,導致客人需提出保險索償,顧客需自行與保險公司聯絡。
  10. 政府和旅遊機構或會提供世界各地的疾病預防,安全事項,及防疫注射意見(例如黃熱病)。顧客前往感染風險地區應留意相關資訊和風險評估。有關顧客身體狀況是否適合服用預防藥物或注射疫苗,以及是否能夠服用預防藥物或承受注射疫苗後可能會引起的副作用,請務必於確認訂單前自行尋求醫生或專業人士提供之意見。

D)報名須知

  1. 由於個別國家之出入境條例有別,建議出國顧客之旅遊證件於「旅遊地回程日」起計需有最少6個月有效期。旅遊證件必須有足夠的空白頁數,以蓋上出入境印或入境簽證。參加中國旅行團者必須提供相關旅遊證件副本(如國內居民身份証,回鄉証等)。
  2. 顧客參加中國旅行團,行程期間請隨身攜帶本人的有效旅遊證件原件。國內居民未滿16歲者請攜帶戶口本原件;超過16歲的旅客若沒有辦理身份證,請在戶口所在地開出相關身份證明,以免影響酒店入住或景點入場等安排。出行前顧客請務必檢查證件的有效期。
  3. 「本公司」根據顧客所提供之資料進行預訂手續。顧客必須提供旅遊證件上的完全相符之姓名及資料,並清楚核對收據上參加者的資料。如顧客於報名後更改旅遊證件資料或所提供之資料不符,必須立刻通知「本公司」,因更改資料會導致其預訂須重新辦理,顧客必須繳付由此而產生之額外費用。
  4. 「本公司 」保留取消任何以虛假或重覆名字登記訂單之權利。
  5. 請務必填寫準確有效的聯繫方式(如手提電話號碼及電郵地址),以便「本公司」聯絡顧客。
  6. 當顧客收到確認書時,請仔細核對以確保內容正確無誤,諸如旅行日期、地點、票價和內容。對於因顧客未確認行程而導致的損失和不便,「本公司 」不承擔任何責任。
  7. 預訂一經「本公司」確認及訂購後,除經「本公司」之特別同意及安排,否則不得將預訂轉予他人或轉用於其他出發日期或其他旅行團。
  8. 顧客參加「本公司」之旅行團,必須自行選擇購買適當的旅遊保險;顧客有責任認清承保範圍,必須理解保單內的條款細則,確保所購買的保險能夠覆蓋行程中各項已包及自費活動。
  9. 請保留收據,以作特殊情況下退款之憑據。
  10. 在一個旅行團中,每位顧客可以預訂最多 3 間客房。如果「本公司」認定顧客透過個別預訂的方式總計預訂超過 3 間客房,「本公司」保留取消預訂的權利,並按條款收取相關費用(如適用)。
  11. 訂單需以電子錢包或信用卡形式全數繳付費用,並經過銀行確認過帳,方可作實。所有付款皆以港幣、美金或南韓圜形式結算。若顧客以非港幣、美金或南韓圜結算的貨幣付款,需自行承擔銀行匯率之差異及手續費,詳情請向相關金融機構查詢。
  12. 減免折扣,豁免及其他推廣優惠,必須於報名時申請及提供證明予「本公司」。
  13. 旅行團團費及年齡定義各有不同。詳情請參閱有關行程單張上所列條款細則。
  14. 按行程出發日計算,年齡未滿18歲的顧客須符合下列報名要求:
    • 15歲以下:必須與父或母或監護人同行。
    • 滿15歲而未滿18歲: 如非與父或母或監護人同行,則必須由父或母或監護人同意並於確認書簽署作實,個別國家或有可能要求具備一份合適的旅遊綜合保險及一份入境國家認可的同意書。
  15. 由成人陪同的兒童或嬰兒也需要預約參團,並需付相關參團費用。「本公司」將不會為嬰兒額外提供膳食,酒店床位及任何佔座位之交通安排(包括但不限於旅遊巴士)的座位。如顧客要求提供嬰兒床,「本公司」將協助顧客向住宿供應商面要求安排,但以住宿供應商面保留最終決定權。
  16. 「本公司」保留接受報名與否之最終權利。
  17. 旅行團成行與否受不同因素影響,「本公司」保留最終決定權。若「本公司」最終決定該旅行團不能出發,「本公司」將按旅遊業議會指引退回團費。

E)費用包括

  1. 酒店及郵輪住宿:根據行程表內所列或同級酒店,房間是以兩人共用一雙人房為標準。單人房費(或附加費)則以一人佔一房為標準。
  2. 交通工具:行程表內所列之各式交通工具,惟在發生突發或無法控制事件的情況下,「本公司」及當地獨立旅遊代理人有權替換行程內之交通工具。
  3. 膳食:行程表內所列之膳食,惟在發生突發或無法控制事件的情況下,「本公司」及當地獨立旅遊代理人有權替換行程內之膳食。
  4. 遊覽節目:行程表內所列之遊覽活動,惟在發生突發或無法控制事件的情況下,「本公司」及當地獨立旅遊代理人有權替換行程內之項目。
  5. 領隊之服務:當地領隊接待。每團之出發人數以不少於15人為原則,若個別旅行團人數不足15人,「本公司」將不派當地領隊接待,改由當地導遊接待。個別景點或國家提供之領隊,導遊為英語或華語。顧客不得藉詞反對或退出。
  6. 香港旅遊業議會印花成本。

F)費用不包括

  1. 旅遊證件、各國之入境簽證費。
  2. 給予領隊或導遊或司機之服務費。(除特別註明除外)
    • 服務內容: 與當地旅遊代理人及提供服務機構單位接洽,落實旅行團之包含膳食、住宿、交通及活動安排。辦理酒店入住及退房手續、分配酒店房間。介紹當地風土人情等。
  3. 各國之機場稅、港口稅、燃油附加費、航空保險稅。(除特別註明除外)
  4. 一切私人性質之費用。
  5. 所有行程表以外之觀光節目。
  6. 行程內於當地餐廳用膳期間的私人消費。
  7. 提早到達或延期逗留者住宿或機場之接送費用、單人房附加費、升級房間等級或其他相關之費用。
  8. 因私人、交通延阻、罷工、颱風或其他「本公司」不能控制的情況而引致之額外費用。
  9. 旅行平安、醫藥、行李等保險。
  10. 因個人問題或個人糾紛所引致之責任、延誤、損失及賠償。
  11. 個人需要的醫療服務費用及有關的其他支出。

G) 取消及退款辦法

  1. 「本公司」可根據香港旅遊業議會關於「會員因迫不得已理由而取消旅行團」的第223號指引,於處理團員退款時可以收取退票費(如有),以及「本公司」訂列收取之手續費如下。有關香港旅遊業議會的第223號指引,請瀏覽香港旅遊業議會網站 http://www.tichk.org/

團員繳付退票費後(如適用):

  • 可保留團費半年; 或
    • 如選擇轉團,團費差額則可保留半年; 或
    • 可繳付「因迫不得已理由」之手續費後,取回已付餘款。
  1. 根據第177號指引,「迫不得已理由」指戰爭、政治動盪、恐怖襲擊、天災、疫症、惡劣天氣、交通工具發生技術問題、載運機構臨時更改班次 / 時間表、罷工、工業行動、旅遊目的地政府 / 世界衛生組織發出旅遊警告、香港特區政府發出紅色 /黑色外遊警示,以及其他業界不能控制的不利旅客外遊的情況。
  2. 若參加人數不足,或已知或受到不可抗力事件的威脅,「本公司」有權提前取消旅行團,並按香港旅遊業議會相關指引作出安排,「本公司」毋需負責取消旅行團的責任或支付額外補償。
  3. 除經「本公司」之特別同意及安排,「本公司」或其委託機構均不接納顧客在出發前,出發日或旅途中自行更改由其他人士代為參團,已報名的顧客將被當作自動放棄論,「本公司」亦有權取消其隨團資格而毋須發還任何團費。該顧客需自行承擔所有行為後果。
  4. 顧客可於報名時要求自行出發或中途參團,惟因任何延誤以致未能隨上原團安排之行程,所繳團費概不發還,而其個人之一切住宿膳食以及其他直接或間接的費用或損失,一切由顧客承擔。
  5. 顧客如在旅途中突然退出或不參予任何團體活動如膳食、觀光或住宿),均當作自動放棄論,所繳費用概不退還,亦不會安排其他替代活動。
  6. 如顧客遇上突發情況或因任何理由而未能跟隨團隊的行程,「本公司」須考慮當時環境及情況,並顧及其他團員的安全與利益等因素下,方決定是否安排當地代表陪同該顧客逗留當地並予以協助,顧客不得異議及藉此要求賠償。另外,如顧客需要當地獨立旅遊代理人及服務機構單位代表於途中或完團後提供額外協助,當中衍生之額外開支,一切由顧客承擔。
  7. 訂單確認後,顧客因任何情況下提出要求取消或更改參加者,出發日期及旅行團等,應盡快及於出發日前事先提出(不包括出發日及通知日)。申請一經被接納,款項將按照行程單張上所列條款扣除費用(不包括出發日及通知日)。日後若「本公司」因任何原因而取消旅行團,所扣除的費用概不發還。
  8. 部份旅行團於訂單確認後取消,所有費用將被扣除。詳情請參閱有關行程單張上所列條款細則。

H)額外注意事項

  1. 當顧客提出的要求超出訂單內容的合理範圍時, 「本公司」保留拒絕顧客預訂的權利。
  2. 如果「本公司」合理地認為顧客可能給其他參加者或他人帶來不安、不便或阻礙行程順利進行,或者妨礙業務運作,「本公司」保留拒絕顧客預訂的權利。
  3. 顧客需時刻謹慎照顧隨行之小孩,長者及有需要人士。
  4. 部分提供特定服務和/或活動的服務供應商可能會要求顧客在參與服務和/或活動前簽署相關的免責協定。若顧客未能符合或違反此類供應商的規定和限制,將可能導致預訂被撤銷、無法享受適用的旅行產品或服務,預訂費用損失和/或「本公司」追討因此類違約而產生的費用。
  5. 行程中眾多旅遊項目需要顧客具備基本的健康條件。如果顧客患有慢性疾病、正在懷孕、患有殘疾或有特殊需要,要密切注意自己的身體狀況,並考慮是否適宜參加旅行。請在申請旅行時告知「本公司」,切不可隱瞞或盲目前往。在某些情況下,「本公司」可能會要求顧客提交醫生簽署的醫療證明適合參與行程及要求有醫護人員或照顧者全程陪伴。同時,「本公司」保留拒絕顧客預訂或隨團出發的權利。
  6. 「本公司」、當地獨立旅遊代理人及服務機構單位工作人員不具有個人護理等相關專業知識。如顧客需要此類協助,「本公司」建議顧客與專業人士同行或另作適當安排。
  7. 如顧客於出發前感到身體不適,應即向尋求醫生或專業人士尋求適合旅遊的專業意見。而顧客因身體抱恙導或體溫超過37度(攝氏),「本公司」保留拒絕顧客預訂或隨團出發的權利而不退回任何款項。提早離團所產生之各項費用需由顧客自理。
  8. 如有特殊需要,顧客理應承擔「本公司」根據顧客要求採取的特殊措施的費用。
  9. 入住的酒店「本公司」將根據房態或實際情況安排,恕不接受指定住宿。入住房型按行程表上所列,「本公司」不保障具體房間設施,所處位置及顧客特殊要求(包括但不限房間升級,床型,吸煙房等)。住宿房間如有衛生安全問題或設施嚴重不完善,請立即與導遊和住宿供應商聯繫,當場解決。
  10. 如顧客有特殊需求,請於確認訂單前向「本公司」諮詢。申請一經被接納,一概不能取消或更改,顧客理應承擔「本公司」根據顧客要求採取的特殊需求的費用(如有)。日後若「本公司」因任何原因而取消旅行團,相關費用概不發還。
  11. 如顧客需要加床安排,請在預訂時備註,後續是否可以安排及相關費用以「本公司」回覆為準。部份酒店房間面積較小,加床可能會引起顧客的不便,顧客應先評估情況,再決定應否確認安排。加床安排一經被接納,一概不能取消或更改。
  12. 「本公司」按承諾標準確保餐飲衛生及餐食數量,但不同地區膳食口味有差異,不一定滿足顧客的口味或需求,敬請諒解。
  13. 行程中所用車輛皆為專車。車型視出行人數而定,「本公司」會根據人數安排合適的用車,顧客不得異議。
  14. 行程中當地服務機構單位或會提供無線上網服務。實際上網穩定性及速度或會受到不同產品型號,顧客身處位置,實際使用人數,信號覆蓋範圍及信號接收強弱等因素影響,需視乎當地安排為準。顧客不可藉故退團。同時使用該服務人士均受相關之條款及細則規限。顧客應先評估情況,再決定應否接受。
  15. 部份旅行團因行程內容設有年齡限制,詳情請參閱有關行程單張上所列條款細則。例如:
    • 出於安全考慮,15歲以下未成年人需要至少一名成年旅客陪同參加。
    • 部分旅行團因服務能力有限,不接受71周歲(含)以上客人預訂。
    • 部分旅行團因服務能力有限,無法接待嬰兒(14天-2周歲(含))出行。
    • 出於安全考慮,部分旅行團不接受孕婦或行動不便人士預訂。
  16. 「本公司」未有授權任何人士(包括領隊及導遊)向顧客推銷或介紹自費項目或未經「本公司」認可的活動及貨品。因顧客自願參加此等活動或購買此等貨品而引致的任何不滿、損失或傷亡,旅客應直接向介紹人或服務提供者進行交涉或追討賠償,「本公司」一概不會負責。

I)收集及使用個人資料指引

  1. 「本公司」將按照隱私和 Cookie 聲明中的規定收集及使用個人資料。「本公司」向顧客收集的個人資料,將會以保密方式處理,並只會用作為顧客提供相關旅遊服務時使用。過程中,「本公司」可能需要將顧客資料轉交予相關的旅遊代理人或提供服務機構,以安排及完成有關旅遊服務。除此之外,未經顧客同意,「本公司」將不會向其他機構或人士提供顧客的個人資料(法律要求者除外)。
  2. 顧客可透過登入會員帳戶查閱及更正其個人資料。

J)遵照旅遊業議會指示

  1. 遵照旅遊業議會指示,旅行社可向顧客徵收外遊費之0.15%作為印花成本。持有印花收據的顧客,可獲得「旅遊業賠償基金」(包括「旅行團意外緊急援助基金計劃」)的保障,包括:(一)顧客因旅行社倒閉或挾款潛逃,可從旅遊業賠償基金獲得外遊費九成之特惠賠償;及(二)參加旅行團外遊時因意外導致傷亡之人士,他們及其家屬可得到援助基金提供的經濟援助,金額最高為港幣30萬元。上述賠償基金及援助基金並非取代旅遊保險,顧客應自行購買合適的保險計劃,以求全面保障。
  2. 如想查詢上述賠償基金及援助基金之資料,請致電旅遊業賠償基金管理委員會秘書處電話:+852 3151-7945或到網站:https://www.ticf.org.hk查詢。
  3. 旅客必須取得印花收據,方可獲得『旅遊業賠償基金』保障。
  4. 為確保以上權益,「本公司」建議顧客保留已蓋有旅遊業議會印花之旅行團收據正本,並交予親友妥善保存,以作突發事故之意外或保險索償用途。

K)條款可承諾性

此等預訂條款適用於顧客個人,在未獲得「本公司」書面確認前,顧客不可將預訂條款或權利或義務轉讓予任何第三方。「本公司」基於預訂條款所享有的權利可進行轉讓, 且可將其職責委託予他人。

「本公司」有權酌情根據這些預訂條款放棄任何權利。「本公司」也可以根據香港有關機構不時發布的規則和規例的要求放棄其在這些預訂條款下的權利。「本公司」對此預訂條款中任何條款或條件之放棄主張,不得被視為進一步或持續對此條款或條件、或對任何其他條款或條件的放棄主張,任何 「本公司」未基於此預訂條款而主張之權益或條款,不應被視為放棄該權益或條款。若本預訂條款中的任何條款, 被法院或其他具合法管轄權的法庭基於任何理由認定為無效、違法或無法強制執行,此條款應被刪除,或在不影響使用條款中其他條款 完整效用的情況下,將其縮限至最小範圍。

顧客保證顧客擁有所有法律授權,並依據預訂條款以及網站使用條款和隱私政策之規範使用本網站。本網站適用的該預訂條款,以及隱私政策和使用條款,共同構成顧客和「本公司」之間對於網站就旅行預訂的任何使用方式問題的完整理解和協議, 且其效力優於同期的所有該網站旅行預訂的書面和口頭理解、協議、擔保和保證。「本公司」保留任何上述內容未明示之權利。

中文及其他語言譯本如有任何歧異之處, 皆以中文為準。

責任及細則 (住宿套餐預訂)

顧客須於作出任何付款前細讀本“重要責任及細則” 所載的條款及條件,當顧客付款後將視為接受所有條款及條件。

愛旅航有限公司保留變更、刪除或新增條款的權利。每次顧客進行旅行預訂時,都有責任閱讀並接受這些條款。在這些預訂條款經過變更、刪減或新增後,若顧客仍繼續使用愛旅航有限公司的服務即表示顧客認可並接受本條款。如有任何爭議,愛旅航有限公司保留最終決定權。

A)責任問題

  1. 愛旅航有限公司(「本公司」)代顧客安排之交通工具(如郵輪、輪船、火車或巴士等)、住宿、膳食、旅遊觀光或娛樂項目,均非由「本公司」擁有,管理或控制,所有由「本公司」代顧客作出之上述安排,或代上述服務機構單位簽發之任何票據、交換文件、收據、合約等,乃按照上述服務機構單位預先擬定的規則條款簽發。顧客了解所有預訂均受這些條款和任何其他服務提供商特定條款或細則,包括政策的約束(「服務供應商條款」),這些條款或細則應在顧客完成預訂之前提供。 如果這些條款與服務供應商條款發生抵觸,以服務供應商條款的相關規定為準。顧客如遇交通延誤、行李損失、意外傷亡及財物損失等、顧客同意及接受僅向擁有、管理或控制有關交通工具、酒店、食肆、旅遊點或娛樂項目之供應商及機構直接交涉及追討或索償,不論交涉、追討或索償結果如何,顧客不會要求「本公司」對此負上任何責任及放棄向「本公司」追討或索償。顧客在行程中遇上任何事故(例如參加觀光或娛樂項目時發生意外)而導致傷亡及財物損失,顧客同意及接受僅向擁有、管理或控制有關項目之供應商及機構直接交涉及追討或索償。「本公司」概不對該傷亡及財物損失負責。
  2. 在發生不能控制或未預料到事件的情況下,「本公司」及其他代理人及當地服務機構單位有權在在啟程前或旅途中取消或替換行程內之項目,亦有權縮短或延長旅程,顧客不得異議。各參加住宿套餐之顧客同意及接受經調整的行程安排為最終的安排,亦不會把這最終的安排當作違反住宿套餐的商品說明。
  3. 郵輪公司、酒店及其他旅遊機構之服務,均非由「本公司」擁有、管理或控制。「本公司」僅代理其之服務。凡購買「本公司」住宿套餐之顧客如遇有財物損失、意外傷亡、天災人禍、機器失靈、交通延誤、失火、罷工、戰爭、政局不安及政府更改條例等而招致損失或引致額外費用時,顧客同意及接受不會要求「本公司」對此負上任何責任及放棄向「本公司」追討或索償。
  4. 除因由「本公司」或其員工之疏忽而引致顧客之個人傷亡外,「本公司」對顧客在任何意外中之個人傷亡、經濟、娛樂或精神損失概不負責。
  5. 「本公司」直接提供之服務(不包括經委託合作機構),均以香港法律來解釋,對「本公司」所有索償必須於香港辦理,而「本公司」對顧客所負之責任,在適用法律許可的最大程度下不會超過顧客所繳交費用之總額。
  6. 「本公司」不具有各地旅遊規例、不安狀態、健康風險、氣候危險、供應商破產、或對於殘疾人士的適合性等相關專業知識。「本公司」提供的相關資訊僅供參考。顧客應自行尋求目的地官方機構所發布的最新資訊並履行有關規定,以確保符合旅遊資格。顧客特此豁免「本公司」,同意不對關於本章節提及的情況中全部或部分內容以及其他任一超出其管控範疇的情形進行申訴,並同意在旅行返程後30天 內提交任何其他關於「本公司」的申訴。所有申訴必須以書面形式提交並附以精準的證據或證明文件。
  7. 顧客參加「本公司」代理之住宿套餐前,應參閱相關旅遊警示(如有)。顧客參加套餐與否,純屬個人決定。如顧客因當地懸掛旅遊警示而自行決定不參加套餐均當作自動放棄論,所繳費用概不退還,「本公司」不會安排其他替代套餐或服務。
  8. 「本公司」住宿套餐必須按列明日期入住,如顧客要求提早到達或延期逗留,「本公司」當盡力為顧客代訂相應的住宿及其他列明之項目(如有)。但不論提早到達或延期逗留之住宿確定與否,顧客不得藉此取消預訂、要求更改出發日期或作出任何索償。提早到達或延期逗留之日期一經確認,一概不能取消或更改,並採用套餐之預訂條款。顧客同意及接受當套餐尚未開始或延期逗留開始時,「本公司」安排之行程未有生效或即告結束,逗留期間之費用、責任、行李損失、意外傷亡及財物損失等,均由顧客自負,概與「本公司」及其代理人及當地服務機構單位等無關,亦毋需負上任何法律責任。
  9. 顧客如在套餐中自行離開或放棄行程,離開後套餐即告完成及結束,顧客離開後須自負責任,一切與「本公司」或其委託機構無關。
  10. 行程中所安排之船票/住宿/觀光等項目一經「本公司」確認及訂購後,不論任何情況下而未能使用者,概不退回任何款項,不會安排其他替代行程。
  11. 顧客須遵守各國政府之法例,包括但不限於有關風俗、入境或運輸的規定、嚴禁攜帶違禁品、禁止使用航拍機、禁止酒店及住宿房間內吸煙及當地其他違法條例等;違例者須自行負責,「本公司」保留追討因而引致的損失。
  12. 顧客須遵守合理而適當的行為標準,不得侮辱、滋擾、威脅、攻擊或恐嚇其他顧客、服務機構單位人員及其他人士。假如「本公司」或當地服務機構單位合理地認為其中任何顧客不遵守行為標準,或不遵守服務機構單位人員指引及安排,或對他人作出滋擾或影響套餐正常活動及安全時,將被視為違約,顧客同意及接受「本公司」或獲授權人士有權採取「本公司」認為合理必要的措施以防止此等行為繼續,包括終止顧客繼續參加套餐,而「本公司」代安排之套餐對有關顧客即告完成及結束。而受該顧客監護之18歲以下同行團員亦須一併離開。被終止繼續參加套餐的顧客,將不獲退款,「本公司」亦不再對其負有責任,亦不會負責承擔被逐離開後的任何行動及費用。
  13. 所有住宿套餐之更改、取消手續及預訂要求,顧客必須直接與「本公司」聯絡及辦理。如顧客自行與住宿或當地服務機構單位作任何私人協議將被視為無效,「本公司」一概不予承認,並有權終止顧客繼續參加套餐不退回任何款項。
  14. 如果「本公司」由於顧客意圖或疏忽、違反法律、公共秩序和道德的行為或顧客未遵守「本公司」的旅行協議的規定而遭受損害,「本公司」將會向顧客索取賠償。
  15. 顧客應將其旅遊証件副本、旅遊收據、旅遊簽證及旅遊保險保單和所有重要文件副本留於易於聯絡的有關人士,以備在旅程中遺失或損壞文件時用。同時,顧客應確保將家人或朋友的聯絡資料副本,交予「本公司」,以備在緊急情況下,「本公司」或獲授權人士可以提供協助。
  16. 顧客如有任何特別要求,顧客須於報名截止日期前聯絡「本公司」,「本公司」當協助顧客向服務機構單位要求安排,但以服務機構單位最後安排為準。「本公司」及服務機構單位並不確保滿足顧客要求。若最終未能確實接納或滿足顧客要求,顧客不得藉此取消預訂、要求任何更改、退款或作出任何索償。
  17. 根據香港特別行政區個人資料(私隱)條例,所有顧客資料除為安排住宿套餐外,絕對不會提供予第三者。
  18. 報名及責任細則以香港特別行政區法律為依據,所有對「本公司」之索償必須在香港特別行政區辦理。

B)特殊情況

  1. 顧客於出發前須自行了解清楚及預先辦妥所須入境文件包括簽證,沿途於任何國家,如顧客因任何理由而被拒或延遲入境,顧客必須承擔此責任及須承擔由此問題而引致之損失,「本公司」毋須為此負任何責任。顧客所需額外安排之食宿、交通及其他有關之費用全部由該顧客負責,而未能完成套餐之餘下行程將不會獲得任何補償。
  2. 若顧客因簽證問題(包括但不限未辦簽證或簽證被拒)而不能成行,後果均由顧客自負。「本公司」有權就所繳之費用中扣除因此而引致的一切費用包括但不限於住宿、膳食、旅遊觀光的費用及「本公司」的行政費用。
  3. 即使顧客持有有效之入境簽證及旅遊證件,如出/入境時遭本地/當地政府機構或航空公司拒絕出/入境,不論是因其本身背景問題或任何其他原因(不論是否知道原因),顧客同意並接受不能要求「本公司」對此負上任何責任。另所繳費用不得退回或轉予他人或轉用於其他住宿套餐,顧客須自行繳付期間引致之額外費用。
  4. 「本公司」當盡力根據行程安排所有酒店,但「本公司」有權視乎當時情形作出更改,如遇酒店突告滿房、大型活動、滑雪期間或其他特殊情況,將安排住宿鄰近(城市)之同級酒店代替。
  5. 住宿套餐之任何景點和膳食,如遇節日、假期或特殊情況下關閉或休息,「本公司」及服務機構單位有權替換行程內之項目。
  6. 顧客參加套餐中各項活動時,應遵守相關服務人員之指引及安排,並必先衡量個人的年齡、體格、健康狀況、當時的天氣環境及活動內容等,以評估自己能承擔風險程度,再決定應否參與,並須獨自承擔由此而引致的一切責任及後果。當顧客認為有需要時,更應自行尋求醫生或專業人士提供之意見。

C)報名須知

  1. 由於個別國家之出入境條例有別,建議出國顧客之旅遊證件於「旅遊地回程日」起計需有最少6個月有效期。旅遊證件必須有足夠的空白頁數,以蓋上出入境印或入境簽證。參加國內住宿套餐者必須提供相關身份證明文件(如國內居民身份証,回鄉証等)。出行前顧客請務必檢查證件的有效期。
  2. 「本公司」根據顧客所提供之資料進行預訂手續。顧客必須提供旅遊證件上的完全相符之姓名及資料,並清楚核對收據上參加者的資料。如顧客於報名後更改旅遊證件資料或所提供之資料不符,必須立刻通知「本公司 」,因更改資料會導致其預訂須重新辦理,顧客必須繳付由此而產生之額外費用。
  3. 「本公司 」保留取消任何以虛假或重覆名字登記訂單之權利。
  4. 請務必填寫準確有效的聯繫方式(如手提電話號碼及電郵地址),以便「本公司 」聯絡顧客。
  5. 當顧客收到確認書時,請仔細核對以確保內容正確無誤,諸如旅行日期、地點、票價和內容。對於因顧客未確認行程而導致的損失和不便,「本公司 」不承擔任何責任。
  6. 預訂一經「本公司」確認及訂購後,除經「本公司」之特別同意及安排,否則不得將預訂轉予他人或轉用於其他出發日期或其他住宿套餐。
  7. 如因實際入住顧客與預訂入住顧客資料不符,「本公司」或服務機構單位有權拒絕為顧客登記入住或提供套餐項目。顧客需自行承擔所有費用及責任。「本公司」亦有權取消其參加資格而毋須發還任何費用。
  8. 住宿套餐圴列明最多可容納人數。若超出列明人數,「本公司」或服務機構單位有權拒絕為顧客登記入住或要求顧客繳付額外費用。顧客需自行承擔所有費用及責任。「本公司」亦有權取消其參加資格而毋須發還任何費用。
  9. 在一個住宿套餐中,每位顧客可以預訂最多 3 間客房。如果「本公司」認定顧客透過個別預訂的方式總計預訂超過 3 間客房,「本公司」保留取消預訂的權利,並按條款收取相關費用(如適用)。
  10. 顧客參加「本公司」之住宿套餐,必須自行選擇購買適當的旅遊保險;顧客有責任認清承保範圍,必須理解保單內的條款細則,確保所購買的保險能夠覆蓋行程中各項已包及自費活動。
  11. 請保留收據,以作特殊情況下退款之憑據。
  12. 訂單需以電子錢包或信用卡形式全數繳付費用,並經過銀行確認過帳,方可作實。所有付款皆以港幣、美金或南韓圜形式結算。若顧客以非港幣、美金或南韓圜結算的貨幣付款,需自行承擔銀行匯率之差異及手續費,詳情請向相關金融機構查詢。
  13. 減免折扣,豁免及其他推廣優惠,必須於報名時申請及提供證明予「本公司」。
  14. 住宿供應商可能要求顧客於辦理入住手續時,以信用卡或現金形式向酒店交付保證金。在離開前,顧客必須直接向住宿供應商繳付所有雜費及個人消費。
  15. 住宿套餐費用及年齡定義各有不同。詳情請參閱有關行程單張上所列條款細則。
  16. 按行程出發日計算,年齡未滿18歲的顧客須符合下列報名要求:
    • 15歲以下:必須與父或母或監護人同行。
    • 滿15歲而未滿18歲: 如非與父或母或監護人同行,則必須由父或母或監護人同意並於確認書簽署作實,個別國家或有可能要求具備一份合適的旅遊綜合保險及一份入境國家認可的同意書
  17. 由成人陪同的兒童或嬰兒也需要預約登記住宿套餐,並需付相關費用。「本公司」將不會為嬰兒額外提供膳食,酒店床位及任何佔座位之交通安排的座位。如顧客要求提供嬰兒床,「本公司」將協助顧客向住宿供應商面要求安排,但以住宿供應商面保留最終決定權。
  18. 「本公司」保留接受報名與否之最終權利。
  19. 住宿套餐成行與否受不同因素影響,「本公司」保留最終決定權。若「本公司」最終決定該套餐不能成行,「本公司」將按套餐條款退回團費。

D)費用包括

  1. 酒店住宿:根據行程表內所列之酒店,房間是以兩人共用一雙人房為標準。單人房費(或附加費)則以一人佔一房為標準。部分國家之住宿於顧客入住後,會在當地額外向住客收取附加費用或稅項。詳情請參閱有關行程單張。
  2. 膳食:行程表內所列之膳食,惟在發生突發或無法控制事件的情況下,「本公司」及服務機構單位有權替換行程內之膳食。
  3. 交通工具(如有):行程表內所列之各式交通工具,惟在發生突發或無法控制事件的情況下,「本公司」及服務機構單位有權替換行程內之交通工具。
  4. 觀光或娛樂節目(如有):行程表內所列之活動,惟在發生突發或無法控制事件的情況下,「本公司」及服務機構單位有權替換行程內之項目。

E)費用不包括

  1. 領隊、司機及服務員之服務費。
  2. 旅遊證件、各國之入境簽證費。
  3. 各國之機場稅、港口稅、燃油附加費、航空保險稅。(除特別註明除外)
  4. 一切私人性質之費用。
  5. 所有行程表以外之膳食,觀光節目。
  6. 行程內於當地餐廳用膳期間的私人消費。
  7. 提早到達或延期逗留者住宿或機場之接送費用、單人房附加費、升級房間等級或其他相關之費用。
  8. 因私人、交通延阻、罷工、颱風或其他「本公司」不能控制的情況而引致之額外費用。
  9. 旅行平安、醫藥、行李等保險。
  10. 因個人問題或個人糾紛所引致之責任、延誤、損失及賠償。
  11. 個人需要的醫療服務費用及有關的其他支出。

F) 取消及退款辦法

  1. 若因參加人數不足,或已知或受到「迫不得已理由」的影響,「本公司」有權提前取消住宿套餐,「本公司」毋需負責取消套餐的責任或支付額外補償。
  2. 「迫不得已理由」指戰爭、政治動盪、恐怖襲擊、天災、疫症、惡劣天氣、交通工具發生技術問題、載運機構臨時更改班次 / 時間表、罷工、工業行動、旅遊目的地政府 / 世界衛生組織發出旅遊警告、香港特區政府發出紅色 /黑色外遊警示,以及其他業界不能控制的不利旅客外遊的情況。
  3. 除經「本公司」之特別同意及安排,「本公司」或服務機構單位均不接納顧客在出發前,出發日或旅途中自行更改由其他人士代為參加或使用套餐,已報名的顧客將被當作自動放棄論,「本公司」亦有權取消其參加資格而毋須發還任何費用。該顧客需自行承擔所有行為後果。
  4. 顧客可於報名時要求自行出發或中途參加,惟因任何延誤以致未能使用套餐安排之行程,所繳費用概不發還,而其個人之一切住宿膳食以及其他直接或間接的費用或損失,一切由顧客承擔。
  5. 顧客如在旅途中突然退出或不參予任何套餐活動如膳食、觀光或住宿),均當作自動放棄論,所繳費用概不退還,亦不會安排其他替代活動。
  6. 如顧客需要服務機構單位代表於途中或套餐完結後提供額外協助,當中衍生之額外開支,一切由顧客承擔。
  7. 訂單確認後,顧客因任何情況下提出要求取消或更改參加者,出發日期及住宿套餐等,應盡快於出發日前事先提出(不包括出發日及通知日)。若不被接納,顧客需按原有確認之行程安排,否則全額費用將被扣除。申請一經被接納,款項將按照行程單張上所列條款扣除費用(不包括出發日及通知日)。日後若「本公司」因任何原因而取消套餐,所扣除的費用概不發還。
  8. 部份住宿套餐於訂單確認後無法取消、退款或更改,所有費用將被扣除。詳情請參閱有關行程單張上所列條款細則。

G)額外注意事項

  1. 有關住宿設施及活動,如因天氣或其他因素(包括但不限於不可抗力情況,當地條件,維修重建等)影響而未能進行活動或享用設施。「本公司」不會作出任何賠償。
  2. 當顧客提出的要求超出訂單內容的合理範圍時, 「本公司」保留拒絕顧客預訂的權利。
  3. 如果「本公司」合理地認為顧客可能給服務機構單位人員或他人帶來不安、不便或阻礙行程順利進行,或者妨礙業務運作,「本公司」保留拒絕顧客預訂的權利。
  4. 部分提供特定服務和/或活動的服務供應商可能會要求顧客在參與服務和/或活動前簽署相關的免責協定。若顧客未能符合或違反此類供應商的規定和限制,將可能導致預訂被撤銷、無法享受適用的旅行產品或服務,預訂費用損失和/或「本公司」追討因此類違約而產生的費用。
  5. 行程中眾多旅遊項目需要顧客具備基本的健康條件。如果顧客患有慢性疾病、正在懷孕、患有殘疾或有特殊需要,要密切注意自己的身體狀況,並考慮是否適宜參加旅行。請在申請旅行時告知「本公司」,切不可隱瞞或盲目前往。在某些情況下,「本公司」可能會要求顧客提交醫生簽署的醫療證明適合參與行程及要求有醫護人員或照顧者全程陪伴。同時,「本公司」保留拒絕顧客預訂或參與套餐的權利。
  6. 如顧客於出發前感到身體不適,應即向尋求醫生或專業人士尋求適合旅遊的專業意見。而顧客因身體抱恙導或體溫超過37度(攝氏),「本公司」及服務機構單位保留拒絕顧客預訂或使用套餐的權利而不退回任何款項。提早離開所產生之各項費用需由顧客自理。
  7. 如有特殊需要,顧客理應承擔「本公司」根據顧客要求採取的特殊措施的費用。
  8. 住宿房型按行程表上所列,「本公司」不保障具體房間設施,所處位置及顧客特殊要求(包括但不限房間升級,床型,吸煙房等)。住宿房間如有衛生安全問題或設施嚴重不完善,請立即與住宿供應商聯繫,當場解決。
  9. 如顧客有特殊需求,請於確認訂單前向「本公司」諮詢。申請一經被接納,一概不能取消或更改,顧客理應承擔「本公司」根據顧客要求採取的特殊需求的費用(如有)。日後若「本公司」因任何原因而取消套餐,所扣除的費用概不發還。
  10. 如顧客需要加床安排,請在預訂時備註,後續是否可以安排及相關費用以「本公司」回覆為準。加床後房間活動面積也可能較少,可能會引起顧客的不便,顧客應先評估情況,再決定應否確認安排。加床安排一經被接納,一概不能取消或更改。
  11. 行程中當地服務機構單位或會提供無線上網服務。實際上網穩定性及速度或會受到不同產品型號,顧客身處位置,實際使用人數,信號覆蓋範圍及信號接收強弱等因素影響,需視乎當地安排為準。顧客不可藉故取消預訂。同時使用該服務人士均受相關之條款及細則規限。顧客應先評估情況,再決定應否接受。
  12. 「本公司」未有授權任何人士(包括服務機構單位)向顧客推銷或介紹自費項目或未經「本公司」認可的活動及貨品。因顧客自願參加此等活動或購買此等貨品而引致的任何不滿、損失或傷亡,旅客應直接向介紹人或服務提供者進行交涉或追討賠償,「本公司」一概不會負責。

H)收集及使用個人資料指引

  1. 「本公司」將按照隱私和 Cookie 聲明中的規定收集及使用個人資料。「本公司」向顧客收集的個人資料,將會以保密方式處理,並只會用作為顧客提供相關旅遊服務時使用。過程中,「本公司」可能需要將顧客資料轉交予相關的旅遊代理人或提供服務機構,以安排及完成有關旅遊服務。除此之外,未經顧客同意,「本公司」將不會向其他機構或人士提供顧客的個人資料(法律要求者除外)。
  2. 顧客可透過登入會員帳戶查閱及更正其個人資料。

I)條款可承諾性

此等預訂條款適用於顧客個人,在未獲得「本公司」書面確認前,顧客不可將預訂條款或權利或義務轉讓予任何第三方。「本公司」基於預訂條款所享有的權利可進行轉讓, 且可將其職責委託予他人。

「本公司」有權酌情根據這些預訂條款放棄任何權利。「本公司」也可以根據香港有關機構不時發布的規則和規例的要求放棄其在這些預訂條款下的權利。「本公司」對此預訂條款中任何條款或條件之放棄主張,不得被視為進一步或持續對此條款或條件、或對任何其他條款或條件的放棄主張,任何 「本公司」未基於此預訂條款而主張之權益或條款,不應被視為放棄該權益或條款。若本預訂條款中的任何條款, 被法院或其他具合法管轄權的法庭基於任何理由認定為無效、違法或無法強制執行,此條款應被刪除,或在不影響使用條款中其他條款 完整效用的情況下,將其縮限至最小範圍。

顧客保證顧客擁有所有法律授權,並依據預訂條款以及網站使用條款和隱私政策之規範使用本網站。本網站適用的該預訂條款,以及隱私政策和使用條款,共同構成顧客和「本公司」之間對於網站就旅行預訂的任何使用方式問題的完整理解和協議, 且其效力優於同期的所有該網站旅行預訂的書面和口頭理解、協議、擔保和保證。「本公司」保留任何上述內容未明示之權利。

中文及其他語言譯本如有任何歧異之處, 皆以中文為準。

愛旅航有限公司(「本公司」)明白及尊重客戶對於個人私隱的權利。本私隱聲明旨在確保客戶透過網站、應用程式(「本平台」)使用本公司的產品或服務時,能就提供相關的個人資料作出適當決定。

適用範圍

客戶向本公司提交個人資料,即表明客戶同意本私隱聲明所列的處理方式。客戶的個人資料為自願提供。如客戶不同意本公司的政策與處理,客戶可選擇不使用本平台。若客戶拒絕提供或選擇撤回同意,本公司可能無法提供或履行相關的服務(如:完成客戶的預訂)。一旦使用平台的任何部分,即表示客戶接受並同意本公司關於隱私權的做法。若本公司更新本隱私政策,而客戶繼續使用平台(在修訂後的隱私政策張貼之後),即表示客戶接受並同意修訂後的隱私政策條款。

本聲明不適用於連結至本平台、或可由本平台連結的任何第三方平台所收集到的資訊。第三方平台均有其私隱政策及程序,請仔細閱讀。本公司對其政策及處理概不承擔責任。

本平台服務使用對象僅限 18 歲或以上成年人士。18歲以下之未成年人士(包括兒童)不得在本平台上提供任何個人資料。本公司未蓄意收集未滿 18歲以下未成年人士的個人資料。除非已獲取家長或合法監護人的同意,18歲以下之未成年人士請勿在本平台註冊及進行任何交易,也請勿提交個人資料。

收集個人資料方法

本公司或會透過以下方法獲得客戶的個人資料:

  • 客戶使用本公司的網站、應用程式進行任何交易及提交資料
  • 在本公司建立和管理帳戶
  • 參加任何活動中向本公司提供的個人資料
  • 註冊以接收優惠或推廣資料
  • 第三方(如:關聯企業、服務供應商、合作夥伴)
  • 客戶瀏覽本公司的網站或下載及使用應用程式時,本公司亦會在取得客戶的同意下透過自動化技術(如適用)收集有關資料。

追蹤技術會取得客戶一般使用網路的資訊。這有助於改善平台運作,並使本公司能夠提供更佳、更個人化的服務。若客戶選擇拒絕追蹤技術,可透過瀏覽器的指示作出相應的設定。但同時,客戶可能會無法使用本公司服務的部分功能。

個人資料內容

本公司會透過上述方法所獲得包括(但不限於) 以下個人資料:

  • 客戶/ 聯絡人個人資料:姓名、性別、出生日期、電話號碼、住址、電郵地址、政府發出的身份證明文件等
  • 財務資料:信用卡號碼、持卡人姓名、到期日期、銀行帳戶詳情等
  • 客戶的個人喜好:特別要求、旅遊資訊、影像、影片和其他錄音、社交媒體內、容調查問卷
  • 通訊內容:聯絡方式、文字和錄音通訊紀錄、聊天室紀錄、客戶協作工具使用等
  • 會員計劃:會籍資料、用戶驗證、活動紀錄等
  • 個人特別資料:國籍、健康狀況、工作狀況、緊急聯絡等
  • 平台瀏覽及使用:使用細節、IP位置、作業系統等

客戶可能向本公司提供其他人士的個人資料(如:作為同行旅伴、進行交易及提交查詢)。此前客戶應確保取得相關人士的批准及知悉其個人資料將會提供予本公司用作以下用途。

使用個人資料用途

本公司會使用、保留、查閱透過上述方法所獲得的個人資料作以下用途:

  • 辦理旅遊相關產品及服務(包括但不限於規劃、預訂、管理、查閱)
  • 辦理帳戶相關的服務(包括但不限於建立、管理、驗證、維護)
  • 提供客戶服務及作品質監控、培訓、爭議解決
  • 產品及服務之修訂,推廣及優惠資訊、市場研究、數據核對等
  • 處理事故,申索及管理其他風險
  • 提供及改善本平台、工具、活動的成效和安全
  • 遵守適用法律、保障本公司及客戶的權利及利益
  • 在法律允許的情況下按合法商業目的經營業務

在知會用途並取得客戶的同意後,本公司也可能將客戶的資訊用於任何其他用途。

獲轉交資料的部門/人士

客戶透過本公司所提供的個人資料或會向下列人士/單位分享:

  • 旅遊產品及服務供應商、代理商、承辦商
  • 第三方服務供應商/ 外判商(如:網絡系統承辦商,顧問,會計公司,社交媒體)
  • 本公司的關聯企業和合作夥伴
  • 在法律允許的情況下適用的政府機關及機構
  • 在法律允許的情況下按合法商業目的相關企業

本公司在契約中要求這些第三方將個人資料予以保密,且只能使用在本公司同意的使用目的上。

  • 以實現客戶提供資料之目的。
  • 以實現客戶提供資訊時,本公司揭露的任何其他目的。

在知會用途並取得客戶的同意後,本公司也可能揭露客戶的資訊予第三方,供其他目的使用。

此外,本公司亦可能為達下列目的而向第三方揭露客戶的個人資料:

  • 為了遵守法院命令或其他法律義務。
  • 若本公司相信揭露是必要或適當的,以保護本公司、其客戶或其他人之權利、資 產或安全。這包括基於防範詐欺與減少信用風險目的,而與其他公司和組織交換資訊。

客戶權利

客戶擁有並可選擇行使以下權利:

  • 索閱、修正或處理客戶的個人資料及帳戶內容
  • 選擇拒收有關本公司的推廣訊息
  • 選擇撤回同意提供個人資料作市場推廣目的
  • 將個人資料轉移至第三方(如適用)
  • 對本公司的個人資料處理提出查詢、限制或投訴

個人資料保安

當獲得個人資料時,本公司會保存於有防火牆保護的安全伺服器內。只有本公司職員及獲授權的人士方可接觸有關資料。相關人士亦需遵守保安指引和保持警覺。雖然本公司盡力保護客戶的個人資料,然而無法完全保證資料之安全。本公司對因資料盜竊或其他惡意行為所導致的資料使用或披露概不承擔責任。

當客戶使用帳戶以存取本平台的特定部分,請必須負責將密碼保密,以免外洩。同時注意在使用任何公用無線網路時,盡量避免提供任何敏感資料,包括付款詳情等。

本公司無法保證網路傳輸沒有風險及不被第三方閱讀或截取。客戶需自行承擔相關風險,本公司不會就客戶以任何方式連接、存取及使用本平台所導致的直接、間接、特殊、附隨、衍生、懲戒性之損害承擔任何責任。

查詢及處理個人資料

若客戶對本私隱聲明有任何疑問或查詢,或希望索閱、修正或拒絕本公司處理客戶的個人資料,請登入會員帳戶提出或以書面電郵至 info@tourtolove.com 辦理。本公司會盡力在15個工作天內處理任何更正個人資料的要求。

撤銷同意

本公司不會阻止或禁止客戶撤銷客戶允許個人資料供收集、使用或揭露的同意權。在資料收集方面,若客戶撤銷同意,必須連帶決定客戶不使用平台,因為一旦客戶存取平台,資料就會自動被收集。在個人資料的使用或揭露方面,除非依法必須使用或揭露,否則本公司將不再使用及收集客戶的資料。

保留個人資料

為了向客戶提供本公司的產品和服務或基於其他本公司隱私政策規定的原因,本公司在必要時將保留客戶的個人信息。當保留的資料不再滿足資料的收集目的,且對法律和營業目的不再是必要時,本公司將不再保留個人資料。

本私隱聲明的修訂

本公司可隨時修訂本條款且無須提前通知。所有的變更都會在本公司發布後立即生效,並適用於此後所有本平台的存取與使用。然而,任何由政府法律與司法部門針對相關爭議性決議條款所提出的變更,將不適用於任何當事人已明確告知,或在條款變更並公告於本平台當日或之前就已存在的爭議。

客戶有責任定期查閱和必須接受更新後的使用條款,方可繼續使用本平台。若客戶不同意本條款,請立即停用或存取本平台。

本公司對私隱聲明所作的修訂,會張貼在網站及應用程式。若本公司對私隱聲明做了重大的修訂,將透過電子郵件或平台首頁公告來通知客戶。私隱聲明前次修訂的日期標示在文件的上方。

準據法

本條款以香港特別行政區法律為依據。因本條款以及由此引起的任何爭議必須在香港特別行政區辦理。香港特別行政區對本條款以及由此引起的任何爭議具有管轄權。

中文及其他語言譯本如有任何歧異之處, 皆以中文為準。

TOURTOLOVE平台www.TOURTOLOVE.com及/或TOURTOLOVE應用程式(合稱「本平台」)由愛旅航有限公司(「本公司」)擁有及營運。使用本平台、由本公司及其指定關聯企業、第三方服務供應商透過本平台所提供的服務(「服務」)前,請先細閱本條款。此條款中使用的「客戶」包括任何進入本平台的人士、任何透過本平台購買服務的人士及與本平台聯絡的人士。

只要存取或使用本平台,即代表客戶同意本條款、本公司私隱聲明,以及任何關於客戶使用服務的指引、使用規則及補充條款。請細閱本條款,因為這些條款構成客戶與本公司之間的整體協議。若客戶不同意這些條款、規範或政策,請勿存取或使用本平台。本公司可隨時修改本條款且無須提前通知,客戶必須接受更新後的使用條款,方可繼續使用本平台。

使用本平台

存取或使用本平台,客戶聲明並保證:

  • 已年滿 18 歲或以上之成年人士
  • 有構成具法律約束力合約的能力
  • 將遵守所有上述之規範要求
  • 僅限使用本平台為客戶本人,或已授權客戶代為預訂的其他人士,進行合法預訂(客戶應確保取得相關人士的批准及知悉相關使用條款,包括適用於該預訂的所有規則與限制)
  • 提供予本平台之資訊皆為真實、準確、最新並完整
  • 如果客戶在本平台持有帳戶,須保護帳戶資訊,無論客戶本人或其他人士使用此帳戶,須由客戶本人監督並負全部責任。

若任何人士不同意或符合以上條件,請勿存取或使用本平台。本公司有權以任何理由(包括但不限於違反使用條款及上述之規範要求)隨時自行決定拒絕任何人士存取或使用本平台提供之服務,恕不另行通知。

禁止之活動

客戶同意基於合法目的及本條款之規範來使用本平台。同時,

  • 不得將平台用作違反任何當地或國際適用的法規
  • 不得將平台內容或服務用於商業目的(包括但不限於推廣,促銷)
  • 於本平台預訂旅遊相關產品、服務或其他產品後,不得將其轉售圖利
  • 不進行任何投機、虛假或欺騙性質之預訂,或基於預期需求而預訂
  • 不得以任何方式或程序存取、監控或複製本平台內容或資訊
  • 未經本公司書面同意,不得基於任何目的而連結至本網站任何部分(包括但不限於旅遊服務的購買路徑)
  • 未經本公司書面同意,不得在其他網站或平台中複製、轉售或包含本平台之任何部份
  • 不得干擾或試圖干擾本平台的正常營運或本平台進行的任何活動
  • 不採取本公司認定為對基礎設施造成或可能造成不合理或過大荷載的行動
  • 不得以任何方式使用本平台而使之癱瘓、負載過度、受損或削弱,或干擾任何其他人士對於本平台之使用
  • 不得以任何方式獲取或披露未獲授權的資料(包括但不限於個人資料,商業內容)
  • 不得傳送、上傳及使用不符合下述內容準則的任何資料(包括但不限於推廣,促銷,惡意披露、騷擾)
  • 不得傳送或上傳包括病毒、特洛伊木馬程式、網路蠕蟲、定時炸彈、間諜程式、廣告軟件或對任何電腦軟、硬件操作造成不利影響的其他有害程式和資料。
  • 假冒或企圖假冒本公司、本公司職員、任何其他人士或個體(包括但不限於使用前述人員的電子郵件位址或網路名稱)

私隱聲明
本公司明白及尊重客戶對於個人私隱的權利。關於本公司對於個人資料的相關政策,請閱讀現行有效的私隱聲明。只要存取或使用本平台,即代表客戶同意並遵守私隱聲明,並特此納入本使用條款中。

知識產權 

本平台提供的資訊(包括但不限於內容、設計、文字、圖像、聲效等)、軟件、產品和服務均為本公司、關聯企業或第三方服務供應商全權擁有。客戶不得擅自刪除、混淆、修改、複製、傳送、展示、執行、重製、出版、授權、製作衍生產品、發布、轉讓、銷售或轉售。客戶不得基於任何商業用途使用本平台的任一部份,或可從本平台取得之任何服務或資料。

本公司的標誌和公司名稱已於香港註冊商標或商標。本公司並沒有就使用此商標、公司名稱或稱號給予批准。而該等使用或會構成侵犯本公司的權利。另外,平台中提及的其他標誌、產品及公司名稱可能是其相關持有人的商標。本公司對於非本公司擁有及營運之平台內容概不承擔責任。

當客戶上載及傳送內容至本公司或於活動中提供資訊,客戶保留該資訊的知識產權的所有權,且授與本公司和合作夥伴免費、非專屬、永久、不可撤回、可再授權的權力去使用、寄存、儲存、複製、修改、製作衍生作品(包括但不限於翻譯、改編、摘要)、分享、發布、公開展示此內容。同時允許其他人士或個體按本條款之規範,透過本公司取覽、複製、分享、發布、準備衍生作品,及公開展示該內容(例如轉發網誌、轉貼或下載內容)。

在清晰完整理據支持之下,若客戶認為本公司或其他人士於本平台發布的內容侵犯其知識產權,客戶可登入會員帳戶通知本公司。若客戶的投訴填寫不當或理據不完整,本公司不會處理該投訴。如通知中有不實陳述,可能觸犯適用法律,亦可能導致客戶須負擔賠償。

平台服務及內容

本平台提供的內容的知識產權及與服務相關權利均由本公司所擁有。存取或使用本平台,即代表客戶同意若被認為違反本條款或侵犯知識產權,本公司有權拒絕向其及有關人士提供任何內容和服務。獲本公司授權下,客戶可存取平台內容作指定用途。此等授權為非專屬、不得轉移,並只限根據本條款之規範而執行相關存取。

客戶需遵守所有規範視為使用本平台之必需要件及務必確保所有透過您的網路使用本平台之個人都了解這些服務條款,並同意遵守。

本公司有權自行酌情撤回與修訂本平台,及所提供的服務或資訊,且無需另行通知。平台內容會不定期更新,惟其不一定會是完整或最新的。本平台中的任何資料都可能於任何時間過期,本公司並沒有更新這些資料的義務。若本平台所有或部分之功能和服務於任何時間因任何理由無法使用,本公司恕不負責。本公司亦可能會不定時限制客戶 (包括但不限於註冊會員或其他人士),對於本平台的使用權限。

於本網站或透過本網站所發布的資訊,僅供一般資訊目的使用。本公司無法保證及聲明平台內容的準確性、質素或完整性或其就任何用途的合適性。任何因客戶對於此等資訊的信賴而可能導致的風險,完全由客戶自行承擔,本公司亦不會就此承擔任何責任。針對因客戶或任何其他本網站的訪客,或任何被告知此等資訊之任何內容的人對於此資訊之信賴所衍生的所有義務與責任,本公司一概拒絕承擔。

另外,本平台可能含有由第三方(例如客戶本人,其他人士,合作夥伴,企業實體,傳媒等)所提供的內容。由本公司所提供的內容以外之資料中的所有陳述與或意見,和所有的文章與問題回應以及其他內容,皆為提供這些內容的個人或個體各別的意見,且其責任由資料提供者自行承擔。這不一定代表本公司的立場,推薦或認可此類內容。同時,本公司亦無法保證其準確性和質素。第三方將自行承擔全部責任。

帳戶註冊及使用規範

客戶須註冊個人帳戶(「帳戶」)以使用本平台服務及進行交易。帳戶須維持於生效狀態以持續使用服務。所有帳戶均不得轉讓,且對於帳户的所有權利均於帳户失效時終止。

同意並完成註冊,即表示客戶聲明(而本公司有權據此依賴有關聲明)客戶年滿18歲或以上,有構成具法律約束力合約的能力並將遵守所有條款、細則及通知。

在使用本平台或部分其提供之資源時,客戶可能會被要求提供某些註冊資料或其他資訊。客戶須確保帳戶內及所有提供的資料是真實、準確、最新並完整。客戶可通過系統直接更改有關帳戶資料或與本公司的客戶服務部門聯絡進行。

客戶同意所有客戶於註冊本平台時,與其他包括但不限於透過使用任何本平台的互動功能所提供的資料,都遵循本公司的隱私權政策規範,且客戶同意本公司為確保客戶的資料符合本公司的隱私權政策而採取一切必要之行動。

客戶有責任保護帳戶和資訊安全(例如:登入密碼,帳戶設定,網路安全等),及為透過帳户進行的所有活動負責。若客戶知悉或懷疑未獲授權人士存取帳戶內容或進行未獲授權活動,客戶須盡快與本公司的客戶服務部門聯絡。在此情況下,若客戶的付款資料已儲存於帳戶內,客戶亦需與付款帳戶供應商聯絡,以減少可能發生的任何損失。

本公司保留接受帳戶註冊,使用權限及註銷帳戶之最終權利。

客戶提供內容及規範

本平台及所舉行的活動可能包含留言板、聊天室、個人檔案、在线聊天、公佈欄與其他互動功能。該等功能允許客戶將內容或資料在本平台或透過本平台分享、發布、公開展示。

當客戶提供內容(包括所有文字、檔案、圖像、相片、聲音、影片或其他材料)(「客戶內容」),客戶授與本公司和合作夥伴免費、非專屬、永久、不可撤回、可再授權的權力去使用、寄存、儲存、複製、修改、製作衍生作品(包括但不限於翻譯、改編、摘要)、分享、發布、公開展示及以其他方式使用此內容。客戶亦同意放棄對全部或部分提交內容所享有之版權與其相關之權利。

客戶同意及聲明基於合法目的及本條款之規範來提供客戶內容,並負上全部責任。同時遵守以下內容規範:

  • 擁有或已獲相關人士授權可支配該內容的權利
  • 不包括任何可能屬或鼓吹違法、誹謗、猥褻、淫穢、辱罵、具攻擊性、暴力、欺詐、虛假、令人反感、危害任何人士的安全、旨在騷擾任何人士或不適合於網站上顯示的資料
  • 不包括任何可能屬或鼓吹違反公共利益、道德操守、社會秩序、恐怖主義、危害國家安全的資料
  • 不包括任何可能帶有歧視成分的資料(包括種族、性別、宗教信仰、國籍、殘障、性傾向或年齡等)
  • 不造成任何其他人的困擾、不便、引發不必要的焦慮,或可能使他人不悅、困窘,驚慌或惱怒
  • 不包括涉及商業活動,推廣或銷售等(例如:任何廣告,聯絡資料,商標)
  • 不包括與本平台,公司和活動無關的資料
  • 不會侵犯本公司及任何第三方的知識產權或其他法定權利(例如:聲譽與私隱權)
  • 假冒或企圖假冒本公司、本公司職員、任何其他人士或個體

若客戶不同意該以上規範,請勿提供任何資訊。如本公司懷疑或收到指控客戶內容違反以上規範,本公司可移除,拒絕顯示該內容,甚或限制客戶使用和發布內容的權限。

客戶須為其提供的內容承擔所有法律責任,包括其合法性、真實性、正確性與適切性等。本公司無法聲明和擔保客戶內容在發布前先行被驗證和有疑義的內容能在發布後及時被移除。不論本公司是否知悉客戶内容,在任何情況下本公司都不對任何用戶內容承擔任何責任。若客戶意圖或疏忽、違反法律、或未遵守本內容規範而令本公司或第三方遭受損害,有關各方將會向客戶索取賠償。

客戶同意本公司得基於任何理由或無特定理由自行酌情將客戶內容移除或拒絕發布。且客戶同意本公司為確保客戶的資料符合本公司的內容規範、私隱政策、個人與個體的其他權益、不利於本公司、本平台使用者或公眾的安全而採取一切必要之行動。

本公司保留發布,使用內容及移除客戶内容之最終權利。


如有第三方聲稱本平台內容侵犯其權利,請以書面電郵至 info@tourtolove.com 作出申訴並提供相關理據以便驗證。

終止帳戶

客戶可選擇隨時終止帳戶。帳户的所有權利及其相關的任何預訂,服務,累積優惠均於帳户失效時終止及作廢。詳情請閱讀現行有效的會員責任及細則。

本公司可不須提前通知,並基於任何理由(包括但不限於懷疑客戶違反任何使用條款及細則,侵犯知識產權,客戶的預訂或帳戶顯示有詐欺、濫用或可疑活動的跡象,久未使用)隨時關閉,終止客戶及任何相關的帳戶及其存取服務的權利。本公司不會就此承擔任何責任。

此外,本公司亦可取消以客戶的名義、聯絡方法或帳戶所作及其相關的任何預訂和服務。如取消的有關預訂和服務為不可退款或涉及取消費用,本公司有權不就已取消的預訂向客戶安排(部分)退款。如需對取消預訂或凍結,關閉帳戶提出申訴,請與本公司的客戶服務部門聯絡。

然而,本公司亦會遵守適用法律及配合任何執法單位或法院命令的指示,揭露任何透過或於本平台發布任何內容的人之身份或其他資訊。

產品及服務訂購

產品的條款和政策各有不同。資料會詳列於產品頁面及確認書。確認訂單前請仔細閱讀並同意相關規則條款。同時,產品或附有額外資訊作參考。

所有產品和服務的預訂都取決於預訂時的供應情況。大部分的產品及服務接受即時確認。本公司會以電郵形式確認客戶的訂單已經收到。該確認書將提供訂購詳情(例如:確認號碼,訂單狀態,付款資料,產品內容)。客戶亦可於帳戶內查看訂購資料。請仔細核對內容。

本公司根據客戶所提供之資料進行預訂手續。客戶必須提供旅遊證件上的完全相符之姓名及資料,並清楚核對收據上參加者的資料。如客戶於報名後更改旅遊證件資料或所提供之資料不符,必須立刻通知本公司,因更改資料會導致其預訂須重新辦理,客戶必須繳付由此而產生之額外費用。

本公司保留基於任何理由或無特定理由接受和取消訂單與否之最終權利。 

價格及付款

訂單需以電子錢包或信用卡形式全數繳付費用,並經過銀行確認過帳,方可作實。本公司使用第三方付款服務以進行網上交易。當客戶作出訂購時,即表示客戶授權本公司,按接納訂單時金額以所提供的電子錢包或信用卡付款,並聲明客戶獲授權作出付款。客戶不應使用失效或未經授權使用的電子錢包或信用卡進行付款。同時亦表示客戶接納第三方付款服務機構的條款及細則,以及授權其收集、處理及保留交易有關資料。

所有付款皆以港幣,美金或南韓圜形式結算。本平台或提供貨幣換算器僅作參考之用,概不保證和負責其準確性。若客戶以港幣,美金或南韓圜結算的電子錢包或信用卡付款,需自行承擔銀行匯率之差異及手續費,詳情請向相關金融機構查詢。

本公司保留隨時修訂價格及收費的權利,變更的內容可能透過電郵或產品頁面顯示。若客戶通知發出後或繼續使用該服務,代表客戶同意並接納修訂後的價格及收費。此外,本公司盡力確保所刊登的價格準確及完整,惟無法保證及聲明不會出現錯誤或疏漏。如發現有關誤差,本公司保留取消預訂或(如經客戶同意)修訂價格的權利。

預訂修改及取消

客戶可透過帳戶和聯絡客戶服務部門修改或取消預訂。跟據確認書上列明的政策,修改和取消或會涉及費用。部份產品和服務於訂單確認後修改和取消,所有費用將被扣除。詳情請參閱確認書上所列條款細則。完成修改或取消後,更新的確認書或取消確認書會以電郵形式發送至登記郵箱。帳戶內訂單內容和狀態顯示亦會更新。

如客戶的訂單被取消,本公司將努力在合理的時間通知客戶,並提供適切的處理方法。客戶接納本公司毋須就客戶的不滿或損失而作出任何賠償。

優惠券使用規範

優惠券會以不同形式提供及發放,並受有關條款及細則約束。使用前請仔細閱讀該條款內容。本公司自行酌情決定優惠券的安排及條款。

客戶必須持有有效的帳戶才可使用優惠券。所有優惠券於帳户失效時立即終止及作廢。

優惠券僅可於指定服務和產品的預訂過程中使用。若在過程中客戶未有使用優惠券,則不得要求於確認後應用於該預訂。優惠券一旦成功使用,即視為已全數兌換完畢及到期。任何剩餘未使用的金額將被作廢。

所有優惠券屬一次性使用,即使訂單因任何理由被取消或其他任何情況,已使用的優惠券將無法重用或退還。本公司無須作出補償或提供其他替代方案。本公司亦不會因人為錯誤 (例如:遺失,被盜用)而重發優惠券。

優惠券不能兌換現金,亦無法抵扣應繳稅項、取消或變更費用、行政手續費或其他雜項,此等費用乃由客戶全額負擔。優惠券不可與其他折扣優惠及推廣活動同時或合併使用。

若客戶試圖以不合法或違反條款的形式使用優惠券(例如:濫用,欺詐,轉售),本公司可拒絕接受優惠券和相關預訂,甚或終止帳戶。本公司職員,或任何與優惠活動有關人士(包括但不限於合作夥伴) 均不得使用優惠券。

本公司可隨時修訂或取消優惠券及其使用規範,且無須提前通知。如有爭議,本公司保留最終決定權。

獎賞積分規範

獎賞積分是一種可於帳戶中累積並於指定期限內使用的獎賞。本公司自行酌情決定獎賞計劃的安排及條款。

客戶必須持有有效的帳戶才可使用獎賞積分。積分於帳户失效時立即終止及作廢。積分只限帳戶持有人使用,不能轉讓。本公司可自行酌情決定接受或拒絕客戶存取和使用積分。

獎賞積分以美元為計算單位,並從分配到帳戶之日起一年內有效。使用後直接由帳戶中自動扣除。逾期或失效的獎賞積分會直接從帳戶中取消,而不作另行通知。客戶可於帳戶查閱積分記錄及狀態。

獎賞積分不能兌換現金,亦無法抵扣應繳稅項、取消或變更費用、行政手續費或其他雜項,此等費用乃由客戶全額負擔。本公司或可酌情容許積分與合資格優惠券同時使用。

若客戶試圖以不合法或違反條款的形式獲取或使用積分(例如:濫用,欺詐,轉售),本公司可取消積分和相關預訂,甚或終止帳戶。

本公司可隨時修訂,暫停或終止獎賞積分及其使用規範,且無須提前通知。此類修訂措施,可能會隨時且不定時影響正生效的積分價值。客戶不應依賴獎賞積分的永續經營,或任何獲利、兌換獎勵、或其他相關的獎勵措施。如有爭議,本公司保留最終決定權。

旅遊責任事項

本公司提供國內外旅遊產品及服務,並不代表聲明或保證目的地為本公司所建議或沒有風險。客戶選擇及前往目的地旅遊與否,應先仔細考慮是否適宜和其相關風險。

本公司不具有各地旅遊規例、入境要求、旅遊證件、不安狀態、健康風險、氣候危險、供應商破產、或對於殘疾人士的適合性等相關專業知識。客戶應自行尋求目的地官方機構所發布的最新資訊並履行有關規定,以確保符合旅遊資格。

客戶須遵守各地法律和合理而適當的行為標準。若客戶意圖或疏忽、違反法律、公共秩序和道德的行為或客戶未遵守本公司的旅行協議的規定而遭受損害,本公司概不承擔責任及將會向客戶索賠因該行為而引致的損失。

本公司強烈建議客戶旅行前自行選購適當的旅遊保險。

供應商條款及限制

客戶作出訂購時須遵守第三方供應商之額外條款及細則。請仔細閱讀該附加條款及細則。因此,若產品及服務所列之政策,和供應商預訂條款中的條款不一致之處,仍應以預訂條款的規定為準。

供應商可能要求客戶提供個人資料(例如:身份證明文件,聯絡方式)、簽署免責聲明、符合安全規定作為使用其提供服務之先決條件。若客戶未能提供所需資料或符合要求而不能使用服務,本公司和供應商均無需負上責任,且無需安排退款。此外,若當地政策禁止提供相關服務,預訂將失效。若客戶試圖以不合法或違反本條款的形式使用服務(例如:提供虛假資料,隱瞞真實情況),本公司和供應商將可拒絕接受或提供服務,且無需安排退款。

住宿方可能在辦理入住手續時要求客戶提供保證金,以支付客戶入住期間的額外費用。該按金完全是住宿方本身的政策,與本公司和預訂費用無關。

客戶同意任何違反上述供應商條款和限制的行為均可能導致預訂被取消、被拒絕存取相關的產品或服務、喪失所支付的費用。本公司保留追討因此而引致的損失的權利。

免責聲明及責任限制

本平台及所展示的內容,產品和服務是基於以當下之情況而提供(不附帶任何明示或暗示的保證), 並會不定期更新,惟其不一定會是完整或最新的。本公司無法保證及聲明平台內容的準確性、質素或完整性或其就任何用途的合適性。任何因客戶對於此等資訊的信賴而可能導致的風險,完全由客戶自行承擔,在適用法律許可的最大限度之下本公司不會就此承擔任何責任。本公司保留修訂不實資訊及拒絕按不實資訊提供服務的權利。

本平台可能含有由第三方所提供的內容,產品和服務。這不一定代表本公司的立場,推薦或認可此類內容,產品和服務。本公司亦無法保證其準確性和質素。第三方將自行承擔全部責任。同時,本平台提供的產品和服務均非由本公司完全擁有,管理或控制,乃由第三方服務供應商負責。本公司不對乃由第三方的行為、失誤、失職、聲明、違規或疏忽負責,不對由此造成的人身傷害、死亡、財產損毀、或由此產生的其他補償金或費用負責。客戶如遇有財物損失、意外傷亡、天災人禍、機器失靈、交通延誤、失火、罷工、戰爭、政局不安、政府更改條例及不可抗力的情況等而招致損失或引致額外費用時,客戶同意及接受不會要求本公司對此負上任何責任。

本公司不保證或聲明本平台所有或部分之功能和服務於任何時間均不受干擾、可靠或並無故障。本公司無法保證網路上或透過本平台獲取的資訊及服務不存在病毒或其他有害的組件。客戶應自行負責執行充份的程序與檢查,以滿足客戶對於病毒防護及輸入與輸出之資料的正確性等特定要求,並針對任何可能的資料損失,採取必要的外部復原措施。此外亦無法保證網路傳輸沒有風險及不被第三方閱讀或截取。客戶需自行承擔相關風險,本公司不會就客戶以任何方式連接、存取及使用本平台所導致的直接、間接、特殊、附隨、衍生、懲戒性之損害承擔任何責任。

在適用法律許可的最大限度之下,本公司特此拒絕提供任何無論明示或暗示、法定或其他形式之任何種類的保證,其中包括但不限於針對特定目的之適銷性、非侵權性與適用性的任何保證。

若本公司,關聯企業或第三方服務供應商認為須就前述情況酌情負責,則本公司,關聯企業或第三方服務供應商的補償責任上限為: (a) 客戶在本平台進行該交易之總額。或 (b)港幣一千元正 (HK$1,000.00)。

若客戶不同意以上條款、有關規範或政策,對本平台和其內容及服務有爭議,請勿存取或使用本平台。

任何在本使用條款適用之法律中明確規定不得予以排除或限制之保證,將不受前述情況之影響。對於因客戶使用(或不當使用)本平台、任何與其連結的網站、任何本平台或其他平台的內容,或透過本平台或其他網站取得之任何服務與物件,或侵犯智慧財產權或任何人、團體之權利,或因與上述事項相關之情況而導致任何損害,本公司、所有董事、其關聯企業、第三方服務供應商,以及相關職員、主管、承包商、代理商、授權人、供應商、承接人與受託者免責概不負責。該等損害包含任何直接、間接、特殊、偶發性、連帶性或懲罰性的傷害,該等傷害包括但不限於人身傷害、痛苦與折磨、情緒困擾、收益損失、利潤損失、商業或預期儲蓄損失、使用權損失、商譽損失、資料損失,以及由於侵權行為(包含自身疏忽)、違反合約或其他原因造成的損失,即便是可預見的情況。無論本公司是否已被告知或可得而知任何損失發生的可能性,本條款中的限制與免責均會適用。

賠償

若由於客戶違反本使用條款,保證、聲明及協議,或因使用本平台,包括但不限於使用提供客戶內容,及因使用本使用條款中未明確授權之內容、服務與產品,或因使用透過本平台獲取之資訊,或因與上述情況相關之情形,而導致任何索賠、責任、損害、判決、獎勵、虧損、成本、支出或費用(包含行政和法律開支)發生,客戶同意賠償並使本公司、所有董事、其關聯企業、第三方服務供應商,以及相關職員、主管、承包商、代理商、授權人、供應商、承接人與受託者免責,同時為其辯護。

第三方網站連結

本平台或包括非本公司擁有及營運的第三方網站或服務之連結。連結會引領客戶離開本平台。此類連結只供客戶參考。這不一定代表本公司推薦或認可此類連結或與該網站營運商有任何關係。同時,本公司亦無法保證連結內容和服務的準確性和質素。第三方將自行承擔全部責任。客戶須審慎考慮相關風險和所有適用政策。此外,本公司亦無義務被牽涉於客戶與第三方的個別交易和爭議。

地圖條款

本平台或包含Google和 Microsoft所管控的資訊及技術。客戶在 Google 使用條款、Microsoft 使用條款、Google 私隱聲明和 Microsoft 私隱聲明的約束下使用本平台的地圖功能。Google 和 Microsoft 有權隨時全權自行變更他們的使用條款和私隱聲明。請仔細閱讀相關條款細則。

一般條款

本條款以香港特別行政區法律為依據。客戶同意受香港特別行政區法院的專有管轄權管轄,和同意在因本平台,本條款以及由此引起的任何爭議必須在香港特別行政區辦理。在任何未承認本使用條款中所有條款均有效的司法管轄中使用本網站,均被視作未經授權使用。

客戶同意使用本平台或註冊帳戶不代表與本公司之間存在合資、合作、業務代表或僱傭關係。

本公司有責任積極配合任何執法單位或法院命令的指示,提供任何客戶存取及使用本平台的紀錄及有關資料。依據前述單位之調查結果所採取的任何行動,所導致的任何索賠,客戶同意放棄相關權益並使本公司、所有董事、關聯企業、第三方服務供應商,以及相關職員、主管、承包商、代理商、授權人、供應商、承接人與受託者免責。

在適用法律許可的最大限度之下,客戶因本條款或存取或使用本平台,或與之相關的內容所致之任何索賠或起訴理由,須於該起訴理由產生的1年內開始進行,否則此項索賠或起訴理由將永久喪失效用。

未經本公司書面同意,客戶不得轉讓或以其他方式處理此等條款及細則規定的全部或部分客戶權利、責任或義務。其他任何人士或個體均無權執行本條款中的任何部分。

本公司可向第三方轉讓、轉移或委任此等條款及細則或委任代其向客戶提供服務,或履行此等條款及細則所載本公司的任何責任,而無需獲得客戶的同意。

整體協議

本使用條款、本公司私隱聲明,以及任何關於客戶使用服務的指引、使用規則及補充條款一起構成此一適用於客戶本公司之間的完整協議,藉以明定與本平台相關的事宜,並用以取代先前同時期涉及本平台之所有書面與口頭的協議、陳述及保證。

權益放棄與可分割性

本公司對於本條款中列明之任何條款或細則所提出之放棄主張,不得被視為進一步或持續對於該條款或細則,或對於任何其他條款或細則之的放棄主張;任何本公司基於維護本條款明定之任何權益或條款而產生之未竟事宜,不應被視為放棄該權益或條款之主張。

若本使用條款中有任何條款,被政府或具合法管轄權的執法機關基於任何理由認定為無效、違法或無法強制執行,此條款應被刪除,或在不影響使用條款中其他條款的完整全效力之前提下,將之縮限至最小範圍。且本條款內的其他條文仍完全有效。

查詢及客戶支援

若客戶對本條款有任何查詢或欲報告任何違反本條款的情況,請登入會員帳戶聯絡本公司,並提供相關理據以便驗證。

客戶意見

客戶提交任何關於本公司的平台、服務、產品、應用程式或技術的任何推薦、提案、建議或其他意見均有機會被本公司使用。客戶同意本公司無需向客戶作出任何通知或負有任何義務,亦不受任何限制,並無需提供補償或報酬,同意放棄對全部或部分提交內容所有現有或未來的權利。

本使用條款的修訂

本公司可隨時修訂本條款且無須提前通知。所有的變更都會在本公司發布後立即生效,並適用於此後所有本平台的存取與使用。然而,任何由政府法律與司法部門針對相關爭議性決議條款所提出的變更,將不適用於任何當事人已明確告知,或在條款變更並公告於本平台當日或之前就已存在的爭議。

客戶有責任定期查閱和必須接受更新後的使用條款,方可繼續使用本平台。若客戶不同意本條款,請立即停用或存取本平台。

TERMS AND CONDITIONS (PACKAGE TOUR)

Please take the time to read and understand this Terms and Conditions set out below prior to booking a trip with us. We strongly recommend that customers carefully read all information relating to your trip on our website and APPs. Customers will be deemed to have accepted this Terms and Conditions after making payment.

TOURTOLOVE Limited reserves the right to change, delete or add new terms. It is customer’s responsibility to read and accept these Terms each time he/ she makes a travel reservation. Customer’s continued use of TOURTOLOVE Limited services after changes, deletions, or additions have been made to these Terms shall constitute customer’s acceptance thereof. In case of any disputes, the TOURTOLOVE Limited reserves the right to make final decision.

A)Responsibility

  1. The transportation (such as cruises, ships, trains or buses, etc.), accommodation, meals, sightseeing or entertainment arranged by TOURTOLOVE Limited (the “Company") are not owned, controlled or managed by the “Company”, but is issued and arranged in accordance with the rules and terms set by local independent travel agents and service agencies. Customer understands that all bookings are subject to these Terms and any other service provider specific terms or conditions, including policies, (“service provider terms”) which shall be made available to customer before completing booking. In the event of conflict between these Terms and service provider terms, the relevant provisions of the service provider terms will prevail. In the event of an unexpected or unforeseen situation, the customer agrees and accepts the final arrangement of the local travel agent and service provider, and agrees that these arrangements do not constitute a violation of the trade descriptions of the tour. In case of traffic delays, baggage loss, accidental casualties and property losses, etc., customer agrees and accepts that he/ she will recover the amount of the loss or damage by negotiate, claim, action against and only the suppliers and organizations that own, manage or control the transportation, hotels, restaurants, tourist spots or entertainment. Regardless of the outcome of the negotiation, claim or action, the customer should not make claim against the “Company” for any recovery.
  2. The services of cruise companies, hotels and other travel companies are not owned, managed or controlled by the “Company". In the event that the customer participating in tour of the “Company" suffer from property damage, accidental casualties, natural disasters and human failure, machine failures, traffic delays, fires, strikes, wars, political unrest, or changes in government regulations, etc., which incur losses or additional expenses, the customer agrees and accepts that he/ she should not make claim against the “Company” for any recovery.
  3. Except for the personal injury or death of the customer caused by the negligence of the “Company” or its employees, the “Company” shall not be responsible for the personal injury, financial, entertainment or mental loss of the customer in any accident.
  4. The services directly provided by the “Company” (excluding the entrusted cooperative institutions) are interpreted in accordance with Hong Kong law and ordinance. All claims against the “Company” must be handled in Hong Kong, and to the fullest extent permissible by the applicable law, the liability of the “Company” is limited to the total amount of fees paid by customer.
  5. The “Company” have no special knowledge regarding travel regulations, unsafe conditions, health risks, climate hazards, supplier bankruptcies, or suitability for a disabled person of any type of travel. The relevant information provided by the “Company” is for reference only. Customers should research for the latest information released by the official authorities of the destination and comply with relevant regulations to ensure that they meet the travel qualifications. Customer hereby release the “Company” from any claims resulting in whole or in part from the situation mentioned in this paragraph and any other causes not within its control, and agree to submit all other claims against the “Company” within 30 days after the return of trip. All claims must be submitted in writing with precise evidence or supporting documents.
  6. Customers should refer to the relevant travel warnings (if any) before participating in the tours. Whether a customer participates in a tour or not is purely a personal decision. If a customer decides not to participate in a tour due to a local travel warning, it will be deemed to have waived his/ her right, and no refund will be granted. The “Company” will not arrange other alternative tours or services.
  7. For customer who has own air tickets for group travel, he/ she should possess valid travel documents, entry visa, international air tickets, all domestic air tickets, travel insurance and transportation arrangements. Customer must gather at the designated place and time. If the customer has to re-arrange the itinerary, accommodation, flight and cruise as the promoted or suggested package tour did not confirm, all the losses incurred should be responsible by the customers.
  8. In the event of uncontrollable or unexpected, the “Company”, other agents and local service agencies have the right to cancel or replace items in the itinerary before or during the journey, and to shorten or extend the trip. Customers shall raise no objection. Customer participating in the package tour agrees and accepts that the adjusted itinerary is the final arrangement, and this final arrangement do not constitute a violation of the trade descriptions of the tour. Itinerary arrival and departure times are always subject to change without notice. The “Company” reserves the right to cancel, alter, advance, postpone or substitute any scheduled itinerary which, in its sole judgment and discretion, is justified for any reason, and to do so without liability for any loss whatsoever to customers as a result of said change(s).
  9. The “Company” package tour must depart and return at the specified date. If the customer requests to arrive early or extend the stay, the “Company” shall do its best to reserve the corresponding accommodation and other listed items for the customer (if any). Regardless of whether the accommodation for early arrival or extension of stay is confirmed or not, customers are not allowed to withdraw from the tour, request to change the trip date or make any claims for such. Once the request for early arrival or extension of stay is confirmed, it cannot be cancelled or changed, and the package tour booking conditions applied. The customer agrees and accepts that when the package tour has not commenced or the extended stay has begun, the itinerary arranged by the “Company” does not take effect or ends immediately, and the cost, liability, luggage loss, accidental injury and property damage during the stay are at customer’s own risk and liability. The “Company”, its agencies and local service organizations will not be liable for any consequence.
  10. If the customer leaves the group or abandons the itinerary during the trip, the itinerary arranged by the “Company” will be completed and ended right after his/ her departure. After leaving the group, customer is full accountable for their action and hold the “Company”, other agents, local service agencies and its entrusted cooperative institutions harmless against all and any claims.
  11. The ferry tickets/ accommodation/ sightseeing activities and other items included in the itinerary are all group reservations. Once confirmed and ordered, no refund will be arranged to customer who did not avail or drop out from the journey in any circumstances. Alternative itineraries will not be arranged.
  12. Customers must abide by the laws and regulations of various countries, including but not limited to customs, entry or transportation regulations, prohibiting the carrying of restricted articles, prohibiting the use of drone, prohibiting smoking in hotel rooms and accommodation, and other local regulations, etc. Offenders are solely responsible, and the “Company” reserves the right to make claim against the offenders.
  13. Customer must conduct oneself in an orderly and acceptable manner and must not insult, harass, threaten, attack or intimidate other customers, staff and other persons. Customers must follow the reasonable guidelines of safety and schedule announced by the tour guide or other authorized person, in accordance with the overall interests of the group. If, in the “Company” and local service agency’s reasonable opinion, customer fails to comply with the code of conduct, or fails to follow the safety regulations, or fails to follow the guidelines or arrangement of staff, or causes annoyance to others or disrupts to tour operations and safety, it will be regarded as breach of contract. Customer agrees and accepts the “Company” and authorized person reserve the right to take such measures as deem reasonably necessary to prevent continuation of such conduct, including terminate the booking immediately without further liability. The itinerary arranged by the “Company” will be completed and ended immediately for the concerned customer. Minors in the same travel party, aged 18 or below, has to leave the group. In such cases, customer shall not be entitled to any refund or compensation of any kind. Under no circumstances shall the “Company” be liable for any liability, action and cost whatsoever incurred by the customer as a result of such termination of booking.
  14. For all changes of booking, cancellation procedures and reservation requirements, customers must contact and arrange with the “Company” directly. If the customer makes any private deals with the accommodation or local service providers, it will be deemed invalid. The “Company” will not acknowledge any private deals, and has the right to terminate the customer's participation in the package with no refund.
  15. If the “Company” suffers damage or loss due to customer intentions or negligence, acts that violate laws, public order and morals, or the customer fails to comply with the provisions of the “Company” travel agreement, the “Company” may make claims of recovery from the customer.
  16. Customers should keep copies of their travel documents, travel receipts, travel visas and travel insurance policies and all important documents with relevant persons who are easily accessible in case they are lost or damaged during the journey. At the same time, customers should ensure that a copy of the contact information of family members or friends is provided to the tour guide and the “Company” so that the “Company” and authorized person can provide assistance in case of emergency.
  17. If the customer has any allergies (food such as nuts, peanuts, etc.; pollen), he/ she must take appropriate precautions. If the customer suffers from severe allergies, he/ she should consult a doctor for advice on whether it is suitable to participate in the trip or activity under specific circumstances. For any special request, customer must contact the “Company” before the registration deadline. The “Company” shall assist the customer to request arrangements from the local independent travel agents and service agencies, however, the final arrangement by the agent and service agencies shall prevail.
  18. According to the Personal Data (Privacy) Ordinance of the Hong Kong SAR, all customer information will never be provided to third parties, except for the purpose of arranging tours or sightseeing itineraries.
  19. The registration and the terms and conditions are based on the laws of the Hong Kong SAR, and all claims against the “Company” must be initiated in Hong Kong SAR.

BCruise Terms and Conditions

  1. Customer agrees and accepts that all cruise bookings are subject to the terms and conditions of the cruise company.
  2. Please refer to the terms and conditions of the cruise company (English Version) before registration.
  3. Customer agrees and accepts that the cruise company has sole discretion on the stateroom assignment, itinerary, arrival and departure time at port.
  4. Cruise company reserves the right to change itinerary, timing of all embarkations/disembarkations, and port(s) call cancellation due to weather conditions of specific reasons. All of the changes will not be considered as against “The Trade Descriptions Ordinance, Chapter 362, Laws of Hong Kong”. Customers shall not make claims against cruise line or/and the “Company” for any compensation.
  5. If the ship is unable to dock or has to change itinerary due to bad weather, sea situation or any unpredictable or reasons beyond control, customer agrees and accepts cruise company and the “Company” will not be liable for any consequences.

CSpecial Circumstances

  1. All travel documents are the customer’s responsibility. Customer should ensure the required document, including visas and public health documents, are prepared and to comply with customs requirements of the destination, including countries that may just be transiting through. If the customer is denied or delayed entry for any reason, customer should assume full and complete responsibility and the loss incurred to other customers in same group due to the issue raised. The “Company” does not accept any responsibility. Customer needs to arrange additional accommodation, transportation and other related expenses on his/ her own. Unaccomplished group itinerary will not be compensated.
  2. Customer is fully responsible if he/ she is unable to travel due to visa issues (including but not limited to failure to apply for a visa or visa refusal). The “Company” reserves the right to deduct the expenses incurred (including but not limited to the expenses of accommodation, meals, tours) from the tour fares and the administrative fees.
  3. Customer agrees and accepts that the “Company” will not be liable if the customer is denied to entry/ exit the country by local government or airlines, whether it is caused by the issue of customer’s background or any other reasons (whether it is a known or unknow reason), even the customer holds valid travel and visa. The tour fares cannot be refunded or transferred to others or tours. Customer bears the additional cost during the period.
  4. The local service provider will make final decision for the change of the sequence of the itinerary, accommodation, tours and meals due to the special situation and force majeure such as act of God, weather, traffic, flights, trains and ships. Customer shall raise no objection.
  5. The “Company” arranges the accommodation with reference to the itinerary, but reserves the right to make changes depending on the situation. In the event of full house, major event, skiing period and other special circumstances, the accommodation will be replaced with hotels of similar standard in neighbourhood city.
  6. he “Company” and service provider have sole discretion regarding itinerary changes in the event of closure of the attractions and restaurants during festival, holiday or special circumstances.
  7. The itineraries are comprehensive and planned based on the overall group needs. During the journey, customer shall comply with guidelines, recommendations or directions given by the person from service provider. The customer shall conduct a risk tolerance self-assessment about their age, health conditions, weather and nature of the activity before participation of any activities and be fully accountable for all consequence. Doctor or medical professional should be consulted when necessary.
  8. The “Company” or local service agency reserve the right to terminate the participation of any customer who, in the “Company” or local service agency’s reasonable opinion, cannot participation or does not fulfil the requirement to participate in the activity. Customers who have been terminated from the event will not be arranged for any refund or activity replacement.
  9. Customer shall contact the insurance company and submit the claim by their own in the event of any special circumstances which beyond the “Company” control such as flight delay.
  10. Governments and travel organizations may provide the advice for prevention and security of diverse disease and vaccination (e.g. yellow fever). Customer who travels to areas at risk of infection shall pay attention to the relevant information and conduct a risk assessment. Before confirming a trip, customer shall seek advice from doctors or professionals regarding whether the customer’s physical condition is suitable for taking preventive drugs or vaccination, and whether tolerate the side effects that may be caused by vaccination.

DBooking Terms

  1. Travel requirements are different in every country. It is recommended that customer should have a passport which is valid for at least 6 months beyond the end of the trip. Passport should have sufficient blank pages for stamps and visa. Customer who joins a tour in China must allow the “Company” to take and retain copies of the passport or equivalent travel document (such as PRC Resident Identity Card and Mainland Travel Permit for Hong Kong and Macau Residents). Security measures imposed by governments may change from time to time and each customer will be required to comply with them. Please check with the appropriate consulate for specific requirements.
  2. Due to the current travel restrictions in China, most regional authorities in China require all travelers to provide and present valid identification documents (children should bring the original household registration certificate, and those who have not applied for a Resident ID card should bring the original photo household registration certificate) for real-name registration. During the journey, customer should bring along valid documents at all time. Before travel, customers must check the validity of the certificate to ensure it will not affect hotel stays or admission to attractions.
  3. Customers agrees and confirms all traveler details on the booking are full and accurate (as stated in the travel documents), and review the confirmation letter in detail. The “Company” reserves the trip items according to the information provided. Any discrepancies must be brought to the “Company” attention immediately. Amendment will likely result in price differences, loss of reservations and / or incurring amendment or rebooking fee.
  4. The “Company” reserves the right to cancel any request or reservation with false or duplicate names.
  5. Customer should provide accurate and valid contact information (such as mobile phone number and email address) so that the “Company” can contact customer efficiently.
  6. When receiving the confirmation, customer should check it thoroughly to make sure it is correct as to the dates, locations, fares, and package inclusion. The “Company” accepts no responsibility for losses and inconvenience arising from customer’s failure to check the confirmation.
  7. Once the reservation has been confirmed and ordered by the “Company”, the reservation cannot be transferred to other people, travel date or package tour, without the consent and arrangement of the “Company”.
  8. The “Company” recommends that the customer to take out travel insurance, to protect against loss or damage to baggage and personal effects, trip cancellation and emergency evacuations, accidental death or injury, illness and medical expenses sustained or incurred in connection with the trip. It is customer’s responsibility to arrange suitable insurance cover for the activities and event in the holiday.
  9. Please keep the original receipt for refund purpose in special case.
  10. In a package tour, each customer can reserve maximum 3 rooms. If, in the reasonable opinion of the “Company”, the customer reserves more than 3 rooms in total, the “Company” reserves the right to cancel the reservation and charge related fees (if applicable) in accordance with the terms and conditions.
  11. The order must be paid in full in the form of electronic wallet or credit card, and confirmed and posted by the bank before it can be confirmed. All payments are settled in, HK dollar, US dollar or South Korean Won. If the customer pays with currency other than HK dollar, US dollar or South Korean Won, he/ she will be responsible for the difference in exchange rates and handling fees of the bank. For details, please check with the concerned financial institute.
  12. Discounts, exemptions and other promotional offers must be provided and registered at the time of booking.
  13. The tour fares and age definition vary. For details, please refer to the terms and conditions on the respective itinerary leaflet.
  14. Based on the start date of the itinerary, customers under the age of 18 must meet the following registration requirements:
    • Below 15 years old: Must travel with parent or a guardian.
    • 15 years old and above but not yet eighteen: If customer is not traveling with parent or a guardian, he/ she must obtain the consent of the parent or guardian and sign the confirmation letter. Some countries may require travel package insurance for the children or teenagers and a consent form recognized by the country of entry.
  15. Children or infants accompanied by adult need to book in advance, and they need to pay tour fares as to participate in the tour. The “Company” will not provide additional meals, hotel beds and any seat-occupied transportation arrangements (including but not limited to coach seats) for infants. If the customer requests a baby cot, the “Company” will assist the customer to request arrangements for the accommodation, but the accommodation reserves the right to make the final decision.
  16. The “Company” may cancel the booking of any customer who is or becomes ineligible to travel for any reason, or who is travelling without proper documentation. In case of disputes, the “Company” reserves the right to make the final decision.
  17. Whether the package tour will confirm or not is affected by different factors, and the “Company” reserves the right to make the final decision. If the package tour cannot depart as scheduled as decided, the “Company” will refund the tour fares according to the guidelines of the Travel Industry Council of Hong Kong.

E ) Inclusion

  1. Hotel and cruise accommodation: as specified in the itinerary or same standard hotel, accommodation is based on twin-share bedroom. Fare for a room with single occupancy (or surcharge) is based on one person occupies one room.

  3. Meals: meals listed in the itinerary, but in the event of unexpected or uncontrollable incidents, the “Company” and the local independent travel agent have the right to replace the meals in the itinerary.
  4. Tour program: tour program listed in the itinerary, but in the event of unexpected or uncontrollable incidents, the “Company” and the local independent travel agent have the right to replace the program in the itinerary.
  5. Tour host service: tour escort in the destination. The number of participants for each group should not be less than 15 people. Tour host service will not be provided by the “Company” for trip less than 15 people, a local tour guide will be arranged instead. Tour host service provided by individual attractions or countries speaks in English or Chinese. Customer shall raise no objection or requests to withdraw from trip for such.
  6. Levy cost of Travel Industry Council of Hong Kong.

F)Exclusions

  1. Travel documents, Visa fees.
  2. Any gratuities to tour host or tour guide or driver. (Unless specified)
    • Service includes: Liaise with local travel agents and service providers to make arrangements for the package including meals, accommodation, transportation and activities. Hotel check-in and check-out procedures, hotel room allocation. Introduce local customs, etc.
  3. Airport tax, port tax, fuel surcharges, flight insurance tax of various countries. (Unless specified)
  4. All personal expenses.
  5. All sightseeing programs not included in itinerary.
  6. Personal consumption when dining at a local restaurant during the trip.
  7. Accommodation or airport pick-up and drop-off fees for those who arrive early or extend their stay, single room surcharges, room upgrades, or other related fees.
  8. Additional expenses incurred due to personal matters, traffic delays, strikes, typhoons or other circumstances beyond the control of the “Company”
  9. Travel insurance, medicine, baggage insurance, etc.
  10. Liability, delay, loss and compensation caused by personal problems or personal disputes.
  11. Personal medical service expenses and other related expenses.

G) Cancellation and Refund

  1. According to Directive No. 223 issued by the Travel Industry Council of Hong Kong and concerning cancellation of package tours by travel agents for reasons beyond control, if a travel agent cancels a package tour because of ‘reasons beyond control’, it is allowed to collect cancellation charges (if any) and a handling fee clearly stated on the package tour when making refunds to the tour participants.     • If customer chooses to transfer to new group, the difference of the tour fares can be retained for 180 days; or

  1. According to Directive No. 177, “reasons beyond control” mean hostilities, political unrest, terror attacks, natural disasters, pestilences, bad weather, technical problems to transport,  changes  to  the  frequency/timetable  of  any  means  of  conveyance  by  its operator without advance notice, strikes, industrial action, travel advisories (warnings) issued  by  governments of the destinations/ the World Health Organization, red/ black outbound  travel  alerts  issued  by  the  Hong  Kong  SAR Government,  and  any  other situations of which the industry has no control and which are unfavorable to outbound trips of travelers.
  2. If the minimum passenger requirement of the tour does not meet or known or affected by the reasons beyond control, the “Company” has the right to cancel the tour, and make further arrangement based on relevant guideline of Travel Industry Council of Hong Kong. It need not make any extra compensation.
  3. Unless agreed and arranged by the “Company”, the “Company” or its entrusted cooperative institutions will not accept any name change after booking confirmed. Unauthorized traveler change at any time, including before departure, on departure day and during trip, is not allowed. Customers who have signed up will be treated as a waiver, the “Company” also has the right to disqualify the customer with no refund. Customer is fully liable for any consequences.
  4. Customer can request to join the tour in any one of the trip days. However, if customer fails to join back the original tour owning to delay of any reason, the tour fares will not be refunded. Customer is responsible for the direct or indirect personal expenses on accommodation, meals and other losses.
  5. If the customer withdraws or does not participate in any group activities unexpectedly (such as meals, sightseeing or accommodation) during the trip, it will be deemed to have waived automatically. The fee paid will not be refunded, and no substitution will be arranged.
  6. If the customer encounters an emergency or fails to follow the tour itinerary for any reason, the “Company” will assess the situation, and take into account the safety and interests of other group members before deciding whether to arrange a local representative as accompany in destination and provide assistance. Customer shall raise no objection or request compensation by this. In addition, if customer requests further assistance from agents or local service agencies during or after the tour, the additional costs incurred will be borne by the customer.
  7. Once booking confirmed, the customer should submit the request for cancellation, name change, date change or tour change as soon as possible, regardless of the reason. Documentary evidence may be required in support of the request. Once accepted, fee will be deducted according to the terms and conditions of the package (excluding the departure date and notification date). If later, the “Company” cancels the package tour for any reason, this fee will not be refunded.
  8. Cancellation with refund is not allowed for certain tours. For details, please refer to the terms and conditions listed on the relevant itinerary leaflet.

HAdditional Information

  1. When the customer's request imposes any request deemed exceptionally burdensome or beyond a reasonable range, the “Company” reserves the right to reject his/ her reservation.
  2. If in the “Company” reasonable opinion that the customer may cause discomfort, inconvenience to other participants and individuals, obstruct the tour operations, obstruct the business operation. etc., the “Company” reserves the right to reject his/ her reservation.
  3. Customers should always take care of the accompanying children, the elderly and anyone in need of priority.
  4. Some third-party service providers offering certain services and/or activities may require customer to sign their liability waiver prior to participating in the service and/or activity they offer. If customer is unable to fulfil or violate any such supplier's rules and restrictions, it may result in cancellation of reservation(s), being denied access to the applicable travel product or services, forfeiting any monies paid for such reservation(s), and/or the “Company” may make claim for any costs it incurs as a result of such violation.
  5. Customers warrants that he/ she and any person in his/ her care and responsibly shall be physically fit to take the trip. People has chronic disease, is pregnant, has disability or special needed should pay close attention to the health condition and consider if suitable to participate in the trip. The “Company” reserves the right to ask for medical evidence of fitness to travel. Customers must be self-sufficient and/or should travel with a companion to provide any assistance needed during the trip. The “Company” reserves the right to require that customers who is not or deemed not self-sufficient to travel with a companion who shall take responsibility for any assistance needed during the trip and in case of emergency. Customers with any physical or mental disability, mobility problem, other medical condition or handicap which may require special care, treatment or assistance of any kind during the trip (including persons confined to wheelchairs) must report to the “Company” in writing when a reservation is made. If any such disability, mobility problem or condition arises after the reservation has been made then notice must be given to the “Company” as soon as possible. The “Company” may require a medical certificate or other documentation, information or waiver relating to such disability, mobility problem condition as it considers necessary. Moreover, the “Company” reserves the right to reject his/ her reservation or terminate the customer's participation.
  6. The “Company”, local independent travel agents and service agencies staff has no special knowledge of personal care and other related expertise. If the customer needs such assistance, it is recommended that the customer travels with a qualified professional or make appropriate arrangements.
  7. If the customer is suffering from a physical condition or body temperature exceeds 37 degrees (Celsius), the “Company” reserves the right to reject his/ her reservation or to travel with the group. No refund will be provided. All expenses incurred by early departure must be borne by the customer.
  8. For any special needs, the customer should bear the cost of the relevant measures taken by the “Company” according to the request.
  9. Accommodation will be arranged according to the room availability or actual situation. No designated accommodation will be accepted. Check-in room types are as listed in the itinerary. The “Company” does not warrant the room facilities, hotel location and special request by customers (including but not limited to room upgrades, bed types, smoking rooms, etc.), customer should contact the tour host and resolve on the spot for any issue about the hotel room.
  10. Customer should raise any special requirement to the “Company” before confirming the order. Once the request is accepted, it cannot be cancelled or changed, and the customer should pay for the cost (if any) of the special needs taken by the “Company” according to the customer's request. If later the “Company” cancels the package tour for any reason, the relevant fee will not be refunded.
  11. Customer should inform extra bed arrangement upon reservation. Confirmation and fee (if any) will be subject to the “Company” written reply. Extra beds may cause inconvenience to customer as some of the hotel rooms may be packed after the extra bed in placed. Customer should evaluate the situation before confirming the arrangement. Once the extra bed arrangement is accepted, it cannot be cancelled or changed.
  12. The “Company” warrant the food hygiene and food quantity in accordance with the promised standards. However, the flavour or taste of meals may not meet the expectation of customer and it is different across the region.
  13. All vehicles used in the itinerary are dedicated to the group. The model used depends on the number of passengers. The “Company” will arrange a suitable vehicle based on the group size. Customer shall raise no objection.
  14. During the tour, local service providers may provide wireless internet services. The stability and speed of the network may be affected by different factors such as product models, location, actual number of users, signal coverage, and signal reception strength etc. Customers cannot withdraw from the tour for this. At the same time, users are subject to the relevant terms and conditions of the service provider. Customer should make assessment before accepting the service.
  15. Age restrictions will apply for certain tours. For details, please refer to the terms and conditions listed on the relevant itinerary leaflet. For example:
    • For safety reasons, age below 15 need to be accompanied by at least one adult passenger.
    • Due to limited-service capacity, certain routes may not accept customers who are 71 years old or above.
    • Due to limited-service capacity, certain routes may not accept infants who are 14 days to 2 years old.
    • For safety reasons, certain tours may not accept booking for pregnant woman or guest with mobility challenge.
  16. The “Company” has not authorized any person (including tour host and tour guide) to promote optional tour, or activities and products which are not approved by the “Company”. For any dissatisfaction, loss or casualties caused by customers voluntarily participating in such activities or purchasing such products or service, customer should directly negotiate with the agents or service provider for compensation, and the “Company” will not be liable.

IGuidelines on Collection and Use of Personal Data

1. The “Company” will only collect and use the personal information as set out in our Privacy and Cookie Statement. The personal data collected will be treated in a confidential manner and will only be used to provide relevant travel services to customer. During the process, the “Company” may need to transfer the data to relevant travel agents or service providers to arrange and complete relevant travel services. In addition, without the customer's consent, the “Company” will not provide the data to other organizations or persons (except as required by law).

2. Customers can review and update their personal information by login to their membership account.

JInstructions of the Travel Industry Council of Hong Kong

1. The Travel Industry Compensation Fund (TICF) provides protection to outbound travellers who may claim:
(a) An ex gratia payment equivalent to 90% of the loss of outbound fares (commonly arisen from the default of a licensed travel agent); and (b) reimbursement up to HK$300,000 in ex gratia payment, in case of injury or death in an accident during an outbound activity provided or organized by a licensed travel agent.

Although the TICF has provided customer with certain protection, customer is strongly advised to take out travel insurance which meets personal need for a comprehensive protection.

3. Travellers must obtain receipts with levy stamps to have protection by the Travel Industry Compensation Fund.

4. To protect the rights above, it is recommended family members or friends should keep all franked receipts for customer before departure and bring a copy of the receipts during the tour in case of accident or insurance claims.

KAssignability Of Booking Terms

These Booking Terms are personal to individual customer, and customer may not assign these Booking Terms or his/ her rights or obligations there under to a third party without the “Company” prior express written consent. The rights of the “Company” under these Booking Terms may be assigned, and its duties may be delegated.

The “Company” have an absolute discretion to waive any of their rights under these Booking Terms. The “Company” may also waive its rights under these Booking Terms to the extent this is required by the rules and regulations from time to time published by the relevant authorities in Hong Kong. No waiver of by the “Company” of any booking related term or condition set forth in these Booking Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the “Company” to assert a right or provision under these Booking Terms shall not constitute a waiver of such right or provision. If any provision of these Booking Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Booking Terms will continue in full force and effect.

Customer warrants that one possesses all legal authority to use the Website in accordance with these Booking Terms as well as the Website's Terms of Use and Privacy Policy. These Booking Terms, along with the Privacy Policy and Terms of Use applicable to the Website, constitute the entire understanding and agreement between you and the “Company” with respect to all matters relating in any way to the use of the Website for travel bookings and supersede all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to the travel bookings on the Website. Any rights not expressly granted herein are reserved.

The Terms and Conditions has been drafted, and shall be construed, in the Chinese language. Any translation of the Terms and Conditions is solely for reference only. In the event of inconsistency between the Chinese language version and a translated version, the Chinese language version of the Terms and Conditions shall always prevail.

TERMS AND CONDITIONS (FIT RESERVATIONS)

Please take the time to read and understand the Terms and Conditions set out below prior to booking a trip with us. We strongly recommend that customers carefully read all information relating to your trip on our website prior to booking to ensure that customers understand the itinerary you are undertaking. 

TOURTOLOVE Limited reserves the right to change, delete or add new terms. It is customer’s responsibility to read and accept these Terms each time he/ she makes a travel reservation. Customer’s continued use of TOURTOLOVE Limited services after changes, deletions, or additions have been made to these Terms shall constitute customer’s acceptance thereof. In case of any disputes, the TOURTOLOVE Limited reserves the right to make final decision.

 A)Responsibility

  1. The transportation (such as cruises, ships, trains or buses, etc.), accommodation, meals, sightseeing or entertainment arranged for the customers by TOURTOLOVE Limited (the “Company") are not owned, controlled or managed by the “Company”, but is arranged on behalf of the customers or issued receipts, documents, invoices, contracts on behalf of the aforementioned service agents, in accordance with the rules and terms set by aforementioned service agents. Customer understands that all bookings are subject to these Terms and any other service provider specific terms or conditions, including policies, (“service provider terms”) which shall be made available to customer before completing booking. In the event of conflict between these Terms and service provider terms, the relevant provisions of the service provider terms will prevail. In case of traffic delays, baggage loss, accidental casualties, and property losses, etc., the customer agrees and accepts that it will only be directly related to the suppliers and organizations that own, manage, or control the transportation, hotels, restaurants, tourist spots or entertainment items. Or claim, regardless of the outcome of the negotiation, the customer will not ask the "Company" to take any responsibility for this and waive the claim from the "Company". In case of casualties and property losses (e.g. accident happened in a sightseeing or entertainment event), the customer agrees and accepts that it will only be directly related to the suppliers and organizations that own, manage, or control the event. The “Company” will not be liable for that casualties and property losses.
  2. In the event of uncontrollable or unexpected events, the "Company" and other agents and local service agencies have the right to cancel or replace items in the itinerary before or during the journey, and also have the right to shorten or extend the trip. The customer shall not object. Each customer participating in the accommodation package agrees and accepts that the adjusted itinerary is the final arrangement, and this final arrangement will not be regarded as a violation Trade Descriptions Ordinance.
  3. The services of cruise companies, hotels and other travel agencies are not owned, managed or controlled by the "Company". In the event that the customer participating in the "Company" accommodation package suffer from property damage, accidental casualties, natural disasters and human failure, machine failures, traffic delays, fires, strikes, wars, political unrest, or changes in government regulations, etc., which incur losses or incur additional expenses, the customer agrees and accepts that he/ she should not make claim against the “Company” for any recovery.
  4. Except for the personal injury or death of the customer caused by the negligence of the "Company" or its employees, the "Company" shall not be responsible for the personal injury, financial, entertainment or mental loss of the customer in any accident.
  5. The services directly provided by the "Company" (excluding the entrusted cooperative institutions) are interpreted in accordance with Hong Kong law and ordinance. All claims against the "Company" must be handled in Hong Kong, and to the fullest extent permissible by the applicable law, the liability of the “Company” is limited to the total amount of fees paid by customer.
  6. The “Company” have no special knowledge regarding travel regulations, unsafe conditions, health risks, climate hazards, supplier bankruptcies, or suitability for a disabled person of any type of travel. The relevant information provided by the "Company" is for reference only. Customers should find the latest information which released by the official authority of the destination and comply with relevant regulations to ensure that they meet the travel qualifications. Customer hereby release the “Company” from any claims resulting in whole or in part from the situation mentioned in this paragraph and any other causes not within its control, and agree to submit all other claims against the “Company” within 30 days after the return of trip. All claims must be submitted in writing with precise evidence or supporting documents.
  7. Customers should refer to the relevant travel restrictions (if any) before participating in the accommodation package. Whether a customer participates in a package or not is a purely personal decision. If a customer decides not to participate in a package due to a local travel warning, it will be deemed to have waived his/ her right, and no refund will be granted. The "Company" will not arrange other alternative packages or services.
  8. The accommodation package reserved by the “Company” must be utilized at the specified date. If the customer requests to arrive early or extend the stay, the "Company" shall do its best to reserve the corresponding accommodation and other listed items for the customer (if any). Regardless of whether the accommodation for early arrival or extension of stay is confirmed or not, customers are not allowed to withdraw from the package, request to change the package date or make any claims for such. Once the request for early arrival or extension of stay is confirmed, it cannot be cancelled or changed, and the package booking conditions apply. The customer agrees and accepts that when the accommodation package has not commenced or the extended stay has begun, the package arranged by the "Company" does not take effect or ends immediately, and the cost, liability, luggage loss, accidental injury and property damage during the stay are at customer’s own risk and liability. The “Company”, its agencies and local service organizations will not be liable for any consequence.
  9. If the customer leaves by his/ herself or abandons the package during the trip, the package reserved by the "Company" will be finished and ended right after his/ her departure. After leaving, customer is fully accountable for their action and hold the “Company” and its entrusted cooperative institutions harmless against all and any claims.
  10. The ferry tickets/ accommodation/ sightseeing activities and other items included in the itinerary are all group reservations. Once confirmed and ordered, no refund will be arranged to customer who did not avail or drop out from the journey in any circumstances. Alternative itineraries will not be arranged.
  11. Customers must abide by the laws and regulations of various countries, including but not limited to customs, entry or transportation regulations, prohibiting the carrying of restricted articles, prohibiting the use of drone, prohibiting smoking in hotels and accommodation, and other local regulations, etc.; Offenders are solely responsible, and the “Company” reserves the right to make claim against the offenders.
  12. Customer must conduct oneself in an orderly and acceptable manner and must not insult, harass, threaten, attack or intimidate other customers, staff and other persons. If, in the “Company” and local service agency’s reasonable opinion, customer fails to comply with the code of conduct, or fails to follow the guidelines or arrangement of staff, or causes annoyance to others or disrupts to package operations and safety, it will be regarded as breach of contract. Customer agrees and accepts the “Company” and authorized person reserve the right to take such measures as deem reasonably necessary to prevent continuation of such conduct, including terminate the booking immediately without further liability. The package arranged by the “Company” will be finished and ended immediately for the concerned customer. Minors in the same travel party, aged 18 or below, has to leave the group. In such cases, customer shall not be entitled to any refund or compensation of any kind. Under no circumstances shall the “Company” be liable for any liability, action and cost whatsoever incurred by the customer as a result of such termination of booking.
  13. For all changes of booking, cancellation procedures and reservation requirements, customers must contact and arrange with the “Company" directly. If the customer makes any private deals with the accommodation or local service providers, it will be deemed invalid, and the "Company" will not acknowledge any private deals, and has the right to terminate the customer's participation in the package with no refund.
  14. If the "Company" suffers damage or loss due to customer intentions or negligence, acts that violate laws, public order and morals, or the customer fails to comply with the provisions of the "Company" travel agreement, the "Company" may make claims of recovery from the customer.
  15. Customers should keep copies of their travel documents, travel receipts, travel visas and travel insurance policies and all important documents with relevant persons who are easily accessible in case they are lost or damaged during the journey. At the same time, customers should ensure that a copy of the contact information of family members or friends is provided to the "Company" so that “Company” and authorized person can provide assistance in case of emergency. 
  16. For any special request, customer must contact the "Company" before the registration deadline. The "Company" shall assist the customer to request arrangements from the service organization, however, the final arrangement of the service organization shall prevail. "Company" and service organizations do not warrant to meet the requirements. If it fails to accept or meet the customer's requirements, the customer cannot cancel the reservation, request any changes, demand for refund or make any claims.
  17. According to the Personal Data (Privacy) Ordinance of the Hong Kong SAR, all customer information will never be provided to third parties, except for the purpose of arranging package.
  18. The registration and the terms and conditions are based on the laws of the Hong Kong SAR, and all claims against the "Company" must be initiated in the Hong Kong SAR. 

BSpecial Circumstances

  1. All travel documents are the customer’s responsibility. Customer should ensure the required document, including visas and public health documents, are prepared and to comply with customs requirements of the destination, including countries that may just be transiting through. If the customer is denied or delayed entry for any reason, customer should assume full and complete responsibility and the loss incurred due to the issue raised. The “Company” does not accept any responsibility. Customer needs to arrange additional accommodation, transportation and other related expenses on his/ her own. Unaccomplished package will not be compensated.
  2. Customer is fully responsible if he/ she is unable to travel due to visa issues (including but not limited to failure to apply for a visa or visa refusal). The “Company” reserves the right to deduct the expenses incurred (including but not limited to the expenses of accommodation, meals, tours) from the tour fares and the administrative fees.
  3. Customer agrees and accepts that the “Company” will not be liable if the customer is denied to entry/ exit the country by local government or airlines, whether it is caused by the issue of customer’s background or any other reasons (whether it is a known or unknow reason), even the customer holds valid travel and visa. The package fee cannot be refunded or transferred to others or package. Customer bears the additional cost during the period.
  4. The “Company” arranges the accommodation according to the package, but reserves the right to make changes depending on the current situation. In the event of full house, major event, skiing period and other special circumstances, the accommodation will be replaced with hotels of similar standard in neighbourhood city.
  5. The “Company” and service provider have sole discretion regarding item changes in the event of closure of the attractions and restaurants during festival, holiday or special circumstances.
  6. During the journey, customer shall comply with guidelines, recommendations or directions given by the person from service provider. The customer shall conduct a risk tolerance self-assessment about their age, health conditions, weather and nature of the activity before participation of any activities and be fully accountable for all consequence. Doctor or medical professional should be consulted when necessary.

CBooking Terms

  1. Travel requirements are different in every country. It is recommended that customer should have a passport which is valid for at least 6 months beyond the end of the trip. Passport should have sufficient blank pages for stamps and visa. Customer who joins a tour in China must allow the “Company” to take and retain copies of the passport or equivalent travel document (such as PRC Resident Identity Card and Mainland Travel Permit for Hong Kong and Macau Residents). Before travel, customers must check the validity of the certificate to ensure it will not affect hotel stays or admission to attractions. Security measures imposed by governments may change from time to time and each customer will be required to comply with them. Please check with the appropriate consulate for specific requirements. 
  2. Customers agrees and confirms all traveler details on the booking are full and accurate (as stated in the travel documents), and review the confirmation letter in detail. The “Company” reserves the trip items according to the information provided. Any discrepancies must be brought to the “Company” attention immediately. Amendment will likely result in price differences, loss of reservations and / or incurring amendment or rebooking fee.
  3. The “Company” reserves the right to cancel any request or reservation with false or duplicate names.
  4. Customer should provide accurate and valid contact information (such as mobile phone number and email address) so that the “Company” can contact customer efficiently.
  5. When receiving the confirmation, customer should check it thoroughly to make sure it is correct as to the dates, locations, fares, and package inclusion. The “Company” accepts no responsibility for losses and inconvenience arising from customer’s failure to check the confirmation.
  6. Once the reservation has been confirmed and ordered by the “Company”, the reservation cannot be transferred to other people, travel date or accommodation package, without the consent and arrangement of the “Company”.
  7. The "Company" or the service organization has the right to refuse to accept customer or provide any package inclusion, for any discrepancy in the guest details on reservation and guest staying. Customer is fully liable for all expense and consequence. The “Company” has the right to disqualify the customer with no refund.
  8. Each accommodation package lists the maximum occupancy. If the number of people exceeds the limitation, the "Company" or service organization has the right to refuse to check in the customer or require the customer to pay additional surcharge. Customer is fully liable for all expense and consequence. The “Company” has the right to disqualify the customer with no refund.
  9. In an accommodation package, each customer can reserve maximum 3 rooms. If, in the reasonable opinion of the “Company”, the customer reserves more than 3 rooms in total, the “Company” reserves the right to cancel the reservation and charge related fees (if applicable) in accordance with the terms and conditions.
  10. The “Company” recommends that the customer to take out travel insurance, to protect against loss or damage to baggage and personal effects, trip cancellation and emergency evacuations, accidental death or injury, illness and medical expenses sustained or incurred in connection with the trip. It is customer’s responsibility to arrange suitable insurance cover for the activities and event in the holiday.
  11. Please keep the original receipt for refund purpose in special case.
  12. The order must be paid in full in the form of electronic wallet or credit card, and confirmed and posted by the bank before it can be confirmed. All payments are settled in HK dollar, US dollar or South Korean Won. If the customer pays with currency other than HK dollar, US dollar or South Korean Won, he/ she will be responsible for the difference in exchange rates and handling fees of the bank. For details, please check with the concerned financial institute.
  13. Discounts, exemptions and other promotional offers must be provided and registered at the time of booking.
  14. Accommodation provider may require the customer to pay a deposit in the form of a credit card or cash at the time of check-in. Before check-out, customer must pay all miscellaneous charges and personal consumption directly to the accommodation.
  15. The package fee and age definition vary. For details, please refer to the terms and conditions on the respective itinerary leaflet.
  16. Based on the start date of the package, customers under the age of 18 must meet the following registration requirements:
    • Below 15 years old: Must travel with parent or a guardian.
    • 15 years old and above but not yet eighteen: If customer is not traveling with parent or a guardian, he/ she must obtain the consent of the parent or guardian and sign the confirmation letter. Some countries may require travel package insurance for the children or teenagers and a consent form recognized by the country of entry.
  17. Children or infants accompanied by adult need to book in advance, and they need to pay the relevant fees as to avail the package. The "Company" will not provide additional meals, hotel beds and any seat-occupied transportation arrangements (including but not limited to coach seats) for infants. If the customer requests a baby cot, the "Company" will assist the customer to request arrangements for the accommodation, but the accommodation reserves the right to make the final decision.
  18. The “Company” may cancel the booking of any customer who is or becomes ineligible to travel for any reason, or who is travelling without proper documentation. In case of disputes, the “Company” reserves the right to make the final decision.
  19. Whether the package will confirm or not is affected by different factors, and the “Company” reserves the right to make the final decision. If the package cannot be confirmed as scheduled as decided, the “Company” will offer refund according to the terms and conditions of the package.

DInclusion

  1. Hotel Accommodation: as specified in the package or same standard hotel, accommodation is based on twin-share bedroom. Fare for a room with single occupancy (or surcharge) is based on one person occupies one room. Additional fees or taxes may be applied to customers directly during stay in some countries. Please refer to the relevant info on the respective itinerary leaflet.
  2. Meals: meals listed in the package, but in the event of unexpected or uncontrollable incidents, the “Company" and the local service unit have the right to replace the meals in the package.
  3. Transportation: The various of transportation listed in the package, but in the event of unexpected or uncontrollable incidents, the “Company" and the local service unit have the right to replace the transportation in the package.
  4. Sightseeing/ Entertainment program: Sightseeing or entertainment program (if any) listed in the itinerary, but in the event of unexpected or uncontrollable incidents, the “Company" and the local service unit have the right to replace the activities in the itinerary.

EExclusions

  1. Any gratuities to tour leader, driver or service personnel.
  2. Travel documents, Visa fees.
  3. Airport tax, port tax, fuel surcharges, flight insurance tax of various countries. (Unless specified).
  4. All personal expenses.
  5. All meals and sightseeing programs not included in the package.
  6. Personal consumption when dining at a local restaurant during the trip.
  7. Accommodation or airport pick-up and drop-off fees for those who arrive early or extend their stay, single room surcharges, room upgrades, or other related fees.
  8. Additional expenses incurred due to personal matters, traffic delays, strikes, typhoons or other circumstances beyond the control of the "Company".
  9. Travel insurance, medicine, baggage insurance, etc.
  10. Liability, delay, loss and compensation caused by personal problems or personal disputes.
  11. Personal medical service expenses and other related expenses.

F) Cancellation and Refund

  1. If the minimum passenger requirement of the tour does not meet or known or affected by “reasons beyond control”, the “Company” has the right to cancel the package in advance. It need not make any extra compensation.
  2. “Reasons beyond control” mean hostilities, political unrest, terror attacks, natural disasters, pestilences, bad weather, technical problems to transport,  changes  to  the  frequency/timetable  of  any  means  of  conveyance  by  its operator without advance notice, strikes, industrial action, travel advisories (warnings) issued  by  governments of the destinations/the World Health Organization, red/black outbound  travel  alerts  issued  by  the  Hong  Kong  SAR Government,  and  any  other situations of which the industry has no control and which are unfavorable to outbound trips of travelers.
  3. Unless agreed and arranged by the "Company", the "Company" or its service providers will not accept any name change after booking confirmed. Unauthorized traveler change at any time, including before departure, on departure day and during trip, is not allowed.  Customers who have signed up will be treated as a waiver, the "Company" also has the right to disqualify the customer with no refund. Customer is fully liable for any consequences.
  4. Customers can request to join the package in any one of the trip days. However, if customer fails to report their stay owning to delay of any reason, the package fees will not be refunded. Customer is responsible for the direct or indirect personal expenses on accommodation, meals and other losses.
  5. If the customer withdraws or does not participate in any package activities unexpectedly (such as meals, sightseeing or accommodation) during the trip, it will be deemed to have waived automatically. The fee paid will not be refunded, and no substitute will be arranged.
  6. If customers request additional assistance from local service unit or other local organization during the stay or afterwards, the additional expenses incurred will be borne by the customer.
  7. Once booking confirmed, the customer should submit the request for cancellation, name change, date change or package change as soon as possible, regardless of the reason. Documentary evidence may be required in support of the request. If denied, customers should follow the confirmed arrangement, otherwise, all fee will be forfeited. Once accepted, fee will be deducted according to the terms and conditions of the package (excluding the departure date and notification date). If later, the “Company” cancels the accommodation package for any reason, this fee will not be refunded.
  8. Cancellation with refund is not allowed for some packages. For details, please refer to the terms and conditions listed on the relevant itinerary leaflet.

GAdditional Information

  1. In the event that the accommodation facilities and activities are suspended or closed, due to weather or other factors (including but not limited to force majeure, local conditions, maintenance and reconstruction, etc.), the "Company" will not make any compensation.
  2. When the customer's request imposes any request deemed exceptionally burdensome or beyond a reasonable range, the “Company” reserves the right to reject his/ her reservation.
  3. If in the “Company” reasonable opinion that the customer may cause discomfort, inconvenience to other participants and individuals, obstruct the tour operations, obstruct the business operation. etc., the “Company” reserves the right to reject his/ her reservation.
  4. Some third-party service providers offering certain services and/or activities may require customer to sign their liability waiver prior to participating in the service and/or activity they offer. If customer is unable to fulfil or violate any such supplier's rules and restrictions, it may result in cancellation of reservation(s), being denied access to the applicable travel product or services, forfeiting any monies paid for such reservation(s), and/or the “Company” may make claim for any costs it incurs as a result of such violation.
  5. Customers warrants that he/ she and any person in his/ her care and responsibly shall be physically fit to take the trip. People has chronic disease, is pregnant, has disability or special needed should pay close attention to the health condition and consider if suitable to participate in the trip. The “Company” reserves the right to ask for medical evidence of fitness to travel. Customers must be self-sufficient and/or should travel with a companion to provide any assistance needed during the trip. The “Company” reserves the right to require that customers who is not or deemed not self-sufficient to travel with a companion who shall take responsibility for any assistance needed during the trip and in case of emergency. Customers with any physical or mental disability, mobility problem, other medical condition or handicap which may require special care, treatment or assistance of any kind during the trip (including persons confined to wheelchairs) must report to the “Company” in writing when a reservation is made. If any such disability, mobility problem or condition arises after the reservation has been made then notice must be given to the “Company” as soon as possible. The “Company” may require a medical certificate or other documentation, information or waiver relating to such disability, mobility problem condition as it considers necessary. Moreover, the “Company” reserves the right to reject his/ her reservation or terminate the customer's participation.
  6. If customers feel unwell before the journey starts, they should seek professional advice from doctors or professionals. If the customer is suffering from a physical condition or body temperature exceeds 37 degrees (Celsius), the “Company” reserves the right to reject his/ her reservation or to travel with the group. No refund will be provided. All expenses incurred by early departure must be borne by the customer.
  7. For any special needs, the customer should bear the cost of the relevant measures taken by the “Company” according to the request.
  8. Check-in room types are as listed in the itinerary. The “Company” does not warrant the room facilities, hotel location and special request by customers (including but not limited to room upgrades, bed types, smoking rooms, etc.), customer should contact the accommodation provider and resolve on the spot for any issue about the hotel room.
  9. Customer should raise any special requirement to the “Company” before confirming the order. Once the request is accepted, it cannot be cancelled or changed, and the customer should pay for the cost (if any) of the special needs taken by the “Company” according to the customer's request. If later the “Company” cancels the package tour for any reason, the relevant fee will not be refunded.
  10. Customer should inform extra bed arrangement upon reservation. Confirmation and fee (if any) will be subject to the “Company” written reply. Extra beds may cause inconvenience to customer as some of the hotel rooms may be packed after the extra bed in placed. Customer should evaluate the situation before confirming the arrangement. Once the extra bed arrangement is accepted, it cannot be cancelled or changed.
  11. During the trip, local service providers may provide wireless internet services. The stability and speed of the network may be affected by different factors such as product models, location, actual number of users, signal coverage, and signal reception strength etc. Customers cannot withdraw from the tour for this. At the same time, users are subject to the relevant terms and conditions of the service provider. Customer should make assessment before accepting the service.
  12. The "Company" has not authorized any person (including local service organization) to promote optional tour or activities and products which are not approved by the "Company”. For any dissatisfaction, loss or casualties caused by customers voluntarily participating in such activities or purchasing such products or service, customer should directly negotiate with the agents or service provider for compensation, and the “Company” will not be liable.

HGuidelines on Collection and Use of Personal Data

  1. The “Company” will only collect and use the personal information as set out in our Privacy and Cookie Statement. The personal data collected will be treated in a confidential manner and will only be used to provide relevant travel services to customer. During the process, the “Company” may need to transfer the data to relevant travel agents or service providers to arrange and complete relevant travel services. In addition, without the customer's consent, the “Company” will not provide the data to other organizations or persons (except as required by law).
  2. Customers can review and update their personal information by login to their membership account.

IAssignability Of Booking Terms

These Booking Terms are personal to individual customer, and customer may not assign these Booking Terms or his/ her rights or obligations there under to a third party without the “Company” prior express written consent. The rights of the “Company” under these Booking Terms may be assigned, and its duties may be delegated.

The “Company” have an absolute discretion to waive any of their rights under these Booking Terms. The “Company” may also waive its rights under these Booking Terms to the extent this is required by the rules and regulations from time to time published by the relevant authorities in Hong Kong. No waiver of by the “Company” of any booking related term or condition set forth in these Booking Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the “Company” to assert a right or provision under these Booking Terms shall not constitute a waiver of such right or provision. If any provision of these Booking Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Booking Terms will continue in full force and effect.

Customer warrants that one possesses all legal authority to use the Website in accordance with these Booking Terms as well as the Website's Terms of Use and Privacy Policy. These Booking Terms, along with the Privacy Policy and Terms of Use applicable to the Website, constitute the entire understanding and agreement between you and the “Company” with respect to all matters relating in any way to the use of the Website for travel bookings and supersede all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to the travel bookings on the Website. Any rights not expressly granted herein are reserved.

The Terms and Conditions has been drafted, and shall be construed, in the Chinese language. Any translation of the Terms and Conditions is solely for reference only. In the event of inconsistency between the Chinese language version and a translated version, the Chinese language version of the Terms and Conditions shall always prevail.

Please read this General Terms of Use (this “Terms of Use”) in detail before using the TOURTOLOVE Platform and the service (the “Services”) operated by TOURTOLOVE Limited, its affiliated companies (the “Company”) or the third-party operators (the “Operator”). Customers (the “Customer”) when used in this Terms of Use includes any person who access the TOURTOLOVE Platform and persons for whom he/ she make a purchase of the Servies.

This Terms of Use, Privacy Statement, any guidelines concerning Service provision, rules for usage and additional terms shall remain in full force and effect while customer uses TOURTOLOVE Platforms or the Services. Please read this Terms of Use in detail, as they constitute the complete agreement between the Customer and the Company. Customer agrees to use the platform based on legitimate purpose and the specification of this Terms of Use. Additionally, customer agrees not to:

  • Make reservation for travel-related products or services or other products on this platform for the purposes of resale
  • Make any speculative, false, or fraudulent reservation or any reservation in anticipation of demand
  • Access, monitor or copy any content or information of the platform in any form
  • Connect/ link to any section of this platform (including but not limited to, the purchase path for any travel services) for any purpose without the Company’s express written permission
  • Duplicate, copy or re-sell any section of this platform without the Company’s express written permission
  • Interfere or attempt to interfere with the normal operation of this platform or any activity that is conducted on this platform.
  • take any action that imposes, or may impose, in Company’s discretion, an unreasonable or disproportionately large load on the infrastructure;
  • Use this platform in any way that could disable, overburden, damage or impair the site or interfere with any other party’s use of the platform
  • Obtain or disclose unauthorized information in any means (including but not limited to personal information, business content)
  • Send, upload or use any material which does not comply with the content standards set out in these Terms (including but not limited to promotion, sales, malicious disclosure, harassment)

Customer cannot remove, confuse, modify, copy, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or re-sell this information. Customer must not access or use for any commercial purposes any part of the Platform or any service or materials available through the Platform.

Company logo and name are either registered trademarks or trademarks of TOURTOLOVE Limited in Hong Kong. The Company has not approved the usage of trademarks, company name or title, and unapproved usage will be considered as infringe of the Company’s right. Also, other logos, products and company names in the TOURTOLOVE Platform may be the trademarks of their respective owners. The Company accept no liability of any content owned or operate by others parties.

By uploading and sending content to the Company or providing details during activities, customer servers the Intellectual Property Right of this content, and grant the Company and partners royalty-free, nonexclusive, perpetual, irrevocable and sublicensable right to use, deposit, store, copy, modify, create derivative works from and public display this content (for example forward in blog, repost or download content).

With clear and complete supporting, if customer believes the material hosted by the Company or other person infringe his/ her intellectual property right, customer can report to the Company by log-in the membership account. Please note that the Company will not process the complaint if it is not properly filled out or supporting is incomplete. Making of any false statements in the notice may constitute an offence of applicable laws, and may expose the customer to liability for damages.

Platform Service and Content

The intellectual property right and related right of content and service provided by the TOURTOLOVE Platform are fully owned by the Company. By accessing and using the Platform, customer agrees that if it is deemed to be a violation of this Terms or infringe of intellectual property right, the Company reserve to right to refuse to provide content or service to customer and concerned personnel. Upon obtaining the approval from the Company, customer can access and use the platform content for specific use. This authorization is nonexclusive, nontransferable and only for access and usage according to the Terms.

Customers should make all arrangement necessary for them to access to the Platform, and ensuring that all persons who access the Platform through their internet connection are aware of these Terms of Use and comply with them.

The Company reserves the right, at sole discretion, to withdraw or amend the TOURTOLOVE Platform, the services and material provided, at any time without prior notice. Platform content may be updated from time to time, but the content is not necessarily complete or up-to-date. Any of the material on the Platform may be out of date at any given time, and the Company is under no obligation to update such material. The Company accept no liability of any unavailable in all or part of the function or service provided by in the Platform at any time for any reason. From time to time, the Company may restrict the platform access or usage of customer (including but not limited to registered members and other individuals).

The information presented on or through the Platform is made available solely for general information purpose only. The Company is unable to represent or warrant the accuracy, quality and completeness of information in platform, and its suitability for usage. Any reliance customer places on such information is strictly at own risk. The Company will not be responsible for any responsibility arise. The Company also disclaim all liability and responsibility arising from any reliance placed on such material by customer or any other visitor to the Platform, or by anyone who may be informed of any of its contents.

TOURTOLOVE Platform may include materials provided by third parties (for example customer, other personnel, partners, corporate bodies, media etc.). All statements and/ or opinions expressed in these materials, and all articles and responses to questions and other content, other than the content provided by the Company, are solely the opinions and the responsibility of the person or entity providing those materials. That does not necessarily reflect the opinion, recommendations or agreement of the Company. At the same time, the Company is unable to warrant the accuracy and quality of these materials. The concerned party is fully accountable.

Account Registration and Usage Guideline

Customer must register personal account (the “Account”) to utilize the platform service and conduct transactions. The Account should be in active status as to utilize the service sustainably. All Account in not transferable, and all associated right will be terminated once the Account expires.

Upon agree and complete the registration, customer represent (and the Company has the right to rely on that statement) he/ she is 18 years old or above, and possess the legal authority to create a binding legal obligation, and will comply with all terms, conditions and notices.

To access the Platform or some of the resources it offers, customers may be asked to provide certain registration details or other information. Customer should ensure the Account content and all information provided is true, accurate, latest and complete. Customer can amend the Account information directly through the Account or the customer service team.

Customers agree that all information provided to register with this Platform or otherwise, including but not limited to through the use of any interactive features on the Platform, is governed by the Privacy Policy, and customer consent to all actions the Company take with respect to their information consistent with the Privacy Policy of the Company.

Customer has the responsibility to maintain the safety of account and information (for example log-in password, account setting, network safety etc.), and accountable for all activities processed through the Account.

If the customer aware or suspects that unauthorized person access and use the Account information or process unauthorized activities, customer needs to contact the customer service team of the Company the soonest. In this case, if payment details is registered in the Account, customer should contact the payment provider as to minimize the potential loss.

The Company reserve the right to accept Account registration, its usage authority and termination.

Customer’s Contribution and Requirement

TOURTOLOVE Platform and activities may contain message boards, chatrooms, personal webpages or profiles, online chats, bulletin boards and other interactive features. These features allow customer to share, publish and post content and information at or through the Platform.

By providing content (including all text, file, graphic, photo, audio, video and other material) (the “Contribution”), customer grant the Company and partners royalty-free, nonexclusive, perpetual, irrevocable and sublicensable right to use, deposit, store, copy, modify, create derivative works (including but not limited to translation, adaptation and abstract), share, publish, publish and any ways to use the Contributions. Customer also agrees to abandon the copyright and relevant right of all or part of their Contributions.

Customer presents and warrants the Contributions are provided based on legitimate purpose and the specification of this Terms of Use, and be completely responsible. Customer also agrees to comply with below guidelines:

  • Own and control all right in and to the Contribution
  • Does not contain information that may be or promotes illegal, defamatory, libelous, obscene, insult, aggressive, violent, fraudulent, false, disgusting, endanger the safety of others, intend to harass anyone or inappropriate for display on TOURTOLOVE Platform
  • Does not contain information that may be or objectionable on the grounds of public interest, moral and ethics, social order, terrorism, and anything that endanger national security.
  • Does not contain information that is discrimination (including races, sex, religious, nationality, disability, sexual orientation or ages etc.)
  • Does not cause any disturbance, inconvenient, unnecessary anxiety, or create unpleasant, frustration, panic or anger to others
  • Does not involve any business activities, promotion or sales (e.g. any advertisement, contact details or trademarks)
  • Does not contain any irrelevant information to the Platform, Company and activities
  • Does not infringe the intellectual property right and other right of the Company and any third party (for example goodwill and privacy)
  • Impersonate or intent to impersonate the Company, staff, any individual or organization

If customer does not agree with requirement above, please don’t provide any information in TOURTOLOVE Platform. If the Company suspect or receive allegations that the Contribution violates requirements above, the Company can remove, refuse to display the Contribution, or even restrict the customer’s right to use or publish the Contribution.

Customer has complete legal responsibility in their Contribution, including its legality, reliability, accuracy and appropriateness. The Company cannot warrant and present the Contribution is verify before publish and suspicious content can be removed prompted after publication. At no circumstances, the Company accepts no responsibility of any Contribution, whether or not the Company has notice of such content. If customer intent or neglect, constitute legal offense, or does not comply with the regulations, causing loss to the Company or third party, it may expose the customer to liability of damages.

Customers agree that the Company has to right to remove or refuse to post any Contributions for any or no reason in sole discretion. And customer consent to all actions the Company take with respect to any Contribution that deemed necessary or appropriate in sole discretion, including if the Company believe that such Contribution violate the guidelines, Privacy Policy, infringes the right of any person or entity, create liability to any individuals, users of the Platform or the public.

The Company reserve the right to publish, use and removal of Contribution.

If any third party believe the material published on the Platform infringe his/ her right, please email to info@tourtolove.com to make an appeal and provide relevant prove for verification.

Account Termination

Customer can terminate their account anytime. All rights and associated bookings, services and benefits retained will be terminated and forfeited. Please refer to the current membership responsibility and policies.

The Company may suspend, terminated the customer, related accounts and access and usage right for any reason and without notice (including but not limited to suspicious of violations any terms and conditions, infringe of intellectual property rights, signs of fraud, abuse or suspicious activities in customer’s account, inactive account). The Company accepts no responsibility in these actions.

Moreover, the Company may cancel any booking and service associated with the customer’s name, communication or account. If such reservations or services cancelled are non-refundable, the Company reserves its right not to (partial) refund the customer for the cancelled reservations. To contest the cancellation of a booking or freezing or closure of an account, please contact the customer service department.

However, the Company will comply with applicable law and law enforcement authorities or court instructions, to disclose any personal identity or information published in the TOURTOLOVE Platform.

Purchase of Product

Terms and policies vary among the products. Details are presented on the product page and confirmations. Before confirming a purchase, please read carefully and agree with the relevant terms and conditions. Also, product may include additional information for reference.

Reservations of products and services are subject to availability at the time of purchase. Certain services are stated to be subject to instant confirmation. The Company will confirm the purchase order by email. The confirmation will provide detail of the purchase (for example confirmation number, booking status, payment details and product content etc.) Customer can check the order in their account. Please review the details carefully.

Reservations are processed according to the information provided by the customer. Customer has to provide exact name and details as shown on travel documents, and carefully check the participants’ information on the receipt. If customer changes the document content after reservations or locate any discrepancy, the Company should be notified immediately.  Customer may have to pay for the additional cost incurred in rebooking, owning to the amendment of details.

The Company reserve the right to accept or cancel a booking for any or no reason.

Price and Payment

Reservations have to be paid in full by e-wallet or credit card, and posted by the bank. The Company use third party payment services for online transaction. When making a reservation, customer authorized the Company to apply payment to the e-wallet or credit card based on price listed upon confirmation, and present that the customer is authorized to make the payment. Customer should not use invalid or unauthorized e-wallet or credit card for payment. Furthermore, customer accepts the terms and conditions of the third party payment services, and grant that company to collect, process and reserve the relevant information of that transaction.

All payment is settled in HK Dollar, US Dollar or South Korea Won. TOURTOLOVE Platform may provide a currency converter for reference, and will not guarantee or accepts no responsibility of its accuracy. If customer pays in other currency, customer is responsible for any exchange rate different and administration fee by account provider at own risk. Please consult the concerned financial institution for any inquiry.

The Company reserves the right to amend the price and charges at any time, the updated information may be published by email or product pages. If the customer uses after or continue to use the service after the notice, customer agrees and accepts the price and charges after the amendment. The Company strives to ensure that the published price is accurate and complete, however unable to warrant and present there is no mistake or overlook. If error of discrepancy recognized, the Company reserves the right to cancel or (upon agreement with customer) update the price.

Booking Amendment and Cancellation

Customer can amend or cancel booking through the account or customer service department. According to the policy listed on the confirmation, amendment or cancellation will incur charges. Full charges will be deducted for amendment or cancellation of certain products and services after confirmation. For details, please review the terms and conditions in the confirmation. After the amendment or cancellation, the latest confirmation or cancellation will be emailed to the registered address. The booking content and status will also be updated in the account.

If the booking is being cancelled, the Company will notify the customer as soon as reasonably practicable, and provide appropriate arrangement. Customer accepts the Company accept no responsibility to provide any compensation for their dissatisfaction or loss.

Discount Coupon Usage

Discount Coupon is provided and distributed in different form, and being governed by the relevant terms and conditions. Please read the details carefully before application. The Company has the sole discretion to the coupon arrangement and program conditions.

Customer has to retain an active account as to utilize the coupon. All coupon will be terminated and become invalid once the account becomes inactive.

Coupon can only be used in the reservation process of specific products and services. If customer does not apply the coupon during the process, it should not be required to apply after confirmation. Once the coupon is successfully applied, it will be deemed fully redeemed and expired. Any remaining balance will be forfeited.

Coupon is for one time usage. Even the reservation is cancelled for any reason or in other scenario, applied coupon cannot be reused or refunded. The Company will not offer any compensation or other alternatives. Also, the Company will not re-issue the coupon due to human error (for example lost, theft).

Coupon cannot be redeemed for cash or against taxes, cancellation or amendment charges, administration fees or other miscellaneous, which are the sole responsibility of the customer. The Coupon may not be used or combined with other coupons, promotions or special offers.

If customer attempts to use the coupon in an unlawful manner or violate the terms (for example: abuse, fraud, resale), the Company may refuse to accept the coupon and concerned reservations, or even terminate the account. Employee or any related personnel of the promotion (including but not limited to partners) are not allowed to use the coupon.

The Company may revise or cancel the discount coupon and other regulations at any time, without prior notice. For any dispute, the Company reserves the sole discretion.

Reward Credits

Reward credit is accumulated in customer’s account and available for use until expired. The Company has the sole discretion to the program arrangement and conditions.

Customer has to retain an active account as to use the credit. All credit will be forfeited and become invalid once the account is inactive. Credit is personal to the customer and is non-transferable. The Company has the sole discretion to accept or reject the access and usage of the credit.

Reward credit is denominated in U.S. Dollars, and is valid for 1 year from the date allocated to the account. Credit will be deducted from the account after usage. Expired or invalid reward credit will be removed from the account directly without prior notice. Customer can review the credit report and status in the account.

Reward credit cannot be redeemed for cash or against taxes, cancellation or amendment charges, administration fees or other miscellaneous, which are the sole responsibility of the customer. The coupon may not be used or combined with other coupons, promotions or special offers.

If customer attempts to use the credit in an unlawful manner or violate the terms (for example: abuse, fraud, resale), the Company may void the credit and cancel the concerned reservations, or even terminate the account.

The Company may revise, suspend or terminate the program and its regulations without prior notice. From time to time, these changes may affect the value of the reward credit already accumulated at any time. Customer should not reply upon the continued availability of the program, or any earning or redemption offers, or other offers made in connection with the program. For any dispute, the Company reserve the sole discretion.

Liability of Travel

By offering travel products and service in international destinations, the Company does not represent or warrant that travel to such areas is advisable or without risk. Customer should carefully consider the suitability and related risk in choosing and traveling a destination.

The Company has no special knowledge regarding the travel regulations, entry requirements, travel documents, unsafe condition, health risk, weather hazards, supplier bankruptcies or the suitability for a disable person. Customer should seek for latest information announced by the destination’s authorities and fulfil the requirement, as to meet the travel requirement.

Customer has to comply with the local law and reasonable and appropriate code of conduct. If customer experiences loss due to intent or neglect, violation of law, public order, code of conduct or did not follow the travel agreement, the Company accepts no responsibility and may issue claim to customer for any loss incurred.

The Company strongly recommends that customer to take out a comprehensive travel insurance policy prior to departure.

Supplier conditions and restrictions

Additional terms and conditions of the third party operator will apply to customer’s purchase. Please review the additional terms and conditions in detail. Hence, if there is a discrepancy between policies illustrated in the product and service and supplier, the reservations terms should prevail.

The Operator may require customer to provide personal details (for example: identification document, contact information), sign liability waiver, compliance with safety regulations as a prerequisite of participating in the service. If customer cannot participate in the service due to failure in provide information required or fulfil the requirement, the Company and Operator accept no liability and refund request. Reservation will become invalid if the relevant services to be provided are prohibited by local ordinance. If customer attempts to avail the service in an unlawful manner or violate the terms (for example: make false statement, omit to state the true), the Company and Operator may refuse to accept or provide the service, and refund will not be arranged.

Accommodation suppliers may require customer to provide deposit upon check-in, to cover the additional expenses during the stay. Such deposit is a policy of the supplier and unrelated to any reservation fee by the Company.

Customer agrees that any violation of any such supplier's policies and restrictions may result in cancellation of the reservation, being denied access to the concerned product or services, forfeiting any payment. The Company reserve the right for recovery of losses and/ or damages suffered as a result of the action.

Disclaimer of Warranties and Liability Limitation

TOURTOLOVE Platform and its content, and any product or service included on the platform are provided on an “as is” and “as available” basis (without any warranties of any kind, either express or implied), and may be updated from time to time, but the content is not necessarily complete or up-to-date. The Company is unable to represent or warrant the accuracy, quality and completeness of information in platform, and its suitability for usage. Any reliance customer places on such information is strictly at own risk. The Company will not be responsible for any responsibility arise, to the full extent permissible by applicable law. The Company reserve the right to revise any false information and refuse to provide service based on false information.

TOURTOLOVE Platform may include content, product and service provided by third parties.  That does not necessarily reflect the opinion, recommendation or agreement of the Company. At the same time, the Company is unable to warrant the accuracy and quality of these materials. The concerned party is fully accountable. Moreover, the product and service provided in the Platform are not fully owned, managed or controlled by the Company, but by third party operators. The Company is not liable for the acts, errors, omissions, representations, warranties, breaches or negligence of any such operators or for any personal injuries, death, property damage, or other damages or expenses resulting there from. In the event that the customer experiences losses or additional expenses due to property damage, accidental casualties, natural disasters and man-made disasters, machine failures, traffic delays, fires, strikes, wars, political unrest, changes in government regulations and force majeure, the customer agrees and accepts the Company will not be responsible for such expenses.

The Company does not warrant or present that all or part of the function or service provided by the Platform will always be uninterrupted, reliable or error free at any time. The Company cannot guarantee the information and service obtained from the internet or the Platform are free from virus or other harmful components. Customer is responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for anti-virus protection and accuracy of data input and output, and for maintaining a means external to the Platform for any reconstruction of any lost data. Also, it is unable to guarantee that the network transmission is without risk and cannot be read or intercepted by others. Customer is at their own risk. The Company will not be liable for any direct, indirect, special, incidental, consequential or punitive damages arising out of customer’s connection, access and usage of the TOURTOLOVE Platform.

To the full extent permissible by applicable law, the Company specifically disclaims all warranties of any kind, whether express or implied, statutory or otherwise, including without limitation to any warranties of merchantability, non-infringement and fitness for particular purpose.

If the Company, affiliated companies or third party operators believe, at absolute discretion, found liable any losses or damages arises out of the occurrences described above, the liability of the Company and Operators will in no event exceed, in the aggregate, the greater of: (a) the total cost such transaction in the Platform OR (b) One thousand Hong Kong Dollars (HK$1,000.00). If customer does not agree to above terms, regulations or policy, and have dispute in TOURTOLOVE Platform, its content and service, please do not access or use the Platform.

The foregoing does not affect any liability which cannot be excluded or limited under applicable law. In no event will the Company, all directors, its affiliated companies, third party operators, and its employees, supervisors, contractors, agencies, authorized personnel, suppliers, successors and assigns be liable for damages of any kind, under legal theory, arising out of or in connection with customer’s usage (or inability to use) the Platform, any website linked       to it, any content on the Platform or such other websites or any service to items obtained through the Platform or such other website, or infringement of intellectual property right or right of any personnel and organization, including any direct, indirect, special, incidental, consequential or punitive damages, including without limitation of, personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.

Whether the Company has been advised or is aware of the possible losses, the restrictions and exception in this Term will apply.

Indemnification

Customer agrees to defend, indemnify and hold harmless the Company, all directors, its affiliated companies, third party operators, and its employees, supervisors, contractors, agencies, authorized personnel, suppliers, successors and assigns from and against any claims, liabilities, damages, judgements, awards, losses, costs, expenses or fees (including administration and attorneys’ fee) arising out of or relating to his/ her violation of this Terms of Use, warrant, representation, and agreement, or any use of TOURTOLOVE Platform, including but not limited to user’s contribution, and any use of the Platform’s content, product and services other than as expressly authorized in these Terms of Use or own use of any information obtain from the Platform.

TOURTOLOVE Platform may contain hyperlinks to websites or services managed or operated by third parties. The links direct customer away from the Platform. Such links are provided for reference only. That does not necessarily imply Company’s recommendations or endorsement of these links or in connection with the website operator. The Company cannot guarantee the accuracy and quality of content and service in the hyperlinks. The third party should take full responsibility. Customer should carefully consider the risk and all applicable conditions. Also, the Company is under no obligation to involve in any individual transaction and dispute between the customer and any third party.

Maps Terms

TOURTOLOVE Platform may contain content and technology managed and controlled by Google and Microsoft. Customer’s use of mapping is governed by the Terms of Use and Privacy Statement of Google and Microsoft. Google and Microsoft reserve the right to change their Terms of Use and Privacy Statements at any time, at their sole discretion. Please review their terms in detail.

General

The Terms of Use are governed by the laws of Hong Kong SAR. Customer consent to the exclusive jurisdiction of the Hong Kong court and any dispute arising out of or relating to the TOURTOLOVE Platform and the Terms shall be governed by and construed in accordance with the law of Hong Kong SAR. Use of this Platform is unauthorized in any jurisdiction that does not give effect to all provisions of the Terms of Use, including, without limitation, this paragraph.

Customer agrees that no joint venture, partnership, business representative or employment relationship exists between oneself and the TOURTOLOVE Limited as a result of the use of this Platform or account registration.

The Company is responsible to proactively cooperate with any law enforcement authorities or court order, requesting or directing to disclose the record of access and usage of the Platform or other information. Customer waives and hold harmless the Company, all directors, its affiliated companies, third party operators, and its employees, supervisors, contractors, agencies, authorized personnel, suppliers, successors and assigns from any claims resulting from any action taken by the Company or any of the foregoing parties during or as a result of its investigations and from any action taken as a consequence of investigations by either such parties or law enforcement authorities.

To the full extent permissible by applicable law, customer has to bring any claim or cause of action arising from or relating to this Terms or his/ her access or use of this Platform within one (1) year from the date on which such claim or action arose or accrued. Otherwise, such claim or cause of action will be irrevocably waived.

Without the Company’s express written permission, customer cannot assign all or part of his/her rights, duties or obligations arise from this Terms of Use, or through other means. No other person or body has any rights to enforce any terms if the Terms of Use.

The Company may transfer, assign or delegate this Terms of Use, or delegate the provision of services, or perform the duty of this Terms of Use to any third party, without having the consent from customer.

Entire Agreement

The Terms of Use, Privacy Policy, and any regulations, guideline of customer usage and additional conditions constitute the sole and entire agreement between the customer and TOURTOLOVE Limited with respect to the Platform and supersede all prior and contemporaneous understandings, agreements, representations and warranties, both warren and oral, with respect to the TOURTOLOVE Platform.

Waiver and Severability

No waiver of by the Company of any term or condition set forth in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Company to assert a right or provision under there Terms of Use shall not constitute a waiver of such right or provision.

If any provision of the Terms of Use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Use will continue in full force and effect.

Inquiries and Customer Support

For any inquires or report any violation of this Terms of Use, customer can log-in their membership account and provide relevant prove for verification.

Customer’s Comment

Any recommendation, proposal, suggestions or other comment regarding TOURTOLOVE Platform, service, product, Application or technologies may be used by the Company. Customer agrees the Company is not required to notify the customer or have no obligation, and without any restriction, and not necessary to provide any compensation or remuneration, and also agrees to waive all or part of the existing or future right of the content submitted.

Change of Terms of Use

The Company reserve the right to modify any part of this Terms of Use at any time without prior notice. All changes are effective immediately when posted by the Company, and apply to all access to and use of the Platform thereafter. However, any changes to the dispute resolution provisions set forth in Governing Law and Jurisdiction will not apply to any disputes for which the parties have actual notice on or prior to the date the change is posted on the Platform.

It is the customer’s responsibility to periodically review and must agree on the latest Terms of Use, before using the TOURTOLOVE Platform. If customer does not agree with this Terms of Use, please don’t access or use the Platform.

The Company will post the modification on the website and application. If significate change is made, an email or website landing page notification will be issued for customer. The last revised date is listed on at the top of the Terms of Use.

Governing Law

The Terms of Use are governed by the laws of Hong Kong SAR. Customer consent to the exclusive jurisdiction of the Hong Kong court and any dispute arising out of or relating to the TOURTOLOVE Platform and the Terms shall be governed by and construed in accordance with the law of Hong Kong SAR.

The Terms of Use have been drafted, and shall be construed, in the Chinese language. Any translation of the Terms of Use is solely for reference only. In the event of inconsistency between the Chinese language version and a translated version, the Chinese language version of the Terms of Use shall always prevail.
